95This cause came on to be heard pursuant to Sections 766.304
106and 766.305(7), Florida Statutes, upon the Stipulation and Joint
115Petition of the parties, filed February 24, 2009, for the entry
126of an order approving the resolution of a formal claim for
137compensation benefits heretofore filed in this cause in
145accordance with the provisions of Chapter 766, Florida Statutes,
154and a resolution of the exclusive remedy otherwise available as outlined in Chapter 766, Florida Statutes.
170By the terms of their stipulation, the parties have agreed
180that Ralph Santiago and Victoria Santiago are the parents and
190natural guardians of Destiny Desire Santiago Illescas (Destiny),
198a deceased minor; that Destiny was born a live infant on
209November 15, 2007, at Baptist Medical Center of the Beaches, a
"220hospital" as defined by Section 766.302(6), Florida Statutes,
228located in Jacksonville, Florida; that Destiny's birth weight
236exceeded 2,500 grams; and that Destiny died November 15, 2007.
247The parties have further agreed that Meridith Johnson Farrow,
256M.D., delivered obstetrical services at Destiny's birth, and at
265all times material hereto, was a "participating physician" in
274the Florida Birth-Related Neurological Injury Compensation Plan,
281as defined by Section 766.302(7), Florida Statutes. Finally, by
290their stipulation, the parties have agreed that Destiny suffered
299a "birth-related neurological injury," as that term is defined
308by Section 766.302(2), Florida Statutes.
313After due consideration of the interests of all parties,
322and being otherwise fully advised in the premises, it is
332ORDERED that:
3341. The Stipulation and Joint Petition of the parties,
343filed February 24, 2009, is hereby approved, and the parties are
354directed to comply with the provisions thereof.
3612. Petitioners, Ralph Santiago and Victoria Santiago, as
369the parents and natural guardians of Destiny Desire Santiago
378Illescas, a deceased minor, are awarded One hundred thousand
387dollars ($100,000.00), pursuant to Section 766.31(1)(b)1.,
394Florida Statutes, and a death benefit of Ten thousand dollars
404($10,000.00), pursuant to Section 766.31(1)(b)2., Florida
411Statutes, all to be paid in lump sum.
4193. Petitioners are further awarded attorney's fees and
427other expenses of Ten Thousand eight hundred eleven dollars and
437forty cents ($10,811.40), pursuant to Section 766.31(1)(c),
445Florida Statutes. No award is made for past expenses, as none
456are owning, and no provision is made for the payment of future
468Stat.
4694. Upon payment of the award of One hundred thousand
479dollars ($100,000.00), a death benefit of Ten thousand dollars
489($10,000.00), and attorney's fees and other expenses of Ten
499thousand eight hundred eleven dollars and forty cents
507($10,811.40), the claims of Petitioners (Claimants) shall be
516deemed fully satisfied and extinguished.
5215. The Division of Administrative Hearings retains
528jurisdiction over this matter to resolve any disputes should
537they arise, regarding the parties' compliance with the terms of
547this Final Order.
5506. The hearing scheduled for March 4, 2009, is cancelled.
