115STATEMENT OF THE ISSUE
119The issue for determination is whether Petitioners
126position was properly reclassified by Respondent under the
134Service First Initiative from Career Service to Select Exempt
143Service.
144PRELIMINARY STATEMENT
146Sherry A. Blow-Beasley, a/k/a Sherry A. Blow, a/k/a Sherry
155A. Strange-Blow a/k/a Sherry A. Beasley, hereinafter
162Ms. Blow-Beasley, was notified by the Department of Children and
172Family Services, hereinafter DCFS, that her employment position
180was reclassified under Service First from Career Service to
189Select Exempt Service (SES). Ms. Blow-Beasley challenged the
197classification and requested a hearing. 1 On May 21, 2008, this
208matter was referred to the Division of Administrative Hearings.
217Prior to the final hearing the parties filed a Revised
227Joint Stipulation of Facts. At hearing, DCFS Motion to
236Dismiss, which was filed prior to hearing, was heard. After
246hearing the parties arguments, the motion was denied.
254Ms. Blow-Beasley testified in her own behalf and entered no
264exhibits into evidence. DCFS did not present the testimony of
274any witnesses and entered two exhibits (Respondents Exhibits
282numbered 1 and 2) into evidence.
288A transcript of the hearing was ordered. At the request of
299the parties, the time for filing post-hearing submissions was
308set for ten days following the filing of the transcript. The
319Transcript, consisting of one volume, was filed on October 20,
3292008. The parties timely filed their post-hearing submissions,
337which were considered in the preparation of this Recommended
346Order. 2
348FINDINGS OF FACT 3
3521. Ms. Blow-Beasley was employed with DCFS, formerly known
361as Department of Health and Rehabilitative Services, hereinafter
369HRS, in Broward County, Florida from February 1, 1988 to June 7,
3812002.
3822. From August 3, 2000 to July 2001, as part of her
394employment with DCFS, Ms. Blow-Beasley worked for Economic
402Services.
4033. On September 29, 2000, Ms. Blow-Beasley was hired as a
414Public Assistance Specialist Supervisor by DCFS, which was a
423Career Service position.
4264. From September 29, 2000 to July 2001, a Public
436Assistance Specialist Supervisor was a supervisory position with
444HRS and/or DCFS.
4475. From September 29, 2000 to July 1, 2001, in her role as
460a Public Assistance Specialist Supervisor, Ms. Blow-Beasley
467supervised two or more employees.
4726. As part of her duties as a Public Assistance Specialist
483Supervisor, Ms. Blow-Beasley reviewed and approved employee time
491(work time, sick leave, annual leave, vacation, etc.) of
500employees under her supervision.
5047. Also, as part of her duties as a Public Assistance
515Specialist Supervisor, Ms. Blow-Beasley reviewed the work and
523performance of employees under her supervision.
5298. Additionally, as part of her duties as a Public
539Assistance Specialist Supervisor, Ms. Blow-Beasley was
545responsible for ensuring that employees under her supervision
553met certain DCFS performance standards and measures.
5609. Further, as part of her duties as a Public Assistance
571Specialist Supervisor, Ms. Blow-Beasley was responsible for
578ensuring that employees under her supervision complied with
586certain state and federal laws.
59110. Furthermore, as part of her duties as a Public
601Assistance Specialist Supervisor, Ms. Blow-Beasley conducted,
607approved and/or executed performance evaluations for those
614persons whom she supervised.
61811. By letter dated June 15, 2001, Ms. Blow-Beasley was
628notified by DCFS that her position in Career Service was being
639transferred to SES, effective July 1, 2001. Her position in
649Career Service was reclassified as a SES position.
65712. Ms. Blow-Beasley informed her supervisor that she did
666not want to remain in SES and would accept a demotion to be in
680Career Service. Her request was not granted.
68713. From July 2001 to June 7, 2002, as part of her
699employment with DCFS, Ms. Blow-Beasley worked for the Economic
708Self-Sufficiency, hereinafter ESS, Program.
71214. From July 2001 to June 7, 2002, Ms. Blow-Beasleys
722position title was, and she was employed as, ESS Supervisor
732Specialist.
73315. From July 2001 to June 7, 2002, an ESS Supervisor
744Specialist was a supervisory position with DCFS.
75116. As part of her duties as an ESS Supervisor Specialist,
762Ms. Blow-Beasley reviewed and approved employee time (work time,
771sick leave, annual leave, vacation, etc.) of employees under her
781supervision.
78217. Also, as part of her duties as an ESS Supervisor
793Specialist, Ms. Blow-Beasley reviewed the work and performance
801of employees under her supervision.
80618. Additionally, as part of her duties as an ESS
816Supervisor Specialist, Ms. Blow-Beasley was responsible for
823ensuring that employees under her supervision met certain DCFS
832performance standards and measures.
83619. Further, as part of her duties as an ESS Supervisor
847Specialist, Ms. Blow-Beasley was responsible for ensuring that
855employees under her supervision complied with certain state and
864federal laws.
