93STATEMENT OF THE ISSUE
97The issue in this cause is whether Petitioners are entitled
107to a motor vehicle dealership that is proposed to be located in
119Panama City Beach, Florida.
123PRELIMINARY STATEMENT
125On August 22, 2008, Moto Dealer Import, LLC, and Big Boy
136Toys Florida, LLC (Petitioners) published a Notice of
144Publication for a New Point Franchise Motor Vehicle Dealer in a
155County of Less than 300,000 Population in the Florida
165Administrative Weekly. The proposed dealership was to be
173located in Panama City Beach, Florida. On September 7, 2008,
183Moto Import Distributors, LLC (Respondent) filed a Petition of
192Complaint in letter form, protesting the establishment of the
201franchise at its proposed location. The case was forwarded to
211the Division of Administrative Hearings to conduct the final
220hearing in this matter.
224This cause came on for hearing as noticed. After waiting
234more than 15 minutes, Petitioners failed to appear to prosecute
244their claim. Respondent, likewise, did not appear.
251FINDINGS OF FACT
2541. On November 4, 2008, a Notice of Hearing setting the
265date, time and location of final hearing was issued in this
276case. The Notice of Hearing was mailed to the last known, valid
288addresses of the Petitioners, which were also the addresses
297provided in Petitioners' Notice of Publication. Neither Notice
305of Hearing was returned.
3092. This cause came on for hearing as noticed. After
319waiting more than 15 minutes, Petitioners failed to appear to
329prosecute their claim. There has been no communication from the
339Petitioners, before, during, or since the hearing to indicate
348that they would not be attending the final hearing.
3573. Because of Petitioners' failure to appear, there was no
367evidence to demonstrate that Petitioners are entitled to a
376franchise motor vehicle dealership in Panama City Beach,
384Florida. Absent such evidence, the establishment of the
392proposed dealership should be denied.
397CONCLUSIONS OF LAW
4004. The Division of Administrative Hearings has
407jurisdiction over the parties to and the subject matter of this
418proceeding. §§ 120.569 and 120.57(1), Fla. Stat. (2008).
4265. The Department of Highway Safety and Motor Vehicles
435(Department) is the agency responsible for regulating the
443licensing and franchising of motor vehicles dealers. §§ 320.60-
452320.70, Fla. Stat. (2008).
4566. Section 320.642(1), Florida Statutes, requires a motor
464vehicle dealer who proposes to establish an additional motor
473vehicle dealership within an area already represented by the
482same line-make vehicle to give written notice to the Department
492of its intent to establish a new franchise. The statute also
503provides that any affected dealership may protest the
511establishment of a new franchise in its territory.
5197. Section 320.642(2), Florida Statutes, establishes the
526standards of review to determine if establishment of a new,
536competing motor vehicle franchise should be granted. Section
544320.642(2)(a), Florida Statutes, states in relevant part:
551An application for a motor vehicle dealer
558license in any community or territory shall
565be denied when:
568* * *
5712. The licensee fails to show that the
579existing franchise dealer . . . are not
587providing adequate representation of such
592line-make motor vehicles in such . . .
600territory. The burden of proof in
606establishing inadequate representation shall
610be on the licensee. (emphasis supplied)
6168. In this case, Petitioners, as the licensees, failed to
626appear at the hearing after proper Notice of the hearing was
637issued. Because Petitioners failed to appear, no evidence that
646Respondent was not adequately representing the territory in
654which the proposed dealership intends to locate was presented.
663Absent such evidence, Petitioners have not carried their burden
672of proof in this matter and the establishment of the proposed
683franchise should be denied.
687RECOMMENDATION
688Based on the foregoing Findings of Fact and Conclusions of
698Law, it is
701RECOMMENDED that a final order be entered by the Florida
711Department of Highway Safety and Motor Vehicles denying the
720establishment of Petitioners' proposed franchise.
