111STATEMENT OF THE ISSUE
115The issue in the case is whether an application for a motor
127vehicle dealer license filed by LS MotorSports, LLC, and
136Michael J. Konczal, Inc., should be approved.
143PRELIMINARY STATEMENT
145By notice published in the Florida Administrative Weekly
153(Volume 34, Number 29; July 18, 2008), the Department of Highway
164Safety and Motor Vehicles (Department) gave notice that
172LS MotorSports, LLC (LS MotorSports), was seeking to establish a
182new point motor vehicle dealership in St. Petersburg, Florida,
191with Michael J. Konczal, Inc., for the line-make "Chunfeng
200Holding Group Co. Ltd.(CFHG)." A challenge to the establishment
209of the dealership was filed with the Department by an existing
220motorcycle dealership, Seminole Scooters, Inc. (Respondent).
226By letter dated July 31, 2008, the Department forwarded the
236challenge to the Division of Administrative Hearings. On
244August 1, 2008, an Initial Order was issued, directing the
254parties to identify the anticipated length of the hearing and
264dates upon which the parties were available. The Respondent
273filed a response to the Initial Order, requesting that the
283hearing be scheduled in St. Petersburg, Florida, and the hearing
293was scheduled accordingly. The case was transferred to the
302undersigned Administrative Law Judge on January 29, 2009.
310At the hearing, Petitioner, Michael Konczal, testified on
318his own behalf. The Respondent's representative testified on
326behalf of the Respondent. No exhibits were offered into
335evidence.
336No transcript of the hearing was filed. The Respondent
345filed a Proposed Recommended Order.
350FINDINGS OF FACT
3531. LS MotorSports is seeking to establish a new point
363motor vehicle dealership in St. Petersburg, Florida, for line-
372make Chunfeng Holding Group Co. Ltd.(CFHG).
3782. The Respondent is an existing franchise motor dealer
387for line-make Chunfeng Holding Group Co. Ltd.(CFHG) and is
396located within 12.5 miles of the proposed new point motor
406vehicle dealership location. The majority of the Respondent's
414vehicle sales come from within a 12.5-mile radius of the
424proposed dealership.
4263. The Respondent timely filed a protest of
434LS MotorSports proposed dealership.
4384. There is no evidence that the Respondent is not
448providing adequate representation within the territory of the
456motor vehicles at issue in this proceeding.
463CONCLUSIONS OF LAW
4665. The Division of Administrative Hearings has
473jurisdiction over the parties to and subject matter of this
483proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).
4916. Subsection 320.642(2)(a), Florida Statutes (2008),
497provides as follows:
500An application for a motor vehicle dealer
507license in any community or territory shall
514be denied when:
5171. A timely protest is filed by a presently
526existing franchised motor vehicle dealer
531with standing to protest as defined in
538subsection (3); and
5412. The licensee fails to show that the
549existing franchised dealer or dealers who
555register new motor vehicle retail sales or
562retail leases of the same line-make in the
570community or territory of the proposed
576dealership are not providing adequate
581representation of such line-make motor
586vehicles in such community or territory.
592The burden of proof in establishing
598inadequate representation shall be on the
604licensee. (Emphasis supplied)
6077. The licensees in this case are Petitioners,
615LS Motorsports and Michael J. Konczal, Inc. See
623§§ 320.60(8) and 320.61, Fla. Stat. (2008).
6308. As the licensees, the Petitioners have the burden of
640establishing compliance with applicable statutory requirements
646by a preponderance of the evidence presented at the hearing.
656§ 320.642(2)(a)2., Fla. Stat. (2008). The Petitioners have
664failed to establish that the Respondent is not providing
673adequate representation of the line-make Chunfeng Holding Group
681Co. Ltd.(CFHG).
683RECOMMENDATION
684Based on the foregoing Findings of Fact and Conclusions of
694Law, it is RECOMMENDED that the Department of Highway Safety and
705Motor Vehicles enter a final order denying the application for
715establishment of the motor vehicle dealer franchise at issue in
725this case.
