115PRELIMINARY STATEMENT

117The Florida Department of Highway Safety and Motor Vehicles forwarded the instant case to the Division of Administrative

135Hearings for formal proceedings on August 18, 2008. Thereafter,

144the case was scheduled for hearing and the parties were provided

155notice of the hearing location and time.

162At the hearing, the Respondent, Best Buy Vehicles, Inc.

171(Respondent), did not appear. The Petitioner, H. Long

179Investments, Corp. d/b/a Tropical Scooters of Vero (Petitioner),

187did appear and presented evidence in support of the proposed

197dealership.

198A transcript of the proceeding was not filed. The parties

208were granted ten days from the hearing date within which to file

220proposed recommended orders. By letter filed November 12, 2008,

229the Respondent requested that the case be held in St. Lucie

240County "due to the number of cases like this our company endures

252on an annual basis." The Petitioner responded to that letter on

263November 17, 2008. The Respondent's letter has been treated as a

274request to re-open the record and is addressed below.

283FINDINGS OF FACT

2861. On August 1, 2008, in the Florida Administrative Weekly,

296Volume 34, Number 31, a Notice of Publication for a New Point

308Franchise Motor Vehicle Dealer in a County of Less than 300,000

320Population was published. The notice provided that Vento North

329America, LLC, intended to allow the establishment of H. Long

339Investments Corp. d/b/a Tropical Scooters of Vero, as a

348dealership for the sale of motorcycles manufactured by Qianjaing

357Motorcycle Group Corp. (QINJ) at 4901 North U.S. Highway 1, Unit

368J, Vero Beach (Indian River County), Florida.

3752. On August 12, 2008, the Respondent timely filed a

385protest of the establishment of the Petitioner's dealership and

394represented that 25 percent of its retail sales were within a

40520-mile straight line distance of the proposed dealership during

414any 12-month period out of the 36-month period immediately

423preceding the filing of the protest.

4293. Based upon the Petitioner's evidence, its proposed

437dealership location is not less than 21.51 miles from the

447Respondent's dealership.

4494. The Respondent did not establish that any of its sales

460are within 20 miles of the proposed dealership.

4685. The Respondent did not establish that it currently

477markets any motorcycle to be sold by the proposed dealership.

487More specifically, the Respondent did not offer evidence that it

497has an agreement for the same line-make vehicle to be sold by the

510proposed dealer.

5126. Vento North America, the distributor of the motorcycle

521brand/model to be sold at the proposed dealership, did not attend

532the hearing.

5347. Notice of the formal hearing was provided to all parties

545of record at their addresses of record.

5528. The Respondent did not timely contest the location,

561date, or time for the hearing.

567CONCLUSIONS OF LAW

5709. The Division of Administrative Hearings has jurisdiction

578over the parties to and the subject matter of these proceedings.

589§§ 120.569, and 120.57(1), Fla. Stat (2008).

59610. Section 320.605, Florida Statutes (2008), provides:

603It is the intent of the Legislature to

611protect the public health, safety, and

617welfare of the citizens of the state by

625regulating the licensing of motor vehicle

631dealers and manufacturers, maintaining

635competition, providing consumer protection

639and fair trade and providing minorities with

646opportunities for full participation as motor

652vehicle dealers.

65411. Section 320.642 Florida Statutes (2008) provides, in

662part:

663(3) An existing franchised motor vehicle

669dealer or dealers shall have standing to

676protest a proposed additional or relocated

682motor vehicle dealer where the existing motor

689vehicle dealer or dealers have a franchise

696agreement for the same line-make vehicle to

703be sold or serviced by the proposed

710additional or relocated motor vehicle dealer

716and are physically located so as to meet or

725satisfy any of the following requirements or

732conditions:

733(a) If the proposed additional or relocated

740motor vehicle dealer is to be located in a

749county with a population of less than 300,000

758according to the most recent data of the

766United States Census Bureau or the data of

774the Bureau of Economic and Business Research

781of the University of Florida:

7861. The proposed additional or relocated

792motor vehicle dealer is to be located in the

801area designated or described as the area of

809responsibility, or such similarly designated

814area, including the entire area designated as

821a multiple-point area, in the franchise

827agreement or in any related document or

834commitment with the existing motor vehicle

840dealer or dealers of the same line-make as

848such agreement existed upon October 1, 1988;

8552. The existing motor vehicle dealer or

862dealers of the same line-make have a licensed

870franchise location within a radius of 20

877miles of the location of the proposed

884additional or relocated motor vehicle dealer;

890or

8913. Any existing motor vehicle dealer or

898dealers of the same line-make can establish

905that during any 12-month period of the 36-

913month period preceding the filing of the

920licensee's application for the proposed

925dealership, such dealer or its predecessor

931made 25 percent of its retail sales of new

940motor vehicles to persons whose registered

946household addresses were located within a

952radius of 20 miles of the location of the

961proposed additional or relocated motor

966vehicle dealer; provided such existing dealer

972is located in the same county or any county

981contiguous to the county where the additional

988or relocated dealer is proposed to be

995located.

99612. The Respondent's request for a hearing in St. Lucie

1006County, filed after the hearing had occurred, was untimely. If

1016treated as Motion to Re-Open the Record, it is denied. The

1027Respondent was provided timely notice of the hearing date and

1037location. The Respondent provided no reasonable excuse for the

1046failure to attend the hearing in this cause. Moreover, to

1056further delay the rendition of this order is prejudicial to the

1067Petitioner.

106813. The record in this cause is devoid of any evidence

1079supporting the allegations set forth in the Respondent's request

1088for hearing. The Respondent has failed to establish standing to

1098challenge the proposed dealership as a matter of law.

1107RECOMMENDATION

1108Based on the foregoing Findings of Fact and Conclusions of

1118Law, it is RECOMMENDED that the Florida Department of Highway

1128Safety and Motor Vehicles enter a Final Order dismissing the

1138protest filed by the Respondent and approving the dealership

1147proposed by this Petitioner.