86620. Furthermore, as part of her duties as an ESS
876Supervisor Specialist, Ms. Blow-Beasley conducted, approved
882and/or executed performance evaluations for those persons whom
890she supervised.
89221. Ms. Blow-Beasley does not dispute that, from
900September 29, 2000 to June 7, 2002, she was a supervisor and had
913been in both Career Service and SES as a supervisor.
92322. Ms. Blow-Beasley does not dispute that, when her
932position was reclassified from Career Service to SES, her duties
942and responsibilities did not change, but remained the same.
95123. No direct evidence was presented to demonstrate that
960Ms. Blow-Beasley had the authority to hire, transfer, suspend,
969lay off, recall, promote, discharge, assign, reward, or
977discipline subordinate employees. However, an inference is
984drawn and a finding of fact is made that, based on her duties,
997she had the authority to effectively recommend the action to
1007hire, transfer, suspend, lay off, recall, promote, discharge,
1015assign, reward, or discipline subordinate employees.
102124. Approximately one year after the reclassification, on
1029June 7, 2002, Ms. Blow-Beasley was dismissed from employment
1038with DCFS. On the said date, she signed a letter acknowledging
1049receipt of the notice of dismissal from DCFS.
1057CONCLUSIONS OF LAW
106025. The Division of Administrative Hearings has
1067jurisdiction over the subject matter of this proceeding and the
1077parties thereto pursuant to Sections 120.569 and 120.57(1),
1085Florida Statutes (2008).
108826. These proceedings are de novo . § 120.57(1)(k), Fla.
1098Stat. (2008).
110027. The general rule is that "the burden of proof, apart
1111from statute, is on the party asserting the affirmative of an
1122issue before an administrative tribunal." Florida Department of
1130Transportation v. J. W. C. Company, Inc. , 396 So. 2d 778, 788
1142(Fla. 1st DCA 1981). DCFS has the burden of proof to show by
1155the preponderance of the evidence that its reclassification of
1164Ms. Blow-Beasleys position from Career Service to SES was
1173proper. Department of Banking and Finance, Division of
1181Securities and Investor Protection v. Osborne Stern and Company ,
1190670 So. 2d 932 (Fla. 1996); J. W. C. Company, Inc. , supra .;
1203§ 120.57(1)(j), Fla. Stat. (2008).
120828. In 2001, the Florida Legislature directed the
1216Department of Management Services (DMS) to restructure the
1224States personnel system and mandated DMS to create a position
1234classification system for Career Service and SES positions;
1242state agencies were responsible for the application of the
1251system and had the responsibility to reclassify established
1259agency positions within the classes established by DMS. See
1268Fuller v. Department of Education , 927 So. 2d 28, 29, 30 (Fla.
12801st DCA 2006).
128329. State employees were deemed to be in Career Service
1293positions unless positions were exempted. § 110.205(1), Fla.
1301Stat. (2001).
130330. Section 110.205, Florida Statutes (2001), provides in
1311pertinent part:
1313(2) EXEMPT POSITIONS . --The exempt
1319positions that are not covered by this part
1327include the following:
1330* * *
1333(x) Managerial employees, as defined in s.
1340447.203(4), confidential employees, as
1344defined in s. 447.203(5), and supervisory
1350employees who spend the majority of their
1357time communicating with, motivating,
1361training, and evaluating employees, and
1366planning and directing employees' work, and
1372who have the authority to hire, transfer,
1379suspend, lay off, recall, promote,
1384discharge, assign, reward, or discipline
1389subordinate employees or effectively
1393recommend such action, including all
1398employees serving as supervisors,
1402administrators, and directors. . . .

141131. The evidence demonstrates that Ms. Blow-Beasleys
1418Career Service position was a supervisory position and that,
1427when the position was reclassified to SES, it remained a
1437supervisory position. The evidence further demonstrates that
1444her duties associated with her Career Service position did not
1454change when the position was reclassified to an SES position.
146432. Additionally, the evidence demonstrates that Ms. Blow-
1472Beasleys duties in her reclassified position did not differ
1481from, but remained the same as, the duties in her Career Service
1493position.
149433. Moreover, the evidence demonstrates that
1500Ms. Blow-Beasleys position met the criteria for an exempt
1509position. § 110.205(2)(x), Fla. Stat. (2001).
151534. Hence, DCFS met its burden in demonstrating that
1524Ms. Blow-Beasleys Career Service position was properly
1531reclassified as an SES position.
153635. This Administrative Law Judge is without authority in
1545this proceeding to address Ms. Blow-Beasleys position that she
1554did not wish to remain in the position that was reclassified and
1566requested a demotion to return to Career Service, but her
1576request was not granted.
1580RECOMMENDATION
1581Based on the foregoing Findings of Fact and Conclusions of
1591Law, it is
1594RECOMMENDED that the Department of Children and Family
1602Services enter a final order finding that Ms. Sherry A.
1612Blow-Beasleys Career Service position was properly reclassified
1619as a Select Exempt Service position.
