98STATEMENT OF THE ISSUES

102The issues in this case are whether Respondent violated

111Subsections 482.121(1)(a) and 482.121(1)(b), Florida Statutes

117(2007), 1 and, if so, what discipline should be imposed.

127PRELIMINARY STATEMENT

129On February 12, 2008, Petitioner, Department of Agriculture

137and Consumer Services, issued an Administrative Complaint

144against Respondent, Keith Lewis (Mr. Lewis), alleging that Mr.

153Florida Statutes, by allowing his certificate to be used by a

164licensee to secure or keep a license, when he was not in charge

177of the pest control activities in the category or categories

187covered by his certificate and was not a full-time employee.

197Mr. Lewis requested an administrative hearing.

203The case was forwarded to the Division of Administrative

212Hearings on May 27, 2008, for assignment to an Administrative

222Law Judge. The case was originally assigned to Administrative

231Law Judge Charles C. Adams, but was transferred to

240Administrative Law Judge Susan B. Harrell to conduct the final

250hearing.

251The final hearing was scheduled to commence at 10:00 a.m.

261Central Time, and Mr. Lewis was provided notice of the final

272hearing. At 10:00 a.m., Mr. Lewis had not appeared for the

283final hearing. The commencement of the hearing was delayed

292until 10:20 a.m. to allow Mr. Lewis an opportunity to appear,

303but neither Mr. Lewis nor a representative for Mr. Lewis

313appeared for the final hearing.

318At the final hearing, Petitioner called Michael Page and

327Michael Walters as its witnesses. Petitioner’s Exhibits 1, 2,

3363, 5, and 6 were admitted in evidence.

344No transcript of the final hearing was filed. Petitioner

353filed its Proposed Recommended Order on August 8, 2008.

362Mr. Lewis did not file any post-hearing submittal.

370FINDINGS OF FACT

3731. PFSG, Inc., d/b/a US Lawns of Destin (US Lawns), 2

384submitted a Pest Control Business License Application to the

393Petitioner, listing Mr. Lewis as its certified operator in

402charge for lawn and ornamental pest control, effective August 9,

4122007. Mr. Lewis’ certificate number is Jf 13685.

4202. US Lawns had been operating on an emergency certificate

430from June 6, 2007, until Mr. Lewis’ employment on August 8,

4412007. In its application for a business license, US Lawns

451requested that its emergency certificate be canceled as of

460August 8, 2007.

4633. In order for a pest control company to operate, the

474company has to have a certified pest control operator in charge

485of the pest control activities at the licensed business

494location. If a company does not have a certified operator to

505serve as the certified operator in charge, an emergency

514certificate can be issued and renewed monthly up to a year,

525allowing an employee who did not have a certified operator’s

535certificate to serve as the certified operator in charge.

5444. As the certified operator in charge for US Lawns,

554Mr. Lewis applied to Petitioner for a pest control employee

564identification card, effective August 9, 2007. He listed the

573commencement of his employment with US Lawns as August 9, 2007.

584He also stated that his last employment with a pest control

595company had ended on June 11, 2007. A pest control employee

606identification card was issued to Mr. Lewis by Petitioner.

6155. Mr. Lewis’ wife died on July 4, 2007.

6246. Petitioner received a complaint that Mr. Lewis was not

634working full time for US Lawns and was allowing US Lawns to use

647his certificate to maintain its business license. Based on the

657complaint, Michael Walters, who is employed by Petitioner as an

667environmental specialist II, began an investigation.

6737. Mr. Walters went to US Lawns' office and made an

684inspection. On October 31, 2007, Mr. Walters went to see

694Mr. Lewis at Mr. Lewis’ home for the purpose of interviewing

705Mr. Lewis. Mr. Lewis gave Mr. Walters a signed affidavit, which

716stated:

717I work full time with U.S. Lawns of Santa

726Rosa Beach. I have been part time since the

735loss of my wife, but I do go to work at

746least once a week and check on things. I do

756all the training for card holders and such.

764As soon as I feel better I should be back

774fulltime. I have been there around 5 yrs.,

782minus one year with another company.

