99STATEMENT OF THE ISSUE
103Whether the Petitioner's application for licensure by
110endorsement as a Dietitian/Nutritionist should be granted or
118denied for the reasons stated in the Notice of Intent to Deny
130dated April 15, 2008.
134PRELIMINARY STATEMENT
136In a Notice of Intent to Deny dated April 14, 2008, the
148Board of Medicine, Dietetics and Nutrition Council ("Council")
158notified Larisa Alonso that her application for a
166Dietitian/Nutritionist license by endorsement was denied. The
173Council stated that Ms. Alonso was licensed in Washington State
183as a certified nutritionist and had failed to prove that "the
194criteria for issuance of a Washington State nutritionist license
203is substantially equivalent to the criteria for
210Dietitian/Nutritionist license in the State of Florida, as
218required by Section 468.513, F.S. Ms. Alonso timely requested
227an administrative hearing to resolve disputed issues of material
236fact, and the Council forwarded the matter to the Division of
247Administrative Hearings for assignment of an administrative law
255judge. Pursuant to notice, the final hearing was held on
265October 17, 2008.
268At the hearing, Ms. Alonso testified in her own behalf, and
279Petitioner's Exhibit 1 was offered and received into evidence.
288The Council presented the testimony of Ivy Shivers, and
297Respondent's Exhibit 1 was offered and received into evidence.
306The parties also offered Joint Exhibit 1, which was received
316into evidence. Finally, at the Petitioner's request, official

461FINDINGS OF FACT
464Based on the oral and documentary evidence presented at the
474final hearing and on the entire record of this proceeding, the
485following findings of fact are made:
4911. The Council, which serves under the supervision of the
501Board of Medicine, is the entity responsible for certifying
510persons for licensure by endorsement as a
517dietitian/nutritionist. § 468.509, Fla. Stat. (2008) 1 ; Fla.
525Admin. Code R. 64B8-40.003(1)(a).
5292. On or about January 16, 2008, the Council received
539Ms. Alonso's application for licensure by endorsement as a
548dietitian/nutritionist pursuant to Section 468.513, Florida
554Statutes.
5553. At the time of her application, Ms. Alonso was a
566certified nutritionist in the State of Washington, having been
575issued license number NU00001939 on April 11, 2007. Ms. Alonso
585is not licensed in the State of Washington as a certified
596dietitian, nor has she taken a state or national examination for
607licensure as a dietitian or as a nutritionist.
6154. In 1994, Ms. Alonso earned a Bachelor's of Science
625degree from Cornell University in biochemistry, and, in 2000,
634she earned a Master's of Science degree from the University of
645Texas, School of Public Health, in nutrition and immunology.
6545. Prior to moving to Florida in early 2008, Ms. Alonso
665worked as a nutritionist in Washington State. Prior to
674receiving her certification as a nutritionist in Washington
682State, she worked as a nutritionist in several clinics under the
693supervision of medical and naturopathic doctors for
700approximately four years. During this time, she performed
708nutritional assessments and developed nutritional programs for
715the clinics' patients and provided nutritional support for the
724doctors working in the clinics.
7296. Ms. Alonso was licensed pursuant to Section 18.138.030,
738Revised Code of Washington, which sets forth the requirements
747for certification as a dietitian and as a nutritionist in the
758State of Washington. Section 18.138.030, Revised Code of
766Washington, provides in pertinent part:
771(1) An applicant applying for certification
777as a certified dietitian or certified
783nutritionist shall file a written
788application on a form or forms provided by
796the secretary setting forth under affidavit
802such information as the secretary may
808require, and proof that the candidate has
815met qualifications set forth below in
821subsection (2) or (3) of this section.
828(2) Any person seeking certification as a
"835certified dietitian" shall meet the
840following qualifications:
842(a) Be eighteen years of age or older;
850(b) Has satisfactorily completed a major
856course of study in human nutrition, foods
863and nutrition, dietetics, or food systems
869management, and has received a baccalaureate
875or higher degree from a college or
882university accredited by the Western
887association of schools and colleges or a
894similar accreditation agency or colleges and
900universities approved by the secretary in
906rule;
907(c) Demonstrates evidence of having
912successfully completed a planned continuous
917preprofessional experience in dietetic
921practice of not less than nine hundred hours
929under the supervision of a certified
935dietitian or a registered dietitian or
941demonstrates completion of a coordinated
946undergraduate program in dietetics, both of
952which meet the training criteria established
958by the secretary;
961(d) Has satisfactorily completed an
966examination for dietitians administered by a
972public or private agency or institution
978recognized by the secretary as qualified to
985administer the examination; and
989(e) Has satisfactorily completed courses of
995continuing education as currently
999established by the secretary.
1003* * *
1006(4) Any person seeking certification as a
"1013certified nutritionist" shall meet the
1018following qualifications:
1020(a) Possess the qualifications required to
1026be a certified dietitian; or
1031(b) Has received a master's degree or
1038doctorate degree in one of the following
1045subject areas: Human nutrition, nutrition
1050education, foods and nutrition, or public
1056health nutrition from a college or
1062university accredited by the Western
1067association of schools and colleges or a
1074similar accrediting agency or colleges and
1080universities approved by the secretary in
1086rule.
