91STATEMENT OF THE ISSUE

95The issue is whether Petitioners are entitled to a motor

105vehicle dealership that is proposed to be located in Winter

115Park, Florida.

117PRELIMINARY STATEMENT

119On February 6, 2009, Zongshen, Inc., and Scooter City USA,

129LLC (Petitioners) published a Notice of Publication for a New

139Point Franchise Motor Vehicle Dealer in a County of More than

150300,000 Population in the Florida Administrative Weekly .

159Respondent Action Orlando Motorsports filed a protest with the

168Department of Highway Safety and Motor Vehicles (Department) on

177February 16, 2009. By letter dated February 17, 2009, the

187Department referred the matter to DOAH to assign an

196administrative law judge to conduct a hearing "for the sole

206purpose of determining the propriety of the protest regarding

215issues specifically within the purview of Sections 320.642 and

224320.699, Florida Statutes."

227The hearing was convened as scheduled. Respondent was

235present and ready to proceed. Petitioners made no appearance.

244James Sursely, the owner of Action Orlando Motorsports,

252testified at the hearing.

256The hearing was not transcribed. Respondent waived the

264filing of a proposed recommended order. All references to the

274Florida Statutes are to the 2008 edition unless otherwise

283indicated.

284FINDINGS OF FACT

2871. Respondent is an existing franchised dealer of

295motorcycles manufactured by Zongshen Industrial Group (ZONG).

3022. Petitioners have proposed the establishment of a new

311dealership to sell the same line and make of motorcycles as

322those sold by Respondent.

3263. Respondent's dealership is located at 306 West Main

335Street, Apopka, Florida 32712.

3394. Petitioners' proposed dealership would be located at

3472650 West Fairbanks Avenue, Winter Park, Florida 32789.

3555. The proposed dealership is within a 12.5-mile radius of

365Respondent's dealership.

3676. Respondent has standing to protest the establishment of

376the proposed dealership.

379CONCLUSIONS OF LAW

3827. DOAH has jurisdiction over the parties and the subject

3928. The Department is the agency responsible for regulating

401the licensing and franchising of motor vehicle dealers.

409§§ 320.60-320.70, Fla. Stat.

4139. Subsection 320.642(1), Florida Statutes, requires a

420motor vehicle dealer who proposes to establish an additional

429motor vehicle dealership within an area already represented by

438the same line-make vehicle to give written notice to the

448Department of its intent to establish a new franchise. The

458statute also provides that any affected dealership may protest

467the establishment of a new franchise in its territory.

47610. Subsection 320.642(2), Florida Statutes, establishes

482the standards of review to determine if establishment of a new,

493competing motor vehicle franchise should be granted. Subsection

501320.642(2)(a), Florida Statutes, provides in relevant part:

508An application for a motor vehicle dealer

515license in any community or territory shall

522be denied when:

5251. A timely protest is filed by a presently

534existing franchised motor vehicle dealer

539with standing to protest as defined in

546subsection (3); and

5492. The licensee fails to show that the

557existing franchised dealer or dealers who

563register new motor vehicle retail sales or

570retail leases of the same line-make in the

578community or territory of the proposed

584dealership are not providing adequate

589representation of such line-make motor

594vehicles in such community or territory.

600The burden of proof in establishing

606inadequate representation shall be on the

612licensee.

61311. Pursuant to Subsection (3)(b)1. of Section 320.642,

621Florida Statutes, "if the proposed additional . . . motor

631vehicle dealer is to be located in a county with a population of

644more than 300,000," as in the instant case, then any existing

656motor vehicle dealer of the same line-make whose licensed

665franchise location is within a radius of 12.5 miles of the

676proposed additional dealer has standing to file a protest within

686the meaning of Subsection (2)(a)1. of the statute.

69412. Respondent is an existing motor vehicle dealer who has

704standing to file a protest of the proposed new dealership in

715this case.

71713. The burden is therefore on Petitioners to prove that

727there is "inadequate representation" in the community or

735territory of the proposed new dealership, according to the

744criteria set forth in Subsection 320.642(2)(b), Florida

751Statutes.

75214. Petitioners made no appearance and presented no

760evidence at the final hearing. Petitioners failed to meet their

770burden of proof.

77315. The approval sought by Petitioners must therefore be

782denied.

783RECOMMENDATION

784Based on the foregoing Findings of Fact and Conclusions of

794Law, it is

797RECOMMENDED:

798That the Department of Highway Safety and Motor Vehicles

807enter a final order denying the establishment of Petitioners'

816proposed franchise.
