102PRELIMINARY STATEMENT

104Because of the procedural nature of the findings in this case, the statements normally contained in the Preliminary

131FINDINGS OF FACT

1341. On July 22, 2003, Petitioner received notice from the

144Department of Children and Family Services (DFCS or the

153Department) of a clear point of entry to challenge the

163reclassification of her position from career service to select

172exempt service. Petitioner filed a request for hearing on

181August 19, 2003, which apparently lay unaddressed for some time.

1912. On March 6, 2008, the Department issued an Order on

202Status, advising Petitioner that her request for hearing filed

211August 19, 2003, did not comply with Section 120.569(2)(c),

220Florida Statutes, or Florida Administrative Code Rule 28-

228106.201(2). The Order directed Petitioner to file an amended

237request for hearing within 30 days or the case would be

248dismissed.

2493. On May 6, 2008, the Department entered a Final Order

260Closing File, indicating no response had been received to its

270Order on Status. On May 29, 2008, Petitioner wrote to the

281Department indicating that the Final Order Closing File was the

291first correspondence she had received from the Department, and

300that the documents had been sent to a wrong address,

310notwithstanding that the Department had been supplied the correct

319address.

3204. On July 18, 2008, the matter was referred to the

331Division of Administrative Hearings and an Initial Order was

340issued. No timely response was received to the Initial Order

350from either party, and the matter was duly noticed for hearing

361for September 30, 2008.

3655. On September 30, 2008, the hearing commenced as

374scheduled at 9:30 a.m. Respondent was present and ready to

384proceed. Petitioner was not present. The Division had, the day

394before, received a telephone call from Petitioner indicating that

403she might not appear, and she was advised of the need to either

416withdraw her request for hearing or request a continuance.

4256. The undersigned recessed the hearing to give Petitioner

434every opportunity to arrive. In addition, the undersigned

442questioned her assistant and checked the official docket of the

452Division of Administrative Hearings to determine if any document

461had been filed on the docket of the Division or any telephone

473call was received indicating Petitioner was delayed. No such

482communication had been received.

4867. Counsel for Respondent represented that he had not heard

496from the Petitioner in the days leading up to the hearing. In

508light of Petitioner's failure to appear, the hearing was

517adjourned at 10:03 a.m.

521CONCLUSIONS OF LAW

5248. The Division of Administrative Hearings has jurisdiction

532over the subject matter and the parties to this action in

543accordance with Sections 120.569 and 120.57(1), Florida Statutes

551(2008).

5529. Petitioner has the burden of demonstrating that her

561position with the Department was reclassified in error. Antel v.

571Department of Professional Regulation , 522 So. 2d 1056 (Fla. 5th

581DCA 1988); Florida Department of Transportation v. J.W.C. Co. ,

590396 So. 2d 778 (Fla. 1st DCA 1981); Balino v. Department of

602Health & Rehabilitative Services , 348 So. 2d 349 (Fla. 1st DCA

6131977).

61410. In light of Petitioner's failure to appear, she has

624failed to meet her burden in this proceeding.

632RECOMMENDATION

633Upon consideration of the facts found and conclusions of law

643reached, it is

646RECOMMENDED:

647That a final order be entered dismissing Petitioner's

655request for hearing.
