101STATEMENT OF THE ISSUE
105The issue in the case is whether an application for a new
117point franchise motor vehicle dealership filed by Zongshen,
125Inc., and Biker-Barn Source Sales, Inc., should be approved.
134PRELIMINARY STATEMENT
136By notice published in the Florida Administrative Weekly
144(Volume 35, Number 5; February 6, 2009), the Department of
154Highway Safety and Motor Vehicles (Department) gave notice that
163Zongshen, Inc. (Zongshen), was seeking to establish a new point
173motor vehicle dealership in Cape Coral, Lee County, Florida,
182with Biker-Barn Source Sales, Inc. (Biker-Barn), for the line-
191make "Zongshen Industrial Group (ZONG)." A challenge to the
200establishment of the dealership was filed with the Department by
210an existing motorcycle dealership, Action Motorsports, Inc.
217(Respondent).
218By letter dated February 27, 2009, the Department forwarded
227the challenge to the Division of Administrative Hearings. An
236Initial Order was issued on March 2, 2009, directing the parties
247to identify dates upon which the parties were available for
257hearing. The Respondent filed a response to the Initial Order.
267The hearing was scheduled in accordance with the Respondent's
276response and with Subsection 320.699(2), Florida Statutes
283(2009).
284Neither Petitioner appeared or was otherwise represented at
292the hearing. The Respondent was represented by counsel and had
302one exhibit admitted into evidence. No transcript of the
311hearing was filed. No proposed recommended orders were filed.
320FINDINGS OF FACT
3231. Biker-Barn is seeking to establish a new point
332franchise motor vehicle dealership at 924 Del Prado Boulevard
341South, Cape Coral, in Lee County, Florida, for line-make ZONG.
3512. The Respondent is an existing franchise dealer for
360ZONG-manufactured vehicles and is located within 12.5 miles of
369the proposed new point motor vehicle dealership location. The
378majority of the Respondent's vehicle sales come from within a
38812.5-mile radius of the proposed dealership.
3943. The Respondent timely filed a protest of the proposed
404Biker-Barn dealership.
4064. There is no evidence that the Respondent is not
416providing adequate representation within the territory of the
424motor vehicles at issue in this proceeding.
431CONCLUSIONS OF LAW
4345. The Division of Administrative Hearings has
441jurisdiction over the parties to and subject matter of this
451proceeding. §§ 120.569 and 120.57, Fla. Stat. (2009).
4596. Subsection 320.642(2)(a), Florida Statutes (2009),
465provides as follows:
468An application for a motor vehicle dealer
475license in any community or territory shall
482be denied when:
4851. A timely protest is filed by a presently
494existing franchised motor vehicle dealer
499with standing to protest as defined in
506subsection (3); and
5092. The licensee fails to show that the
517existing franchised dealer or dealers who
523register new motor vehicle retail sales or
530retail leases of the same line-make in the
538community or territory of the proposed
544dealership are not providing adequate
549representation of such line-make motor
554vehicles in such community or territory.
560The burden of proof in establishing
566inadequate representation shall be on the
572licensee. (Emphasis supplied)
5757. The licensees in this case are Petitioners Zongshen and
585Biker-Barn. See §§ 320.60(8) and 320.61, Fla. Stat. (2009).
5948. As the licensees, the Petitioners have the burden of
604establishing compliance with applicable statutory requirements
610by a preponderance of the evidence presented at the hearing.
620See § 320.642(2)(a)2., Fla. Stat. (2009). The Petitioners have
629failed to establish that the Respondent is not providing
638adequate representation of the ZONG line-make.
644RECOMMENDATION
645Based on the foregoing Findings of Fact and Conclusions of
655Law, it is RECOMMENDED that the Department enter a final order
666denying the Petitioners' application for establishment of the
674new point franchise motor vehicle dealer franchise.
