88STATEMENT OF THE ISSUE

92The issue in the case is whether the application filed by

103the Petitioner for licensure to operate a family day care home

114should be approved.

117PRELIMINARY STATEMENT

119By certified letter dated August 31, 2007, the Department

128of Children and Family Services (Respondent) notified Ms. Evelyn

137Figueroa (Petitioner) that her application for licensure to

145operate a family day care home was denied. The Petitioner filed

156a request for hearing with the Respondent. The matter was

166originally scheduled for an informal hearing, but was

174subsequently referred to the Division of Administrative Hearings

182for a formal proceeding.

186The Petitioner did not attend the hearing. The Respondent

195presented the testimony of two witnesses and had Exhibits 1

205through 6 admitted into evidence.

210No transcript of the hearing was filed. The Respondent

219filed a Proposed Recommended Order.

224FINDINGS OF FACT

2271. On December 11, 2006, the Petitioner filed an

236application with the Respondent for licensure to operate a

245family day care home.

2492. The application included the following question:

256Has the owner/operator ever had a license

263denied, revoked, or suspended in any state

270or jurisdiction or been the subject of a

278disciplinary action or been fined while

284employed as a family day care home provider.

2923. The application clearly stated that falsification of

300application information was grounds for denial of the license.

3094. The Petitioner responded "no" to the question regarding

318whether a previous license had ever been denied, revoked or

328suspended.

3295. The Petitioner's response to the question was false.

3386. The Petitioner previously operated a licensed family

346day care home in Osceola County, Florida. The license was

356revoked in 2003 for the reasons set forth in a Notice of

368Revocation sent to the Respondent by certified mail dated

377August 6, 2003.

3807. There is no evidence that the Respondent did not

390receive the Notice of Revocation.

3958. The evidence is unclear as to the number of the revoked

407license number which appears as FO7OS0002 in the August 6, 2003,

418Notice of Revocation and as FO9OS0002 in the August 31, 2007,

429Notice of Denial at issue in this proceeding. Nonetheless, the

439evidence clearly establishes that the family day care home

448license held by the Petitioner in 2003 was revoked.

457CONCLUSIONS OF LAW

4609. The Division of Administrative Hearings has

467jurisdiction over the parties to and subject matter of this

477proceeding. §§ 120.569 and 120.57(1), Fla. Stat. (2007).

48510. The Petitioner has the burden of establishing

493entitlement to the licensure sought in this proceeding by a

503preponderance of the evidence. See Department of Banking &

512Finance, Division of Securities & Investor Protection v. Osborne

521Stern & Company , 670 So. 2d 932, 934 (Fla. 1966); Ferris v.

533Turlington, 510 So. 2d 292 (Fla. 1987); § 120.57(1)(j), Fla.

543Stat. (2007). Because the Petitioner did not attend the hearing

553and presented no evidence, the burden has not been met.

56311. The evidence establishes that a prior license for a

573family day care home operated by the Petitioner had been

583revoked, that the Petitioner was notified of the revocation, and

593that the Petitioner failed to disclose the information on the

603application at issue in this proceeding.

609RECOMMENDATION

610Based on the foregoing Findings of Fact and Conclusions of

620Law, it is RECOMMENDED that the Petitioner's application for

629licensure to operate a licensed family day care home be denied.
