39Pursuant to proper notice this cause came on for formal

89STATEMENT OF THE ISSUE
93Whether the Petitioners should be permitted to establish a "line-make dealership" for Taizhou Zhongneng Motorcycle Company,

113PRELIMINARY STATEMENT
115The Respondent named above filed a protest of the
124application to establish a ZHNG line-make dealership by the
133above-named Petitioners.
135The matter was transmitted to the Division of
143Administrative Hearings and the undersigned for hearing. The
151notice of hearing was duly served by U.S. mail on the parties at
164their last-known addresses of record.
169Upon convening the hearing no party appeared.
176Consequently, no evidence could be taken. Upon waiting for
185nearly one hour after the duly-noticed staring time, with no
195appearances by the parties (and no communication from the
204parties immediately prior to, during or after the hearing) the
214hearing was adjourned.
217FINDINGS OF FACT
2201. This matter was convened for hearing for the above-
230named parties, concerning the issue referenced above. The
238hearing was held in Daytona Beach, Florida, on March 18, 2009,
249as more particularly announced in the Notice of Hearing, which
259was served on both parties at their last-known addresses of
269record.
2702. Upon convening the hearing at the noticed location,
279date and time, no party made an appearance. After waiting for
290nearly one hour, there was still no appearance by either party.
301There has been no communication from either party before, during
311or since the hearing regarding any request or reason, concerning
321the failure to appear. After waiting for the above period of
332time, without appearances by either party, the hearing was
341adjourned.
3423. No communication has been received to explain the lack
352of appearances. The Notices of Hearing served on the parties
362have not been returned as un-deliverable by the United States
372Postal Service.
3744. Since no evidence could be taken, no additional facts
384may be found.
387CONCLUSIONS OF LAW
3905. The Division of Administrative Hearings has
397jurisdiction of the subject matter of and the parties to this
408proceeding. §§ 120.569 and 120.57(1), Fla. Stat. (2008).
4166. In light of the above-found circumstances, no evidence
425was adduced by either party, and therefore no findings of fact
436or conclusions of law could be made regarding the above issue.
447That being the case, the matter should be dismissed for lack of
459prosecution.
460RECOMMENDATION
461RECOMMENDED that a final order be entered by the Florida
471Department of Highway Safety and Motor Vehicles, dismissing the
480Petition in its entirety. The file of the Division of
490Administrative Hearings is hereby closed.
