92STATEMENT OF THE ISSUE

96The issue is whether Petitioners should be allowed to establish a new point dealership for the sale of motorcycles manufactured by Taizhou Zhongneng Motorcycle Co., Ltd. (ZHNG), in Jacksonville, Florida.

126FINDINGS OF FACT

1291. On October 10, 2008, the Department of Highway Safety

139and Motor Vehicles (Department) published a notice in the

148Florida Administrative Weekly. The notice advised that Galaxy

156Powersports, LLC d/b/a JCL International, LLC, intends to allow

165the establishment of Putnam City Motors, d/b/a PC Motors, as a

176dealership for the sale of motorcycles manufactured by Taizhou

185Zhongneng Motorcycle Co., Ltd. (ZHNG) at 7033 Beach Boulevard,

194Jacksonville, Duval County, Florida, on or after September 29,

2032008.

2042. By letter received by the Department on October 31,

2142008, Respondent, Roadpower USA LLC, opposed the establishment

222of the dealership selling the same products as Roadpower USA,

232LLC, within 11 miles from its established dealership.

2403. On November 14, 2008, the Department referred this

249matter to the Division of Administrative Hearings to conduct an

259evidentiary hearing.

2614. By Initial Order entered November 14, 2008, Petitioners

270and Respondent were required to provide certain information for

279the scheduling of the final hearing in this cause. None of the

291parties responded to the Initial Order.

2975. A Notice of Hearing by Video Teleconference was entered

307on December 12, 2008, scheduling this case for final hearing on

318May 7, 2009, at 1:00 p.m. An Order of Pre-hearing Instructions

329was entered that same date, which required the parties to

339exchange witness lists and copies of exhibits no later than

349seven days prior to the final hearing. Copies of the witness

360lists were also required to be filed with the Division of

371Administrative Hearings. No witness lists have been filed.

3796. At 1:00 p.m. on May 7, 2009, the final hearing was

391convened. The only persons present were the court reporter, who

401was at the Jacksonville site, and the undersigned, who was at

412the Tallahassee site.

4157. The undersigned waited until approximately 1:25 p.m.,

423but neither the Petitioners nor the Respondent appeared for the

433final hearing. The hearing was adjourned at approximately

4411:30 p.m. No one on behalf of Petitioners or Respondent

451contacted the undersigned’s office with any explanation of their

460non-appearance before the hearing was adjourned, or thereafter.

468CONCLUSIONS OF LAW

4718. The Division of Administrative Hearings has

478jurisdiction over the parties and subject matter of this

487proceeding pursuant to Sections 320.699, 120.569, and 120.57(1),

495Florida Statutes (2008).

4989. Section 320.642, Florida Statutes (2008), sets forth

506the procedure for establishing proposed motor vehicle

513dealerships or permitting the relocations of such dealerships.

521Pursuant to this statute, the burden of proof to support a new

533dealership is on the Petitioners. By failing to appear and

543present evidence at the final hearing, they have failed to meet

554their burden of proof.

558RECOMMENDATION

559Based on the forgoing Findings of Fact and Conclusions of

569Law, it is

572ORDERED:

573That the Department of Highway Safety and Motor Vehicles

582enter a final order denying Petitioners’ application for the new

592point dealership at issue in this case.
