99STATEMENT OF THE ISSUE
103The issue in the case is whether an application for a motor
115vehicle dealer license filed by LS Motorsports, LLC, and
124Michael J. Konczal, Inc., should be approved.
131PRELIMINARY STATEMENT
133By notice published in the Florida Administrative Weekly
141(Volume 34, Number 29; July 18, 2008) the Department of Highway
152Safety and Motor Vehicles (Department) gave notice that
160LS MotorSports, LLC (LS MotorSports), was seeking to establish a
170new point motor vehicle dealership in St. Petersburg, Florida,
179with Michael J. Konczal, Inc., for the line-make "Chongqing
188Lifan Industry Group (CHOL)." A challenge to the establishment
197of the dealership was filed with the Department by an existing
208motorcycle dealership, Scooter Escapes (Respondent).
213By letter dated August 25, 2008, the Department forwarded
222the challenge to the Division of Administrative Hearings. On
231August 28, 2008, an Initial Order was issued, directing the
241parties to identify the anticipated length of the hearing and
251dates upon which the parties were available. The Order stated
261that failure to respond would be deemed a waiver of venue rights
273in which event the hearing would be scheduled in Tallahassee.
283No response to the Initial Order was filed. The hearing was
294scheduled in Tallahassee for March 5, 2009, a date in accordance
305with Section 320.699(2), Florida Statutes (2008).
311At the hearing, there was no appearance by, or on behalf
322of, either Petitioner. The Respondent's owner, Chris Densmore,
330testified on behalf of the Respondent. No exhibits were offered
340into evidence. No transcript of the hearing was filed. No
350proposed recommended orders were filed.
355FINDINGS OF FACT
3581. LS MotorSports is seeking to establish a new point
368motor vehicle dealership in St. Petersburg, Florida, for line-
377make CHOL.
3792. The Respondent is an existing franchise motor vehicle
388dealer for line-make CHOL, located within 12.5 miles of the
398proposed new point motor vehicle dealership location. The
406majority of the Respondent's vehicle sales come from within a
41612.5-mile radius of the proposed dealership.
4223. The Respondent timely filed a protest of
430LS MotorSports proposed dealership.
4344. There is no evidence that the Respondent is not
444providing adequate representation within the territory of the
452motor vehicles at issue in this proceeding.
459CONCLUSIONS OF LAW
4625. The Division of Administrative Hearings has
469jurisdiction over the parties to and subject matter of this
479proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).
4876. Subsection 320.642(2)(a), Florida Statutes (2008),
493provides as follows:
496An application for a motor vehicle dealer
503license in any community or territory shall
510be denied when:
5131. A timely protest is filed by a presently
522existing franchised motor vehicle dealer
527with standing to protest as defined in
534subsection (3); and
5372. The licensee fails to show that the
545existing franchised dealer or dealers who
551register new motor vehicle retail sales or
558retail leases of the same line-make in the
566community or territory of the proposed
572dealership are not providing adequate
577representation of such line-make motor
582vehicles in such community or territory.
588The burden of proof in establishing
594inadequate representation shall be on the
600licensee. (Emphasis supplied)
6037. The licensees in this case are Petitioners
611LS Motorsports, LLC, and Michael J. Konczal, Inc. See
620§§ 320.60(8) and 320.61, Fla. Stat. (2008).
6278. As the licensees, the Petitioners have the burden of
637establishing compliance with applicable statutory requirements
643by a preponderance of the evidence presented at the hearing.
653§ 320.642(2)(a)2., Fla. Stat. (2008). The Petitioners have
661failed to establish that the Respondent is not providing
670adequate representation of the line-make CHOL.
676RECOMMENDATION
677Based on the foregoing Finding of Fact and Conclusions of
687Law, it is RECOMMENDED that the Department of Highway Safety and
698Motor Vehicles enter a final order denying the application for
708establishment of the motor vehicle dealer franchise at issue in
718this case.
