111STATEMENT OF THE ISSUE
115The issue in the case is whether an application for a motor
127vehicle dealer license filed by LS Motorsports, LLC, and
136Michael J. Konczal, Inc., should be approved.
143PRELIMINARY STATEMENT
145By notice published in the Florida Administrative Weekly
153(Volume 34, Number 29; July 18, 2008) the Department of Highway
164Safety and Motor Vehicles (Department) gave notice that
172LS MotorSports, LLC (LS MotorSports), was seeking to establish a
182new point motor vehicle dealership in St. Petersburg, Florida,
191with Michael J. Konczal, Inc., for the line-make "Chongqing
200Lifan Industry Group (CHOL)." A challenge to the establishment
209of the dealership was filed with the Department by an existing
220motorcycle dealership, Seminole Scooters, Inc. (Respondent).
226By letter dated July 31, 2008, the Department forwarded the
236challenge to the Division of Administrative Hearings. On
244August 1, 2008, an Initial Order was issued, directing the
254parties to identify the anticipated length of the hearing and
264dates upon which the parties were available. The Respondent
273filed a response to the Initial Order, requesting that the
283hearing be scheduled in St. Petersburg, Florida, and the hearing
293was scheduled accordingly.
296At the hearing, Petitioner, Michael Konczal, testified on
304his own behalf. The Respondent's representative testified on
312behalf of the Respondent. No exhibits were offered into
321evidence.
322No transcript of the hearing was filed. The Respondent
331filed a Proposed Recommended Order.
336FINDINGS OF FACT
3391. LS MotorSports is seeking to establish a new point
349motor vehicle dealership in St. Petersburg, Florida, for line-
358make Chongqing Lifan Industry Group (CHOL).
3642. The Respondent is an existing franchise motor dealer
373for line-make Chongqing Lifan Industry Group (CHOL), located
381within 12.5 miles of the proposed new point motor vehicle
391dealership location. The majority of the Respondent's vehicle
399sales come from within a 12.5-mile radius of the proposed
409dealership.
4103. The Respondent timely filed a protest of
418LS MotorSports proposed dealership.
4224. There is no evidence that the Respondent is not
432providing adequate representation within the territory of the
440motor vehicles at issue in this proceeding.
447CONCLUSIONS OF LAW
4505. The Division of Administrative Hearings has
457jurisdiction over the parties to and subject matter of this
467proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).
4756. Subsection 320.642(2)(a), Florida Statutes (2008),
481provides as follows:
484An application for a motor vehicle dealer
491license in any community or territory shall
498be denied when:
5011. A timely protest is filed by a presently
510existing franchised motor vehicle dealer
515with standing to protest as defined in
522subsection (3); and
5252. The licensee fails to show that the
533existing franchised dealer or dealers who
539register new motor vehicle retail sales or
546retail leases of the same line-make in the
554community or territory of the proposed
560dealership are not providing adequate
565representation of such line-make motor
570vehicles in such community or territory.
576The burden of proof in establishing
582inadequate representation shall be on the
588licensee. (Emphasis supplied)
5917. The licensees in this case are Petitioners,
599LS Motorsports, LLC, and Michael J. Konczal, Inc. See
608§§ 320.60(8) and 320.61, Fla. Stat. (2008).
6158. As the licensees, the Petitioners have the burden of
625establishing compliance with applicable statutory requirements
631by a preponderance of the evidence presented at the hearing.
641§ 320.642(2)(a)2., Fla. Stat. (2008). The Petitioners have
649failed to establish that the Respondent is not providing
658adequate representation of the line-make Chongqing Lifan
665Industry Group (CHOL).
668RECOMMENDATION
669Based on the foregoing Finding of Fact and Conclusions of
679Law, it is RECOMMENDED that the Department of Highway Safety and
690Motor Vehicles enter a final order denying the application for
700establishment of the motor vehicle dealer franchise at issue in
710this case.