10877. The State of Washington has two certifications, one for
1097dietitians and one for nutritionists. Pursuant to
1104Section 18.139.030(4), Revised Code of Washington, a person
1112qualifies to be licensed as a "certified nutritionist" if the
1122person either meets the requirements for certification as a
1131dietitian or has received a master's degree in the enumerated
1141areas of study.
11448. Section 468.509, Florida Statutes, provides:
1150(1) Any person desiring to be licensed as a
1159dietitian/nutritionist shall apply to the
1164agency [for Health Care Administration] to
1170take the licensure examination.
1174(2) The agency shall examine any applicant
1181who the board certifies has completed the
1188application form and remitted the
1193application and examination fees specified
1198in s. 468.508 and who:
1203(a)1. Possesses a baccalaureate or
1208postbaccalaureate degree with a major course
1214of study in human nutrition, food and
1221nutrition, dietetics, or food management, or
1227an equivalent major course of study, from a
1235school or program accredited, at the time of
1243the applicant's graduation, by the
1248appropriate accrediting agency recognized by
1253the Commission on Recognition of
1258Postsecondary Accreditation and the United
1263States Department of Education; and
12682. Has completed a preprofessional
1273experience component of not less than 900
1280hours or has education or experience
1286determined to be equivalent by the board; or
1294(b)1. Has an academic degree, from a
1301foreign country, . . .
1306* * *
1309(3) The board shall waive the examination
1316requirement for an applicant who presents
1322evidence satisfactory to the board that the
1329applicant is a registered dietitian.
1334(4) The agency shall license as a
1341dietitian/nutritionist any applicant who has
1346remitted the initial licensure fee and has
1353passed the examination in accordance with
1359this section.
13619. In contrast to Washington State, Florida has only one
1371certification for dietitians and nutritionists. Pursuant to
1378Section 468.509, Florida Statutes, a person qualifies to be
1387licensed as a "dietitian/nutritionist" if the person either
1395meets the requirements for certification set forth in
1403Section 468.509(2), Florida Statutes, or is a registered
1411dietitian.
141210. The requirements for licensure as a dietitian in
1421Washington State are substantially equivalent to the
1428requirements for certification as a dietitian/nutritionist in
1435Florida. The requirements for certification as a nutritionist
1443in Washington State are not, however, substantially equivalent
1451to the requirements for licensure as a dietitian/nutritionist in
1460Florida, because a person in Washington State can be certified
1470as a nutritionist without meeting the requirements for
1478certification as a dietitian if the person has an advanced
1488academic degree.
1490CONCLUSIONS OF LAW
149311. The Division of Administrative Hearings has
1500jurisdiction over the subject matter of this proceeding and of
1510the parties thereto pursuant to Sections 120.569 and 120.57(1),
1519Florida Statutes.
152112. Because this case involves a determination of
1529Ms. Alonso's eligibility for certification for licensure by
1537endorsement as a dietitian/nutritionist, she has the burden of
1546proving by a preponderance of the evidence that she meets all of
1558the requirements for necessary for such certification. See
1566Department of Banking & Fin. v. Osborne Stern , 670 So. 2d 932,
1578934 (Fla. 1996)("[W]hile the burden of producing evidence may
1588shift between the parties in an application dispute proceeding,
1597the burden of persuasion remains upon the applicant to prove her
1608entitlement to the license."); § 120.57(1)(j), Fla. Stat.
1617("Findings of fact shall be based upon a preponderance of the
1629evidence, except in penal or licensure disciplinary proceedings
1637or except as otherwise provided by statute . . . .").
164913. Section 468.513, Florida Statutes, sets out the
1657requirements for licensure by endorsement as a
1664dietitian/nutritionist and provides in pertinent part:
1670(1) The agency shall issue a license to
1678practice dietetics and nutrition by
1683endorsement to any applicant who the board
1690certifies as qualified, upon receipt of a
1697completed application and the fee specified
1703in s. 468.508.
1706(2) The board shall certify as qualified
1713for licensure by endorsement under this
1719section any applicant who:
1723(a) Presents evidence satisfactory to the
1729board that he or she is a registered
1737dietitian; or
1739(b) Holds a valid license to practice
1746dietetics or nutrition issued by another
1752state, district, or territory of the United
1759States, if the criteria for issuance of such
1767license are determined by the board to be
1775substantially equivalent to or more
1780stringent than those of this state.
178614. Based on the findings of fact herein, Ms. Alonso has
1797failed to prove by a preponderance of the evidence that she is
1809qualified for licensure by endorsement in Florida as a
1818dietitian/nutritionist. She is not a certified dietitian in the
1827State of Washington, and the requirements for certification as a
1837nutritionist in the State of Washington are not substantially
1846equivalent to the requirements for licensure as a
1854dietitian/nutritionist in Florida. 2
1858RECOMMENDATION
1859Based on the foregoing Findings of Fact and Conclusions of
1869Law, it is RECOMMENDED that the Board of Nursing enter a final
1881order finding that Larisa Alonso failed to satisfy the
1890requirements of Section 468.513(2), Florida Statutes, and
1897denying her application for licensure by endorsement as a
1906dietitian/nutritionist.
