123STATEMENT OF THE ISSUE

127The issue in this case is whether Petitioners' proposed

136motorcycle dealership would serve a community or territory in

145which Respondent's dealership is not presently providing

152adequate representation of the same line-make vehicles that

160Petitioners would offer.

163PRELIMINARY STATEMENT

165On March 14, 2008, an advertisement was published in the

175Florida Administrative Weekly , which gave notice that, unless a

184protest were timely filed, the Department of Highway Safety and

194Motor Vehicles would approve the application of Petitioner USA

203Wholesale Scooters, Inc. for a license to establish a new

213dealership at 2902 East Sunrise Boulevard, Fort Lauderdale,

221Florida, where motorcycles manufactured by Petitioner Chuanl

228Motorcycle USA, Ltd. would be offered for sale. On March 27,

2392008, Respondent Power & Play Warehouse, Inc. filed a written

249complaint with the Department, protesting Petitioner's

255application. The Department immediately forwarded Respondent's

261complaint to the Division of Administrative Hearings ("DOAH")

271for a hearing.

274The final hearing took place on June 10, 2008, as

284scheduled, with both parties present. Noel Farbman, who is an

294owner of Petitioner, testified on his company's behalf.

302Petitioner presented no other evidence. Thomas McMahon

309testified on behalf of Respondent, of which he is the owner. In

321addition, Respondent's Exhibits 1 and 2 were admitted into

330evidence without objection.

333The final hearing transcript was filed with DOAH on

342August 15, 2008. The parties were instructed to submit their

352respective Proposed Recommended Orders on or before August 25,

3612008, which they did.

379FINDINGS OF FACT

3821. On March 14, 2008, an advertisement was published in

392the Florida Administrative Weekly , which gave notice that,

400unless a protest were timely filed, the Department of Highway

410Safety and Motor Vehicles ("Department") intended to approve the

421application of Petitioner USA Wholesale Scooters, Inc.

428("Wholesale Scooters") for a license to establish a new

439dealership at 2902 East Sunrise Boulevard, Fort Lauderdale,

447Florida (the "Proposed New Point"), where motorcycles

455manufactured by Petitioner Chuanl Motorcycle USA, Ltd.

462("Chuanl") would be offered for sale.

4702. Respondent Power & Play Warehouse, Inc. ("Power &

480Play"), which is licensed to operate a dealership, under a

491franchise agreement, for the sale of Chuanl motorcycles in

500Pompano Beach, Florida (the "Existing Dealership"), timely filed

509a written complaint with the Department, protesting the intended

518approval of the Proposed New Point.

5243. The Proposed New Point and the Existing Dealership are

534both situated in Broward County, Florida. It is undisputed that

544the population of Broward County exceeds 300,000.

5524. At the final hearing, the parties stipulated that the

562Proposed New Point would be located within 12.5 miles of the

573Existing Dealership.

5755. Wholesale Scooters failed to present persuasive

582evidence demonstrating that the Existing Dealership is not

590providing adequate representation of Chuanl motorcycles in Fort

598Lauderdale, Pompano Beach, Broward County, or any other

606conceivably relevant community or territory.

611CONCLUSIONS OF LAW

6146. DOAH has personal and subject matter jurisdiction in

623this proceeding pursuant to Sections 120.569 and 120.57(1),

631Florida Statutes.

6337. Section 320.642, Florida Statutes, provides as follows:

641(2)(a) An application [for a license to

648establish an additional motor vehicle

653dealership within a community or territory

659where the same line-make vehicle is

665presently represented by a franchised motor

671vehicle dealership] shall be denied when:

6771. A timely protest is filed by a presently

686existing franchised motor vehicle dealer

691with standing to protest as defined in

698subsection (3); and

7012. The licensee fails to show that the

709existing franchised dealer or dealers who

715register new motor vehicle retail sales or

722retail leases of the same line-make in the

730community or territory of the proposed

736dealership are not providing adequate

741representation of such line-make motor

746vehicles in such community or territory.

752The burden of proof in establishing

758inadequate representation shall be on the

764licensee[, that is, the applicant].

769(Emphasis added.)

7718. An existing franchised dealer has standing to protest

780an application to establish a new dealership if (a) the proposed

791dealership would sell or service the same line-make vehicles for

801which the existing dealer has a franchise agreement and (b) at

812least one other requirement or condition is met. See §

822320.642(3), Fla. Stat. One such additional condition is that

831the "existing motor vehicle dealer or dealers of the same line-

842make have a licensed franchise location within a radius of 12.5

853miles of the location of the proposed" new dealership. See

863320.642(3)(b)1., Fla. Stat. An existing dealer which satisfies

871this particular condition, as does Power & Play, shall have

881standing to bring a protest against the proposed dealership,

890provided "the proposed additional . . . motor vehicle dealer is

901to be located," as here, "in a county with a population of more

914than 300,000." Id.

9189. Power & Play meets the foregoing conditions and thus

928has standing to protest.

93210. Because Wholesale Scooters failed to prove inadequate

940representation, Power & Play's protest effectively blocks the

948establishment of the Proposed New Point. The Department must

957deny Wholesale Scooters' application.

961RECOMMENDATION

962Based on the foregoing Findings of Fact and Conclusions of

972Law, it is RECOMMENDED that the Department enter a final order

983denying Wholesale Scooters' application for a license to operate

992a new dealership at 2902 East Sunrise Boulevard, Fort

1001Lauderdale, Florida, where Chuanl motorcycles would be offered

1009for sale.
