95STATEMENT OF THE ISSUE

99The issue in this case is whether an application for a

110motor vehicle dealership filed by Petitioners should be

118approved.

119PRELIMINARY STATEMENT

121By notice published in the Florida Administrative Weekly

129(Volume 34, Number 36; September 5, 2008), the Department of

139Highway Safety and Motor Vehicles (Department) gave notice that

148Lance Powersports, Inc., was seeking to establish a new point

158motor vehicle dealership in Longwood, Florida, with ECO Motor

167Sports and Scooters, LLC, “for the sale of motorcycles

176manufactured by Taizhou Zongneng Motorcycle Co. Ltd. (ZHNG)." A

185challenge to the establishment of the dealership was filed with

195the Department by an existing motorcycle dealership, Action

203Orlando Motorsports (Action Orlando).

207By letter dated October 9, 2008, the Department forwarded

216the challenge to the Division of Administrative Hearings. The

225case was originally assigned to Administrative Law Judge

233William F. Quattlebaum, but was transferred to Administrative

241Law Judge Susan B. Harrell to conduct the final hearing. On

252October 13, 2008, an Initial Order was issued, directing the

262parties to identify the anticipated length of the hearing and

272dates upon which the parties were available. Petitioners did

281not file a response to the Initial Order. The hearing was

292scheduled in Tallahassee, Florida, for April 21, 2009, a date in

303accordance with Subsection 320.699(2), Florida Statutes (2008).

310At the hearing, there was no appearance by, or on behalf

321of, either Petitioner. Respondent's owner, James Sursley,

328testified on behalf of Respondent. No exhibits were offered

337into evidence. No transcript of the hearing was filed. No

347proposed recommended orders were filed.

352FINDINGS OF FACT

3551. Lance Powersports, Inc., is seeking to establish a new

365point motor vehicle dealership in Longwood, Florida, for

373motorcycles manufactured by ZHNG.

3772. Action Orlando is an existing franchise motor vehicle

386dealer for line-make ZHNG, located within 12.5 miles of the

396proposed new point motor vehicle dealership location.

4033. Action Orlando timely filed a protest of Lance

412Powersports, Inc.’s, proposed dealership.

4164. There is no evidence that Acton Orlando is not

426providing adequate representation within the territory of the

434motor vehicles at issue in this proceeding.

441CONCLUSIONS OF LAW

4445. The Division of Administrative Hearings has

451jurisdiction over the parties to and subject matter of this

461proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).

4696. Subsection 320.642(2)(a), Florida Statutes (2008),

475provides as follows:

478An application for a motor vehicle dealer

485license in any community or territory shall

492be denied when:

4951. A timely protest is filed by a presently

504existing franchised motor vehicle dealer

509with standing to protest as defined in

516subsection (3); and

5192. The licensee fails to show that the

527existing franchised dealer or dealers who

533register new motor vehicle retail sales or

540retail leases of the same line-make in the

548community or territory of the proposed

554dealership are not providing adequate

559representation of such line-make motor

564vehicles in such community or territory.

570The burden of proof in establishing

576inadequate representation shall be on the

582licensee. (Emphasis supplied)

5857. The licensees in this case are Petitioners Lance

594Powersports, Inc., and ECO Motor Sports and Scooters, LLC. See

604§§ 320.60(8) and 320.61, Fla. Stat. (2008).

6118. As the licensees, the Petitioners have the burden of

621establishing compliance with applicable statutory requirements

627by a preponderance of the evidence presented at the hearing.

637§ 320.642(2)(a)2., Fla. Stat. (2008). The Petitioners have

645failed to establish that Action Orlando is not providing

654adequate representation of motorcycles manufactured by ZHNG.

661RECOMMENDATION

662Based on the foregoing Findings of Fact and Conclusions of

672Law, it is RECOMMENDED that the Department of Highway Safety and

683Motor Vehicles enter a final order denying the application for

693establishment of the motor vehicle dealer franchise at issue in

703this case.
