101STATEMENT OF THE ISSUE

105The issue in this case is whether Petitioner voluntarily

114relinquished his license to practice osteopathic medicine.

121PRELIMINARY STATEMENT

123On September 22, 2003, Respondent, Board of Osteopathic

131Medicine (Board), issued a Final Order in Department of Health

141v. James D. ZeBranek, Jr., D.O. , Case No. 2002-29377, accepting

151a voluntary relinquishment to practice osteopathic medicine,

158which was purportedly signed by Petitioner, James D. ZeBranek,

167Jr., D.O. (Dr. ZeBranek). Dr. ZeBranek first learned of the

177Final Order on September 10, 2006.

183Dr. ZeBranek filed a Petition to Rescind Final Order and

193Lift Suspension of License. The Board contended that it did not

204have jurisdiction to consider the petition and entered an order

214denying the petition. Dr. ZeBranek appealed the order, and the

224Fifth District Court of Appeal held that the Board did have

235jurisdiction to hear the petition.

240On November 19, 2008, the Board referred the petition to

250the Division of Administrative Hearings for assignment to an

259Administrative Law Judge to conduct a final hearing.

267By Order dated January 30, 2009, official recognition was

276taken of Florida Administrative Code Chapter 64B15 and the

285opinion of the Fifth District Court of Appeal filed on August 1,

2972008, in James D. ZeBranek, Jr. v. Board of Osteopathic

307Medicine , Case No. 5DO7-525. By Order dated January 30, 2009,

317official recognition was taken of the Romanian Public Ministry

326Ordinance attached to Dr. ZeBranek’s Motion for Judicial

334Recognition of Romanian Public Ministry Ordinance of March 25,

3432008. By Order dated February 2, 2009, official recognition

352was taken of the Final Orders issued by the Board in case

364numbers 6933, 198912229, 199013907, 200110904, 200214679, and

371200229377. By Order dated February 3, 2009, official

379recognition was taken of the 1995 Romanian Law 36 and the 1961

391Hague Apostille Convention.

394The parties entered into a Joint Pre-hearing Stipulation

402and agreed to certain facts contained in Section E of the Joint

414Pre-hearing Stipulation. To the extent relevant, those facts

422have been incorporated in this Recommended Order.

429At the final hearing, Dr. ZeBranek testified in his own

439behalf and called James R. LaVigne and Oana Meda Ungureanu as

450his witnesses. Petitioner’s Exhibits 1, 3, 5, 8 through 11,

460and 13 were admitted in evidence.

466At the final hearing, the Board called Richard A. Shoop and

477Christy Robinson as its witnesses. The Department presented no

486exhibits for admission in evidence.

491Administrative Law Judge’s Exhibit 1, which is the

499Voluntary Relinquishment of License at issue, was admitted in

508evidence.

509The Transcript was filed on March 16, 2009. The parties

519agreed to file their proposed recommended orders within ten days

529of the filing of the Transcript. The parties timely submitted

539their Proposed Recommended Orders, which have been considered in

548the preparation of this Recommended Order.

554FINDINGS OF FACT

5571. Prior to September 22, 2003, Dr. ZeBranek was a

567licensed osteopathic physician in Florida, having been issued

575license number OS 0005033.

5792. The Florida Legislature enacted Chapter 459, Florida

587Statutes, and created the Board in order to ensure that every

598osteopathic physician practicing in Florida meets minimum

605requirements for safe and effective practice. All Florida-

613licensed osteopathic physicians are subject to regulation by the

622Board.

6233. In January 2003, Dr. ZeBranek went to Romania and

633stayed there until March 2006. While Dr. ZeBranek was in

643Romania, the Department of Health (Department) filed an

651Administrative Complaint against him. The attorney representing

658the Department was Richard Shoop.

6634. Sometime prior to June 11, 2003, Mr. Shoop was in

674contact with Dr. ZeBranek. Dr. ZeBranek requested that

682Mr. Shoop send him a voluntary relinquishment of license form

692for his consideration. Mr. Shoop sent Dr. ZeBranek a document

702which had been prepared by the Department staff. The document

712was entitled Voluntary Relinquishment of License

718(Relinquishment) and contained the style of the case and case

728number. The Relinquishment provided that Dr. ZeBranek was

736relinquishing his license to practice osteopathic medicine in

744Florida and was agreeing to never again apply for a license to

756practice osteopathic medicine in Florida. The Relinquishment

763further indicated that acceptance by the Board of the

772Relinquishment would be considered to be discipline by the

781Board. Mr. Shoop sent the Relinquishment to a Florida address.

7915. The Relinquishment contained a signature line and an

800acknowledgment form to be completed by a notary public. The

810acknowledgment form comports with the requirements of

817Section 117.05, Florida Statutes (2003). It was the practice of

827the Board that the execution of voluntary relinquishments be

836executed before a notary public.

