99STATEMENT OF THE ISSUE

103The issue in the case is whether an application for a motor

115vehicle dealer license filed by LS Motorsports, LLC, and

124Michael J. Konczal, Inc., should be approved.

131PRELIMINARY STATEMENT

133By notice published in the Florida Administrative Weekly

141(Volume 34, Number 29; July 18, 2008) the Department of Highway

152Safety and Motor Vehicles (Department) gave notice that

160LS MotorSports, LLC (LS MotorSports), was seeking to establish a

170new point motor vehicle dealership in St. Petersburg, Florida,

179with Michael J. Konczal, Inc., for the line-make "Zongshen

188Industrial Group (ZONG)." A challenge to the establishment of

197the dealership was filed with the Department by an existing

207motorcycle dealership, Scooter Escapes (Respondent).

212By letter dated August 25, 2008, the Department forwarded

221the challenge to the Division of Administrative Hearings. On

230August 28, 2008, an Initial Order was issued, directing the

240parties to identify the anticipated length of the hearing and

250dates upon which the parties were available. The Order stated

260that failure to respond would be deemed a waiver of venue rights

272in which event the hearing would be scheduled in Tallahassee.

282No response to the Initial Order was filed. The hearing was

293scheduled in Tallahassee for March 5, 2009, a date in accordance

304with Section 320.699(2), Florida Statutes (2008).

310At the hearing, there was no appearance by, or on behalf

321of, either Petitioner. The Respondent's owner, Chris Densmore,

329testified on behalf of the Respondent. No exhibits were offered

339into evidence. No transcript of the hearing was filed. No

349proposed recommended orders were filed.

354FINDINGS OF FACT

3571. LS MotorSports is seeking to establish a new point

367motor vehicle dealership in St. Petersburg, Florida, for line-

376make ZONG.

3782. The Respondent is an existing franchise motor vehicle

387dealer for line-make ZONG, located within 12.5 miles of the

397proposed new point motor vehicle dealership location. The

405majority of the Respondent's vehicle sales come from within a

41512.5-mile radius of the proposed dealership.

4213. The Respondent timely filed a protest of

429LS MotorSports’ proposed dealership.

4334. There is no evidence that the Respondent is not

443providing adequate representation within the territory of the

451motor vehicles at issue in this proceeding.

458CONCLUSIONS OF LAW

4615. The Division of Administrative Hearings has

468jurisdiction over the parties to and subject matter of this

478proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).

4866. Subsection 320.642(2)(a), Florida Statutes (2008),

492provides as follows:

495An application for a motor vehicle dealer

502license in any community or territory shall

509be denied when:

5121. A timely protest is filed by a presently

521existing franchised motor vehicle dealer

526with standing to protest as defined in

533subsection (3); and

5362. The licensee fails to show that the

544existing franchised dealer or dealers who

550register new motor vehicle retail sales or

557retail leases of the same line-make in the

565community or territory of the proposed

571dealership are not providing adequate

576representation of such line-make motor

581vehicles in such community or territory.

587The burden of proof in establishing

593inadequate representation shall be on the

599licensee. (Emphasis supplied)

6027. The licensees in this case are Petitioners

610LS Motorsports, LLC, and Michael J. Konczal, Inc. See

619§§ 320.60(8) and 320.61, Fla. Stat. (2008).

6268. As the licensees, the Petitioners have the burden of

636establishing compliance with applicable statutory requirements

642by a preponderance of the evidence presented at the hearing.

652§ 320.642(2)(a)2., Fla. Stat. (2008). The Petitioners have

660failed to establish that the Respondent is not providing

669adequate representation of the line-make ZONG.

675RECOMMENDATION

676Based on the foregoing Finding of Fact and Conclusions of

686Law, it is RECOMMENDED that the Department of Highway Safety and

697Motor Vehicles enter a final order denying the application for

707establishment of the motor vehicle dealer franchise at issue in

717this case.
