95STATEMENT OF THE ISSUE

99The issue is whether Petitioner meets the academic

107requirements to sit for the practical nursing equivalency

115examination in Florida.

118PRELIMINARY STATEMENT

120Petitioner, Angela Sessa ("Petitioner"), applied for

128licensure by examination as a practical nurse. By Notice of

138Intent to Deny ("Notice") dated August 21, 2008, Respondent,

149Board of Nursing ("Board"), advised Petitioner of its intent to

161deny her application because she had not successfully completed

170the Adult Health Care III course. According to the Notice,

180Petitioner had not completed the course that covered the

189oxygenation, circulation and hematology systems, all of "which

197are critical to the practice of practical nursing." On or about

208September 25, 2007, Petitioner requested a hearing on the

217proposed denial.

219At the hearing, Petitioner testified on her own behalf and

229presented the testimony of Rise Sandrowitz, the program manager

238for the nursing program at Hillsborough Community College

246("HCC"). Petitioner's Exhibits 1 and 2 were admitted into

257evidence. Respondent did not present any witnesses.

264Respondent's Exhibits 1, 2 and 3 were admitted into evidence.

274The hearing Transcript was filed on May 8, 2008. At the

285conclusion of the hearing, the time for filing proposed

294recommended orders was set for ten days after the Transcript was

305filed. Petitioner did not file a proposed recommended order.

314Respondent timely submitted a Proposed Recommended Order which

322has been carefully considered in the preparation of this

331Recommended Order.

333FINDINGS OF FACT

3361. Petitioner attended the registered nursing program

343at HCC.

3452. On or about March 1, 2007, Petitioner applied to sit

356for the practical nursing licensure examination.

3623. By letter dated May 8, 2008, the Board notified

372Petitioner that additional information was required to complete

380her application. According to the letter, two submissions were

389required. First, the director of nursing at HCC needed to

399submit a letter stating that Petitioner's coursework meets the

408practical nursing educational equivalency. Second, Petitioner

414needed to submit verification that she completed coursework in

423medical-surgical nursing (oxygenation, circulation and

428hematology).

4294. Rise Sandrowitz, program manager of the nursing program

438at HCC, submitted a letter to the Board. In the letter dated

450June 8, 2008, Ms. Sandrowitz stated that while Petitioner was a

461student at HCC, she "twice attempted but was unsuccessful in

471Adult Health III."

4745. The Adult Health Care III course is a 5.5 credit hour

486course and covers topics of oxygenation, circulation and

494hematology.

4956. Ms. Sandrowitz' letter does not state that the courses

505Petitioner completed in the professional nursing program at HCC

514met the requirements for the practical nursing equivalency.

5227. Ms. Sandrowitz testified credibly that the intent of

531her letter was to recommend that Petitioner be allowed to sit

542for the examination, if the Board determined that Petitioner's

551coursework met the practical nursing equivalency requirements.

5588. The Board determined that Petitioner's failure to

566successfully complete the course that covered the oxygenation

574(respiratory), circulation, and hematology systems demonstrated

580that she did not meet the practical nursing equivalency

589requirements.

5909. Petitioner testified credibly that each time she took

599the Adult Health Care III course, she attended "all lectures and

610every clinical," took every test and quiz, and completed all

620assignments. Nevertheless, Petitioner did not successfully

626complete the course. Each time Petitioner took the course, she

636was "just short of the 80%" needed to pass the lecture part of

649the course.

65110. Despite her failure to pass Adult Health Care III,

661Petitioner argues that she has adequate knowledge in all nursing

671areas, including those systems covered in that course and, thus,

681should be allowed to sit for the practical nursing examination.

691CONCLUSIONS OF LAW

69411. The Division of Administrative Hearings has

701jurisdiction over the parties to and the subject matter of these

712proceedings. §§ 120.569 and 120.57(1), Fla. Stat. (2007).

72012. The Board of Nursing is the state agency responsible

730for the licensing of registered nurses and licensed practical

739nurses in Florida and the regulation of the nursing profession

749in this state.

75213. As an applicant for licensure, whose license is

761preliminarily denied, Petitioner bears the ultimate burden of

769demonstrating, by a preponderance of the evidence, entitlement

777to such licensure. See Espinoza v. Department of Business and

787Professional , 739 So. 2d 1250, 1251 (Fla. 3d DCA 1991); and

798Florida Department of Transportation v. J.W.C. Co., Inc. ,

806396 So. 2d 778 (Fla. 1st DCA 1981).

81414. The specific requirements for professional nursing and

822practical nursing programs include theoretical instruction and

829clinical experience in medical, surgical, obstetric, pediatric,

836geriatric, and psychiatric nursing. Fla. Admin. Code

843R. 64B9-2.006(2)(c)1. and (3)(a)1.

84715. Petitioner is seeking to qualify to take the practical

857nursing examination based on "practical nursing educational

864equivalency."

86516. Applicants may qualify to take the examination for

874licensure for practical nursing on the basis of courses

883completed in a professional nursing program, which are at least

893equivalent to the practical nursing program. § 464.008(1)(c),

901Fla. Stat.; and Fla. Admin. Code R. 64B9-3.002(1)(d).

90917. To establish that the courses completed are the

918requisite practical nursing educational equivalency, requires

924the submission of documentation from the professional nursing

932school. The documentation submitted must state that the "number

941of completed clock hours or theoretical and clinical

949instruction" is comparable to the practical nursing program

957requirements prescribed in Florida Administrative Code Rule

964Chapter 64B9-2. See Fla. Admin. Code R. 64B9-3.002(1)(d).

97218. In instances where documentation is submitted by the

981professional nursing school, the Board may accept such

989documentation as evidence that the completed clock hours or

998theoretical and clinical instruction is comparable to the

1006practical nursing program requirements set forth in Florida

1014Administrative Code Rule Chapter 64B9-2.

101919. The professional nursing school that Petitioner

1026attended did not submit documentation that stated the number of

1036completed clock hours or theoretical and clinical instruction is

1045comparable to the practical nursing program requirements

1052prescribed by rule.

105520. Petitioner failed to establish that the courses she

1064successfully completed in the professional nursing program at

1072HCC are the equivalent or comparable to practical nursing

1081program requirements set forth by rule.

1087RECOMMENDATION

1088Based on the foregoing Findings of Fact and Conclusions of

1098Law, it is

1101RECOMMENDED that a final order be entered which denies

1110Petitioner, Angela Sessa's, application to sit for the

1118examination for licensure as a practical nurse in Florida.
