97STATEMENT OF THE ISSUES
101The issues are whether Respondent violated Subsections
108475.25(1)(e) and (u) and Section 475.5015, Florida Statutes
116(2006), 1 respectively, by failing to preserve and make available
126books, records, and supporting documents; failing to keep an
135accurate account of all trust fund transactions; and failing to
145direct, control, or manage a sales associate, and, if so, what
156penalty should be imposed.
160PRELIMINARY STATEMENT
162Petitioner filed an Administrative Complaint against
168Respondent on September 16, 2008. Respondent timely requested a
177formal hearing, and Petitioner referred the matter to DOAH to
187conduct the hearing.
190At the hearing, Petitioner presented the testimony of one
199witness and submitted six exhibits for admission into evidence.
208Respondent did not appear and did not present any evidence. The
219identity of the witness and exhibits, and the rulings regarding
229each, are reported in the Transcript of the hearing filed with
240DOAH on June 22, 2009.
245Petitioner timely filed its Proposed Recommended Order
252(PRO) on June 19, 2009. On June 22, 2009, Petitioner requested
263that the time for filing PROs be extended to June 19, 2009. The
276ALJ granted the motion. Respondent did not file a PRO.
286FINDINGS OF FACT
2891. Petitioner is the state agency responsible for
297regulating the practice of real estate in the state. Respondent
307is licensed as a real estate broker pursuant to license
317number 674853.
3192. Respondent operates a real estate brokerage office in
328the name of Sky Land Realty Group, LLC. (Sky Land). The
339principal place of business of Sky Land is 4248 Town Center
350Boulevard, Number 5, Orlando, Florida. Respondent's duties
357include the supervision of Ms. Jamicell Janet Perez, a licensed
367real estate sales associate, referred to hereinafter as the
376sales associate.
3783. On May 22, 2007, Respondent and the sales associate
388represented Mr. Edwin Torres and Ms. Meary Ann Berrios (the
398Buyers) in the purchase of a residential property located at
4087471 Wayland Boulevard, Orlando, Florida (the property). The
416Buyers submitted a written offer to purchase the property. In
426relevant part, the offer included an earnest money deposit of
436$500.00.
4374. On May 22, 2007, the owners of the property, in
448relevant part, verbally rejected the Buyers' offer and counter
457offered to sell the property, if the earnest money deposit were
468increased to $2,000.00. Changes to the written contract are
478initialed by the owners and dated May 23, 2007.
4875. The sales associate did not deliver the $500.00 deposit
497to Respondent but shredded the check after receiving the verbal
507counter offer from the owners on May 22, 2007. The record does
519not show whether the Buyers replaced the destroyed check with a
530check for $2,000.00; accepted any other terms of the counter
541offer; or purchased the property. It is undisputed that the
551listing broker for the owners of the property is the complaining
562witness in this proceeding, but the broker did not testify at
573the hearing.
5756. At some future date, an investigator for Petitioner
584requested Respondent's relevant business records. Respondent
590failed to retain a copy of the $500.00 deposit check.
600Respondent failed to supervise the sales associate by requiring
609her to deliver the check to Respondent so that Respondent could
620deliver the check to the listing broker.
627CONCLUSIONS OF LAW
6307 . D O A H has jurisdiction over the parties to and subject
644(2008). DOAH provided the parties with adequate notice of the
654final hearing.
6568 . Peti tioner bears the burden of proof. Petitioner must
667show by clear and convincing evidence that Respondent committed
676the acts alleged in the Administrative Complaint and the
685reasonableness of any penalty. Department of Banking and
693Finance, Division of Securities and Investor Protection v.
701Osborne Stern and Company , 670 So. 2d 932, 935 (Fla. 1996);
712Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987); State ex rel.
724Vining v. Florida Real Estate Commission , 281 So. 2d 487
734(Fla. 1973).
7369. Petitioner satisfied its burden of showing that
744Respondent violated Subsection 475.25(1)(u) by failing to
751supervise the sales associate to ensure the sales associate
760delivered the check to Respondent so that Respondent could
769deposit the check into the appropriate escrow account. The
778evidence is also clear and convincing that Respondent violated
787Subsection 475.25(1)(e) and Florida Administrative Code
793Rule 61J2-14.012(1), which requires an accurate accounting of
801all trust fund transactions, by failing to retain a copy of the
813deposit check of $500.00 in Respondent's business records of the
823transaction.
82410. The evidence is less than clear and convincing that
834Respondent failed to deliver any other records to Petitioner.
843The evidence is also less than clear and convincing that the
854sales associate retained the deposit check of $500.00 until
863June 8, 2007, as alleged in paragraph number 6 of the
874Administrative Complaint.
87611. The Administrative Complaint does not allege that the
885sales associate held the deposit check of $500.00 and shredded
895it on the same day it was written. Petitioner cannot find the
907sales associate guilty of acts not alleged in the Administrative
917Complaint. Ghani v. Department of Health , 714 So. 2d 1113 (Fla.
9281st DCA 1998); Cotrill v. Department of Insurance , 685 So. 2d
9391371 (Fla. 1st DCA 1996). However, the allegations in the
949Administrative Complaint against the sales associate are
956rendered moot by a settlement agreement entered into at the
966hearing between Petitioner and the sales associate. 2
97412. Petitioner submitted no evidence of prior disciplinary
982history against Respondent. There is no evidence that the
991violations resulted in financial harm to any person. There is
1001no factual basis to support Petitioners request in its PRO for
1012revocation of Respondents license or the imposition of a
1021$5,000.00 fine.
1024RECOMMENDATION
1025Based upon the foregoing Findings of Fact and Conclusions
1034of Law, it is
1038RECOMMENDED that Petitioner enter a final order finding
1046that Respondent failed to supervise a sales associate and failed
1056to retain a copy of a deposit check of $500.00; imposing a fine
1069of $1,000.00; and requiring Respondent to pay fees pursuant to
1080Subsection 455.227(3).
