96STATEMENT OF THE ISSUE
100The issue presented is whether Petitioners should be
108allowed to establish a new point dealership for the sale of
119motorcycles manufactured by Benzhou Vehicle Industry Group Co.
127Ltd. (SHWI) in Tampa, Florida.
132FINDINGS OF FACT
1351. On October 17, 2008, the Department of Highway Safety
145and Motor Vehicles published a notice in the Florida
154Administrative Weekly. The notice announced that Galaxy
161Powersports, LLC, d/b/a JCL International, LLC, intends to allow
170the establishment of Florida Sport Trucks, Inc., d/b/a FST
179Motorsports as a dealership for the sale of motorcycles
188manufactured by Benzhou Vehicle Industry Group Co. Ltd. (SHWI)
197at 2301 South 50th Street, Tampa, Hillsborough County, Florida
20633619, on or after October 3, 2008.
2132. By letter received by the Department on October 31,
2232008, Respondent West Coast Cycle, Inc., opposed the
231establishment of the dealership selling the same products as
240West Coast Cycle, Inc., less than 1/2 mile from its location.
2513. On November 14, 2008, the Department referred this
260matter to the Division of Administrative Hearings to conduct an
270evidentiary proceeding.
2724. By Initial Order entered November 14, 2008, Petitioners
281and Respondent were required to provide certain information for
290the scheduling of the final hearing in this cause. None of the
302parties responded to that Initial Order.
3085. By Notice of Hearing by Video Teleconference entered
317December 12, 2008, this matter was scheduled for final hearing
327on May 7, 2009, at 9:30 a.m. By Order of Pre-hearing
338Instructions entered that same date, the parties were required
347to exchange witness lists and copies of exhibits no later than
358seven days prior to the final hearing. Copies of the witness
369lists were also required to be filed with the Division of
380Administrative Hearings. To date, no witness lists have been
389filed.
3906. By Amended Notice of Hearing by Video Teleconference
399entered April 17, 2009, the commencement time of the final
409hearing was changed to 8:30 a.m., but the date and location for
421the final hearing remained the same.
4277. At 8:30 a.m. on May 7, 2009, the final hearing was
439convened. Only the undersigned and the court reporter were
448present.
4498. The undersigned waited until 9:00 a.m., but neither the
459Petitioners nor Respondent appeared for the final hearing.
467Further, neither the Petitioners nor the Respondent, or anyone
476on their behalf, contacted the undersigned regarding their non-
485appearance or late appearance before the final hearing
493adjourned. Since the final hearing was adjourned, there has
502been no contact or explanation from either Petitioners or
511Respondent regarding their non-appearance.
515CONCLUSIONS OF LAW
5189. The Division of Administrative Hearings has
525jurisdiction over the subject matter hereof and the parties
534hereto. §§ 120.569 and 120.57(1), Fla. Stat.
54110. Pursuant to Section 320.642, Florida Statutes, the
549burden of proof to support a new dealership is on the
560Petitioners. They have failed to meet their burden of proof by
571their failure to appear and present evidence at the final
581hearing.
582RECOMMENDATION
583Based on the foregoing Findings of Fact and Conclusions of
593Law, it is
596RECOMMENDED that a final order be entered denying the
605application for the establishment of the new point dealership at
615issue in this case.