7888. In his request for an administrative hearing, Mr. Lewis

798stated: “I was on vacation for 4 weeks, due to the death of my

812wife,” and I was not working part time ever.

8229. The evidence is clear that Mr. Lewis was not working

833full time for US Lawns from the time of his wife’s death until

846at least the date of his affidavit, October 31, 2007.

856CONCLUSIONS OF LAW

85910. The Division of Administrative Hearings has

866jurisdiction over the parties to and the subject matter of this

877proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).

88511. Petitioner has the burden of establishing the

893allegations in the Administrative Complaint by clear and

901convincing evidence. Department of Banking and Finance v.

909Osborne Stern and Co. , 670 So. 2d 932 (Fla. 1996). Petitioner

920has alleged that Mr. Lewis violated Subsections 482.121(1)(a)

928and 482.121(1)(b), Florida Statutes, which provides:

934(1) A certified operator may not allow her

942or his certificate to be used by a licensee

951to secure or keep a license unless:

958(a) She or he is in charge of the pest

968control activities of the licensee in the

975category or categories covered by her or his

983certificate;

984(b) She or he is a full-time employee of

993the licensee . . .

99812. Subsection 482.111(6)(a), Florida Statutes, provides:

1004Each location of each licensed pest control

1011business must have a certified operator in

1018charge who is certified for the particular

1025category of pest control engaged in at that

1033location. A certified operator in charge

1039must be registered with the department

1045pursuant to rules adopted pursuant to this

1052section. A certified operator in charge may

1059be in charge of one or more categories if

1068she or he is certified for those categories.

107613. Section 482.152, Florida Statutes, sets forth the

1084duties of a certified operator in charge and states:

1093A certified operator in charge of the pest

1101control activities of a licensee shall have

1108his or her primary occupation with the

1115licensee and shall be a full time employee

1123of the licensee, and her or his principal

1131duty shall include the responsibility for

1137the personal supervision of and

1142participation in the pest control activities

1148at the business location of the licensee as

1156the same relate to:

1160(1) The selection of proper and correct

1167chemicals for the particular pest control

1173work performed.

1175(2) The safe and proper use of pesticides

1183used.

1184(3) The correct concentration and

1189formulation of pesticides used in all pest

1196control work performed.

1199(4) The training of personnel in the proper

1207and acceptable methods of pest control.

1213(5) The control measures and procedures

1219used.

1220(6) The notification of the department of

1227any accidental poisoning or death connected

1233with pest control work performed on a job

1241she or he is supervising, within 24 hours

1249after she or he has knowledge of the

1257poisoning or death.

126014. Mr. Lewis was the certified operator in charge for US

1271Lawns, for its lawn and ornamental pest control. US Lawns made

1282application to Petitioner for a pest control business license,

1291using Mr. Lewis as its certified operator in charge effective

1301August 9, 2007, and requesting that its emergency certificate be

1311canceled effective upon Mr. Lewis’ employment.

131715. Petitioner has established by clear and convincing

1325evidence that Mr. Lewis violated Subsection 482.121(1)(a),

1332Florida Statutes. By his own admission, Mr. Lewis stated that

1342he went to US Lawns once a week to check on things. Going to

1356work once a week to “check on things” does not equate to being

1369in charge of the pest control activities for the lawn and

1380ornamental pest control activities of US Lawns.

138716. Petitioner has established by clear and convincing

1395evidence that Mr. Lewis violated Subsection 482.121(1)(b),

1402Florida Statutes. He was not a full-time employee of US Lawns.

1413By his own admission on October 31, 2007, he had been working

1425part time since the death of his wife. His wife died in July

1438and his employment with US Lawns commenced in August. For at

1449least three months, Mr. Lewis had not been working full time.

146017. Subsection 482.121(3), Florida Statutes, provides that

1467a certified operator’s certificate may be revoked when it is

1477used in violation of Section 482. 121, Florida Statutes.

1486RECOMMENDATION

1487Based on the foregoing Findings of Fact and Conclusions of

1497Law, it is RECOMMENDED that a final order be entered finding

1508that Mr. Lewis violated Subsection 482.121(1)(a) and

1515482.121(1)(b), Florida Statutes, and revoking his certified

1522operator’s certificate.
