87STATEMENT OF THE ISSUE

91The issue is whether Petitioners should be allowed to establish a new point dealership for the sale of motorcycles

110manufactured by Taizhou Zhongneng Motorcycle Co., Ltd. (ZHNG),

118in Jacksonville Beach, Florida.

122FINDINGS OF FACT

1251. On October 10, 2008, the Department of Highway Safety

135and Motor Vehicles (Department) published a notice in the

144Florida Administrative Weekly. The notice advised that Galaxy

152Powersports, LLC d/b/a JCL International, LLC, intends to allow

161the establishment of Kitai Powersports, Inc., as a dealership

170for the sale of motorcycles manufactured by Taizhou Zhongneng

179Motorcycle Co., Ltd. (ZHNG) at 228 North 3rd Street,

188Jacksonville Beach, Duval County, Florida, on or after

196October 3, 2008.

1992. By letter received by the Department on October 31,

2092008, Respondent, Roadpower USA LLC, opposed the establishment

217of the dealership selling the same products as Roadpower USA,

227LLC, within .5 miles from its established dealership.

2353. On November 14, 2008, the Department referred this

244matter to the Division of Administrative Hearings to conduct an

254evidentiary hearing.

2564. By Initial Order entered November 14, 2008, Petitioners

265and Respondent were required to provide certain information for

274the scheduling of the final hearing in this cause. None of the

286parties responded to the Initial Order.

2925. A Notice of Hearing by Video Teleconference was entered

302on December 12, 2008, scheduling this case for final hearing on

313May 7, 2009, at 9:00 a.m. An Order of Pre-hearing Instructions

324was entered that same date, which required the parties to

334exchange witness lists and copies of exhibits no later than

344seven days prior to the final hearing. Copies of the witness

355lists were also required to be filed with the Division of

366Administrative Hearings. No witness lists have been filed.

3746. At 9:00 a.m. on May 7, 2009, the final hearing was

386convened. The only persons present were the court reporter, who

396was at the Jacksonville site, and the undersigned, who was at

407the Tallahassee site.

4107. The undersigned waited until approximately 9:25 a.m.,

418but neither the Petitioners nor the Respondent appeared for the

428final hearing. The hearing was adjourned at approximately

4369:30 a.m. No one on behalf of Petitioners or Respondent

446contacted the undersigned’s office with any explanation of their

455non-appearance before the hearing was adjourned, or thereafter.

463CONCLUSIONS OF LAW

4668. The Division of Administrative Hearings has

473jurisdiction over the parties and subject matter of this

482proceeding pursuant to Sections 320.699, 120.569, and 120.57(1),

490Florida Statutes (2008).

4939. Section 320.642, Florida Statutes (2008), sets forth

501the procedure for establishing proposed motor vehicle

508dealerships or permitting the relocations of such dealerships.

516Pursuant to this statute, the burden of proof to support a new

528dealership is on the Petitioners. By failing to appear and

538present evidence at the final hearing, they have failed to meet

549their burden of proof.

553RECOMMENDATION

554Based on the forgoing Findings of Fact and Conclusions of

564Law, it is

567ORDERED:

568That the Department of Highway Safety and Motor Vehicles

577enter a final order denying Petitioners’ application for the new

587point dealership at issue in this case.
