113STATEMENT OF THE ISSUE

117Whether Petitioner is entitled to a permit to operate a

127medical oxygen retail establishment.

131PRELIMINARY STATEMENT

133On April 10, 2008, Respondent, Department of Health

141application filed by Petitioner, All Florida Medical Supplies,

149Inc., for a permit to operate a medical oxygen retail

159establishment. On May 23, 2008, the Division of Administrative

168Hearings received a request to assign an administrative law

177judge to hear issues raised in the Petition for Formal

187Administrative Hearing dated April 29, 2008. The final hearing

196was held on June 24, 2008.

202At the hearing, Petitioner submitted its Exhibits 1-6, but

211presented no witnesses in its case-in-chief. Respondent

218presented the testimony of Bridget Coates and Denean Merritts,

227and submitted Respondent’s Exhibits 1 and 2.

234The Transcript of the final hearing was received on

243July 22, 2008. Proposed Recommended Orders were filed on

252July 28, 2008.

255FINDINGS OF FACT

2581. Petitioner, All Florida Medical Supplies, Inc. located

266in Delray Beach, Florida, is the applicant for a permit to

277operate a medical oxygen retail establishment. The application

285was filed due to a change in the ownership of Petitioner.

2962. Respondent, Department of Health (DOH), is the agency

305authorized to regulate medical oxygen retail establishments, as

313provided in Chapter 499, Florida Statutes (2008).

3203. On November 14, 2007, DOH received Petitioner’s

328Application for a Permit under Chapter 499, Florida Statutes, to

338operate as a medical oxygen retailer. The applicant’s address

347was given as: “601 N. Congress Ave. Bldg. 6 Suite Number 606,

359Delray Beach, FL 33445.”

3634. The handwritten mailing address given appeared to be

372“128 Van Gown Way, Royal Palm Beach, FL 33411-1580.” The name

383given for the emergency contact at the mailing address was

393David L. Ford.

3965. On December 11, 2007, and on December 31, 2007, DOH

407sent letters to the 128 Van Gown address requesting additional

417information to complete the application.

4226. On January 8, 2007, one of the owners of Petitioner,

433Ellen Gust, sent an address correction to DOH by facsimile,

443along with a corrected application providing a new address. The

453corrected address was the 601 North Congress Avenue address.

4627. On January 11, 2008, another letter citing an

471application deficiency was sent to the original Van Gown mailing

481address not the corrected mailing address. In the meantime, the

491assigned DOH permitting staff person and Mrs. Gust, for

500Petitioner, had some telephone and email contacts that

508eliminated the remaining deficiency.

5128. On January 18, 2008, DOH notified Petitioners that is

522application was complete.

5259. A DOH inspector received the completed application from

534the permitting office and, on February 7, 2008, conducted an

544inspection of the business at its location at 601 North Congress

555Avenue in Delray Beach.

55910. The inspector saw approximately 60 cylinders of oxygen

568at the inspection site and determined that they were full, based

579on the color of the tape used to seal them. She testified that

592Mrs. Gust told her that the cylinders had been filled on site.

60411. The inspector found that the full oxygen cylinders

613were improperly labeled. That is, the labels on the cylinders

623lacked the name of the company and location where filled, as

634required by the Food and Drug Administration’s compressed

642medical gases guidelines. In addition, the expiration date on

651the cylinders was December 2007, and there was no way to

662determine the oxygen content because Petitioner failed to

670produce any stability testing records. Mrs. Gust told the

679investigator that the date on the cylinders was the date they

690were filled.

69212. The inspector observed cylinders inside a delivery van

701that also had an expiration date of December 2007. The lot

712numbers on the cylinders inside the business and in the van were

724the same, but the validity of the lot numbers could not be

736verified by reference to any corresponding business records or

745fill logs. Mrs. Gust’s husband told the inspector that the lot

756numbers were the numerical date of the year and month the tanks

768were filled, which is acceptable except that the methodology was

778not listed in any of Petitioner’s policies and procedures.

78713. Based on the inability to verify that the oxygen was

798safe and effective for use by patients, or to determine the

809useful life in the absence of stability test records or fill

820logs, the inspector ordered the removal of the seals on the

831cylinders and the release of the oxygen.

83814. The inspector also found unclear signage to designate

847a quarantine area in the warehouse.

85315. The inspector recommended, and DOH agreed that

861Petitioner failed the site inspection and that its permit

870application should be denied.

874CONCLUSIONS OF LAW

87716. The Division of Administrative Hearings has

884jurisdiction over the parties to and subject matter of this

894proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).

90217. In license and permit application cases, the burden is

912upon the applicant to demonstrate its entitlement by a

921preponderance of the evidence. Department of Transportation v.

929J.W.C. Company, Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981); Balino

941v. Department of Health and Rehabilitative Services , 348 So. 2d

951349 (Fla. 1st DCA 1977); State ex rel. Glaser v. Pepper , 155 So.

9642d 383 (Fla. 1st DCA 1963).

97018. Petitioner, in this case, argues that it is entitled

980to the permit for one reason, the requirement in Florida

990Administrative Code Rule 64F-12.015(3)(d) that follows:

996(d) The department will request from the

1003applicant written documentation to evidence

1008compliance with the requirements of Chapter

1014499, F.S., when an on-site inspection cannot

1021be completed within 30 days of receipt of a

1030completed application for a permit requiring

1036an on-site inspection or a written request

1043for a change of address.

104819. Petitioner claims that its application, having been

1056filed on November 14, 2007, should be deemed to have been

1067complete 30 days later, because it did not timely receive a

1078deficiency letter and have an opportunity to correct any

1087omissions, or have the required on-site inspection within 30

1096days.

109720. Petitioner's argument ignores three compelling facts.

1104First, that it was Petitioner that provided an incorrect mailing

1114address to DOH, and cannot now benefit from its mistake.

1124Second, that the rule requires "receipt of a completed

1133application." The application was not complete until

1140January 18, 2008. Finally, despite DOH's error in continuing to

1150use the original rather than the corrected mailing address when

1160it sent the deficiency letter of January 11, 2008, Petitioner

1170was being given the same information by email and telephone

1180calls to one of its owners, and the inspection was conducted on

1192February 7, 2008, within 30 days of the receipt of the completed

1204application.

120521. Petitioner has failed to demonstrate entitlement to a

1214permit to operate a medical oxygen retail establishment.

1222RECOMMENDATION

1223Based on the foregoing Findings of Fact and Conclusions of

1233Law it is RECOMMENDED:

1237That the Department of Health enter a final order denying

1247the application of All Florida Medical Supplies, Inc., for a

1257permit to operate a medical oxygen retail establishment.
