153Whether the Departments intended award of contract E2K97
161for Asset Maintenance of the Duval County Roadways is contrary
171to the agencys governing statutes, the agency rules or policies

187PRELIMINARY STATEMENT
189This is a procurement protest proceeding initiated by
197Petitioner, Erosion Stoppers, Inc. (ESI) to protest the
205Florida Department of Transportations (FDOT) intended
211contract award to Intervenor, DeAngelo Brothers, Inc., d/b/a DBI
220Services Corporation ("DBI"). The Request for Proposal for
230contract number E-2K97 was posted on June 18, 2007. ESI did not
242file a notice of protest of the RFP terms, conditions, or
253specifications within 72 hours of the posting.
260FDOT posted its notice of intent to award the contract to
271DBI on September 4, 2007. ESI timely filed its Notice of Intent
283to protest the intended award to DBI. That Formal Written
293Protest was filed on October 22, 2007. An order granting DBI
304intervention status was entered on November 7, 2007.
312On November 30, 2007, ESI filed a motion requesting leave
322to file an Amended Formal Written Bid Protest. FDOT and DBI
333objected to the motion. After hearing argument of counsel at a
344duly noticed hearing, ESI was granted leave to file its amended
355petition on February 12, 2008.
360The amended petition alleges that FDOTs scoring of ESIs
369proposal was arbitrary or capricious. It also alleges that the
379RFPs method for ranking proposals conflicts with FDOT procedure
388in two respects. First, ESI claims that FDOT procedure number
398375-000-005a requires that the technical proposals be evaluated
406by at least five people. The parties agree that the RFP
417requires only three evaluators. Second, ESI asserts that FDOT
426procedure number 375-000-005a requires the scoring of the
434technical proposals be weighted as follows: Management Plan
442(50%) and Technical Plan (50%). The parties agree that the RFP
453provides that the scoring of the technical proposals is to be
464weighted as follows: Administration Plan (20%), Management and
472Technical Plan (30%), Operation Plan (30%), and Plan for
481Compliance with Standards (20%). ESI asserts in its amended
490petition that these conflicts between the RFPs method of
499ranking proposals and the FDOT procedure require rejection of
508all bids.
510At the formal hearing held on February 22, 2008, ESI raised
521a third objection with the RFPs method of ranking proposals,
531i.e., that the evaluators did not establish the RFPs criteria
541for ranking proposals as required by FDOT procedure number 375-
551000-005a. This allegation was not pled by ESI in its petition
562or its amended petition. As a consequence, prior to the
572presentation of evidence, the undersigned ruled that ESIs
580objections to the RFPs method of ranking proposals were time-
590barred because it failed to protest the RFP terms, conditions,
600or specifications within 72 hours of the solicitation posting.
609ESI was told that the presentation of evidence would be limited
620to evidence supporting its contention that FDOTs scoring of the
630RFP was arbitrary or capricious, and that it could proffer all
641evidence supporting its challenge to the RFPs method of ranking
651proposals with its post-hearing submission. After this ruling
659was announced, counsel for ESI withdrew its challenge to the
669scoring of its proposal and announced his clients intention to
679appeal the ruling that the remaining allegations of its protest
689are time-barred.
691Joint Exhibits 1-7 were admitted without objection. No
699witnesses were called to testify. The transcript of the hearing
709was filed on March 6, 2008. The parties submitted proposed
719recommended orders, which were duly considered by the
727undersigned before entering this Recommended Order.
733FINDINGS OF FACT
736The following facts were agreed between the parties in
745their Joint Pre-Hearing statement:
7491. On June 18, 2007, FDOT posted the solicitation for
759asset maintenance of the Duval County Roadways through
767procurement E-2K97.
7692. The RFP requested technical proposals and bids for a
779five-year contract for maintenance of identified roads in Duval
788County.
7893. The RFP provides that the scoring of the technical
799proposals is to be weighted as follows: Administration Plan
808(20%), Management and Technical Plan (30%), Operation Plan
816(30%), and Plan for Compliance with Standards (20%).
8244. ESI did not file a protest of the RFP's terms,
835conditions, specifications, or provisions governing the method
842of ranking proposals within 72 hours of the posting of the
853solicitation.
8545. A mandatory pre-bid meeting was held on July 10, 2007.
8656. The technical and price proposals for this project were
875due by August 9, 2007.
8807. Four firms submitted timely proposals in response to
889the RFP. They were ESI, DBI, Infrastructure Corporation of
898America (ICA) and VMS.
9028. The proposals were evaluated by three registered civil
911engineers who are employed by FDOT: Jerry Ausher, Julius
920Rinosa, and Mark Kuhn.
9249. All four firms were determined to be responsive and received scores on their technical proposal and price proposal.