8416. Sometime after June 11, 2003, and prior to September 6,

8522003, Mr. Shoop received the same form that he had sent to

864Dr. ZeBranek. The form had been purportedly signed by

873Dr. ZeBranek and notarized by a Romanian notary public, Olimpia

883Ungureanu. The notary acknowledgment contained the driver’s

890license number and passport number of Dr. ZeBranek as the

900identifiers used by the notary public. The signature on the

910Relinquishment appears to be similar to some other signatures by

920Dr. ZeBranek. 1

9237. The Relinquishment which was received and which was

932purportedly notarized by Ms. Ungureanu was written in English.

941There was no Romanian translation attached to the

949Relinquishment. No evidence was presented to establish whether

957Ms. Ungureanu was fluent in English. No Apostille was attached

967to the Relinquishment, certifying the authenticity of the

975document.

9768. After the Relinquishment was received by Mr. Shoop,

985Mr. Shoop had no further communications with Dr. ZeBranek. The

995executed Relinquishment was presented to the Board at a meeting

1005on September 6, 2003. At the time the Relinquishment was

1015presented to the Board, Dr. ZeBranek’s license was under

1024suspension as a result of a Final Order entered in DOH Case

1036No. 2002-14679. The Board accepted the Relinquishment and

1044entered a Final Order to that effect. The Final Order was filed

1056on September 19, 2003.

10609. Dr. ZeBranek contends that he never signed the

1069Relinquishment and never sent it to Mr. Shoop. Dr. ZeBranek

1079feels that his former wife, with whom he is involved in an

1091acrimonious divorce proceeding, is responsible for sending the

1099fraudulent Relinquishment to the Board. Dr. ZeBranek’s opinion

1107is not without some basis. In the past, he has been involved a

1120situation in which a forged deed, allegedly notarized by the

1130same notary who purportedly notarized the Relinquishment, was

1138used by his former wife to transfer the marital home in Florida

1150to herself. A Romanian public prosecutor refused to prosecute

1159the notary for forgery, concluding that the notary whose name

1169appeared on the deed did not notarize the deed.

117810. The preponderance of the evidence establishes that

1186Dr. ZeBranek did not sign the Relinquishment.

1193CONCLUSIONS OF LAW

119611. The Division of Administrative Hearings has

1203jurisdiction over the parties to and the subject matter of this

1214proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).

122212. As the Petitioner, Dr. ZeBranek seeks to overturn the

1232Final Order based on the Relinquishment which the Board

1241received. He must establish by a preponderance of the evidence

1251that the signature was not his. See Florida Department of

1261Transportation v. J.W.C. Company, Inc. , 396 So. 2d 778 (Fla. 1st

1272DCA 1981).

127413. Subsection 90.902(3), Florida Statutes (2003),

1280provides that foreign documents may be self-authenticating when

1288the documents have been executed or attested to in accordance

1298with the foreign laws where the document was executed or

1308attested to and is accompanied by a final certification.

131714. In the instant case, the Relinquishment was not

1326notarized in accordance with Romanian law, which requires that

1335the document be written in Romanian and translated into the

1345foreign language by a certified translator unless the notary

1354knows the foreign language in which the document is written.

13641995 Romanian Law 36, Chapter 5, Section I, Article 47. The

1375Relinquishment was not accompanied by a final certification.

138315. Dr. ZeBranek has established by a preponderance of the

1393evidence that he did not sign the Relinquishment relied upon by

1404the Board in entering a Final Order accepting a voluntary

1414relinquishment of his license to practice medicine.

1421Dr. ZeBranek testified that he did not execute the

1430Relinquishment. He has been involved in a situation in the past

1441in which the notarization of the notary who purportedly

1450notarized the Relinquishment was forged. The Relinquishment did

1458not have an Apostille attached, which would have authenticated

1467the Relinquishment. The notarization did not comply with

1475Romanian law.

147716. At the conclusion of the final hearing, Dr. ZeBranek

1487moved for attorney’s fees. He did not state the basis for his

1499motion, and no attorney was representing Dr. ZeBranek in this

1509proceeding.

1510RECOMMENDATION

1511Based on the foregoing Findings of Fact and Conclusions of

1521Law, it is RECOMMENDED that a final order finding that the

1532Relinquishment was not executed by Dr. ZeBranek; vacating the

1541Final Order entered on September 22, 2003; and denying the

1551request for attorney’s fees.

1612ENDNOTE

16131/ Dr. ZeBranek submitted several exemplars of his signature in

1623evidence as Petitioner’s Composite Exhibit 13. Some of the

1632exemplars were markedly different from each other. Dr. ZeBranek

1641stated that his signature changed during 2002 to 2004. No

1651explanation was given for the change in appearances of the

1661signatures. The signature on the Relinquishment resembles some

1669of the signatures in the exhibit and is quite different from

1680some of the signatures in the exhibit.
