116PRELIMINARY STATEMENT

118This cause was referred to the Division of Administrative

127Hearings on or about October 31, 2008. The final hearing date

138of April 29, 2009, was selected so as to comply with the

150applicable statute, Section 320.699, Florida Statutes.

156FINDINGS OF FACT

1591. On October 10, 2008, the Department of Highway Safety

169and Motor Vehicles published a notice in the Florida

178Administrative Weekly. The notice announced that Galaxy

185Powersports, LLC, d/b/a JCL International, LLC, intended to

193establish Putnam City Motors, Inc., d/b/a PC Motors, as a

203dealership for the sale of motorcycles manufactured by Taizhon

212Zhongneng Motorcycle, Co., Ltd. (ZHNG) at 7033 Beach Boulevard,

221Jacksonville (Duval County), Florida 32216, on or after

229September 29, 2008.

2322. Thereafter, the Respondent, (Jeff Wiggins) of Seven

240Bridges Cycles, Inc. timely challenged the approval of the

249proposed dealership.

2513. By a notice entered December 16, 2008, the cause was

262set for formal disputed-fact hearing at 9:30 a.m., April 29,

2722009, by video conference between Jacksonville and Tallahassee,

280Florida.

2814. A Notice of Video Instructions requiring pre-filing of

290exhibits also was entered on December 16, 2008. No party

300complied with the April 18,2009, pre-filing date for exhibits

310set out in that Order.

3155. A few days prior to April 29, 2009, the undersigned's

326secretary called each party to determine if the case had been

337resolved. Neither party returned her phone call.

3446. At 9:30 a.m., on April 29, 2009, no one on behalf of

357either Petitioner or Respondent appeared at either hearing site.

3667. The undersigned caused the court reporter to sound the

376docket in the Jacksonville site's hallway at 9:35 a.m. and at

38710:00 a.m. on April 29, 2009, but no one responded for either

399party or for the manufacturer. By 10:00 a.m., no one had

410appeared at the Tallahassee site.

4158. The hearing was closed without any appearances or

424evidence.

425CONCLUSIONS OF LAW

4289. The Division of Administrative Hearings has

435jurisdiction over the parties and subject matter of this cause,

445pursuant to Sections 120.569 and 120.57(1), Florida Statutes

453(2008).

45410. The duty to go forward and the burden of proof to

466support a new dealership pursuant to Section 320.642, Florida

475Statutes, has not been met herein, and a final order should be

487entered denying a grant of a new point dealership.

496RECOMMENDATION

497Based on the foregoing Findings of Facts and Conclusions of

507Law, it is

510RECOMMENDED that the Department of Highway Safety and Motor

519Vehicles enter a final order denying the new point dealership

529sought by Petitioners Galaxy Powersports, LLC, d/b/a JCL

537International, LLC, and Putnam City Motors, Inc., d/b/a PC

546Motors.