94310. DBI's average score on its technical proposal was 88,
953the highest of the four firms.
95911. ESI's average score on its technical proposal was
96875.33, the lowest of the four firms.
97512. ESI's price proposal bid was $44,759,500.00, the lowest of the four firms.
99013. DBI's price proposal bid was $48,748,886.00, the
1000second lowest of the four firms.
100614. After combining the technical scores and price
1014proposal scores, the total proposal scores for the four firms
1024were as follows: DBI = 89.14, VMS = 85.19, ESI = 82.73, and
1037ICA = 82.68.
104015. On September 4, 2007, FDOT posted its notice of
1050intended award to DBI as the winning bidder.
105816. ESI filed a notice of intent to protest on
1068September 7, 2007, followed by a formal written protest on
1078September 17, 2007.
108117. DBI filed a Petition to Intervene which was granted on
1092November 7, 2007.
109518. As the intended awardee, DBI has a substantial
1104interest in the outcome of this proceeding and thus, has
1114standing to intervene.
1117CONCLUSIONS OF LAW
112019. The Division of Administrative Hearings has
1127jurisdiction over the parties to and subject matter of this
1137proceeding pursuant to Section 120.57(3), Florida Statutes
1144(2007).
114520. ESI has the burden of proof in this proceeding.
1155§ 120.57(3)(f), Fla. Stat. (2007).
116021. In a competitive-procurement protest, other than a
1168rejection of all bids, the administrative law judge shall
1177conduct a de novo proceeding to determine whether the agency's
1187proposed action is contrary to the agency's governing statutes,
1196the agency's rules or policies, or the solicitation
1204specifications. The standard of proof for such proceedings
1212shall be whether the proposed agency action was clearly
1221erroneous, contrary to competition, arbitrary, or capricious.
1228§ 120.57(3)(f), Fla. Stat.; see also State Contracting &
1237Engineering Corp. v. Dept. of Transportation , 709 So. 2d 607,
1247609 (Fla. 1st DCA 1998) (purpose of a bid protest proceeding is
1259to evaluate the action taken by the agency in relation to the
1271standards in Section 120.57(3)(f), Florida Statutes).
127722. As the protestor, ESI must show not only that the
1288proposed award is contrary to the RFP, but must also show that
1300the proposed award is clearly erroneous, contrary to
1308competition, or an abuse of discretion. Syslogic Technology
1316Services, Inc. v. South Florida Water Management Dist ., 2002
1326Fla. Div. Adm. Hear. WL 76312 (DOAH Jan. 18, 2002).
133623. Section 120.57(3)(b), Florida Statutes, provides in
1343pertinent part that:
1346With respect to a protest of the terms,
1354conditions, and specifications contained in
1359a solicitation, including any provisions
1364governing the methods for ranking bids,
1370proposals, or replies . . . the notice of
1379protest shall be filed in writing within 72
1387hours after the posting of the solicitation.
1394The RFP was posted on June 18, 2007. ESI did not file a notice
1408of protest within 72 hours of the posting as required by section
1420120.57(3)(b). In fact, it did not raise any formal objection to
1431the RFP terms, conditions or specifications until after FDOT
1440posted its notice of intent to award the contract to DBI. ESIs
1452protest of the RFPs method of ranking proposals is, therefore,
1462time-barred. Consultech of Jacksonville, Inc. v. Dep't. of
1470Health , 876 So. 2d 731 (Fla. 1st DCA 2004)(affirming the
1480agencys final order rejecting untimely protest of RFP's
1488specifications); Optiplan Inc. v. School Bd. of Broward County ,
1497710 So. 2d 569 (Fla. 4th DCA 1998)(bidder waived right to
1508challenge school board's evaluation criteria because it failed
1516to bring protest within 72 hours of publication of bid
1526solicitation); Capeletti Brothers, Inc. v. Dep't. of
1533Transportation , 499 So. 2d 855 (Fla. 1st DCA 1986)(holding
1542bidder waived right to protest bid solicitation specifications
1550when it failed to bring challenge within 72 hours of receipt of
1562project plans).
156424. At the formal hearing, ESI voluntarily withdrew its claim that the scoring of its proposal was arbitrary or capricious and elected not to offer any evidence to support this assertion. Consequently, ESI has failed to meet its burden to demonstrate that FDOTs scoring of its proposal was arbitrary or capricious.
161525. ESI failed to establish that FDOTs proposed award of
1625the contract to DBI is clearly erroneous, contrary to
1634competition, or an abuse of discretion and thus, failed to meet
1645its burden of proof under Section 120.57(3)(f), Florida
1653Statutes.
1654RECOMMENDATION
1655Based on the foregoing Findings of Fact and Conclusions of
1665Law, it is recommended that Petitioners Amended Formal Written
1674Bid Protest be dismissed.
