36Pursuant to notice this cause came on for formal proceeding
46and hearing before P. Michael Ruff, a duly - designated
56Administrative Law Judge of the Division of Administrative

105STATEMENT OF THE ISSUE :
110The issue to be resolved in this proceeding concerns
119whether the Petitioner, because of his race, was given different
129terms and conditions of employment by being denied training,
138being unfairly disciplined, retaliated against, terminated, and,
145if those allegations are proven, what remedy is warranted.
154PRELIMINARY STATEMENT
156This cause arose upon the filing of a Charge of
166Discrimination on February 1, 2007, by the above - named
176Petitioner. After investigation the Florida Commission on Human
184Relations (Commission) made a Determination of "No Cause," after
193which the Petitioner exercised his right to file a Petition for
204Relief and to have the matter referred for formal proceeding to
215the Division of Administrative Hearings. The referral was made
224and the proceeding was ultimately assigned to the undersigned
233Administrative Law Judge.
236The cause came on for hearing as noticed. The Petitioner
246failed to appear at the hearing, and no evidence was adduced in
258proof of the Petitioner's claims. The Petitioner bears the
267burden of proof and, ther efore, inasmuch as no evidence was
278presented for the Petitioner, it was unnecessary for the
287Respondent to go forward with its case and evidence. After
297giving an ample opportunity for the Petitioner to appear and
307prosecute his claim, the hearing was adjour ned.
315FINDINGS OF FACT
3181. The Petitioner, Jimmy O. Gathers, filed a Petition for
328Relief asserting that he was wrongfully terminated from his
337position with the Respondent employer and, before termination,
345was subjected to inadequate and improper training, i nadequate
354work materials, was unfairly disciplined, and was ultimately
362retaliated against and terminated, all because of his race
371(African - American). The cause was set for hearing on the
382Petition for Relief for January 22, 2008, at the Office of the
394Judge s of Compensation Claims, hearing room two, 2401 State
404Avenue, Suite 100, Panama City, Florida, at 10:00 a.m. Central
414Time. The Notice of Hearing was sent to the Petitioner's last
425known address of record at 621 Maine Avenue, Panama City,
435Florida 32401, no tifying the Petitioner of the hearing on the
446above date, time, and place. There was no communication from
456the Petitioner by motion, letter, telephonically, or otherwise
464indicating that the Petitioner had any difficulty which might
473prevent his attending th e hearing at the noticed date, time, and
485place.
4862. Upon convening the hearing, the Petition failed to
495appear. A substantial period of time was allowed to elapse,
505nearly one hour, in which the undersigned and the Respondent and
516Respondent's witnesses wait ed for the Petitioner to appear to
526put on his case. Additionally, various persons in attendance,
535Respondent's counsel and employees or personnel of the
543Respondent were requested and did observe within the building at
553the hearing site and in the immediate environs of the building
564to see if the Petitioner was observed in the vicinity of the
576hearing site. The Petitioner was not observed in the environs
586of the hearing site and never appeared at the hearing during the
598additional time allowed him for his appear ance. Finally, after
608waiting a substantial period of time, as referenced above, it
618was determined that the Petitioner had not appeared to prosecute
628his claim and, since the Petitioner bears the burden of proof in
640this proceeding, it was determined that it was unnecessary for
650the Respondent to adduce any evidence in support of its position
661in this case and the hearing was adjourned.
6693. In excess of one month has elapsed since the hearing
680date, and there has been no communication from the Petitioner
690with th e undersigned, and no indication from the Respondent that
701any communication from the Petitioner has been received by the
711Respondent, which might explain the Petitioner's absence from
719the noticed hearing.
722CONCLUSIONS OF LAW
7254. The Division of Administrativ e Hearings has
733jurisdiction of the subject matter of and the parties to this
744proceeding. §§ 120.569 and 120.57(1), Fla. Stat.
7515. The Petitioner bears the burden of proof in this
761proceeding St. Mary's Honor Center v. Hicks , 509 U.S. 502
771(1993). The Petit ioner failed to appear and has failed to
782communicate with the undersigned and no indication from the
791Respondent has been received by the undersigned which would
800indicate any effort by the Petitioner to communicate with the
810Respondent on the day of or since the day of the noticed
822hearing. The Petitioner bears the burden of proof in this
832proceeding to put on evidence probative of his claims regarding
842racial discrimination in the employment practices of the
850Respondent. The Petitioner failed to appear and put on such
860evidence. Therefore, the Respondent had no necessity to adduce
869evidence in support of its case. After waiting a substantial
879period of time, nearly an hour, with no appearance from the
890Petitioner, the hearing was adjourned. Inasmuch as no cause has
900been demonstrated by the Petitioner for his failure to appear
910and prosecute his claims, it is determined that the Petitioner
920has failed to prosecute his claim. Therefore, at this time, in
931excess of one month after the time and date set for hearing,
943th is matter should be dismissed for lack of prosecution.
953RECOMMENDATION
954Having considered the foregoing Findings of Fact,
961Conclusions of Law, it is, therefore,
967RECOMMENDED that a final order be entered by the Florida
977Commission on Human Relations dismissing the subject petition in
986its entirety.
