104STATEMENT OF THE ISSUE
108Whether Petitioner is entitled to renewal of its standard
117license as a group home for the developmentally disabled.
126PRELIMINARY STATEMENT
128On August 20, 2008, the Petitioner, Lamars Companion
136Service Corp., filed a Petition for Formal Administrative
144Hearing with the Agency for Persons with Disabilities (APD),
153challenging APDs failure to renew her standard license as a
163group home for the developmentally disabled. In the Petition,
172Petitioner also attempted to dispute action taken by the Agency
182for Health Care Administration (AHCA), a separate agency from
191APD. AHCA was never served with the Petition. Accordingly, on
201March 23, 2009, APD forwarded the Petition for Formal
210Administrative Hearing to the Division of Administrative
217Hearings. The only issue forwarded to the Division of
226Administrative Hearings was the issue regarding renewal of
234Petitioners standard license as a group home for the
243developmentally disabled.
245At the hearing, Petitioner offered the testimony of 2
254witnesses and offered 4 exhibits into evidence. Respondent
262offered the testimony of 3 witnesses and offered 6 exhibits into
273evidence.
274After the hearing, Petitioner filed a Proposed Recommended
282Order on June 13, 2009. The proposed order consisted of a
293letter and several unmarked exhibits. The exhibits were not
302introduced into evidence at the hearing, but have been
311considered in the preparation of this Recommended Order.
319Respondent agency also filed a Proposed Recommended Order on
328July 13, 2009.
331FINDINGS OF FACT
3341. For many years, Petitioner was a licensed group home
344under APD and filed its annual application for renewal of its
355license. The group home was known as Lindseys Group Home and
366was located in Cantonment, Florida. It was operated by Minnie
376Lindsey. Around October 1, 2007, Petitioner was again licensed
385by the Department as a group home caring for developmentally
395disabled persons. The license issued was Standard license #S-
4041031. It expired on September 30, 2008.
4112. Petitioner and APD also entered into a Medicaid Waiver
421Services Agreement to provide services to disabled clients of
430APD under the Developmental Disabilities Home and Community
438Based Waiver program or the Family and Supported Living Program.
448Because of its contract with APD, Petitioner was issued a
458Medicaid provider number by the Agency for Health Care
467Administration. The Medicaid provider number permitted
473Petitioner to be paid for providing Medicaid qualified services
482to APDs clients.
4853. By letter dated July 30, 2008, Petitioner was notified
495that APD was terminating the Medicaid Waiver Services Agreement
504with Petitioner. The effective date of the termination was
513August 29, 2008. The letter took no action against Petitioners
523license.
5244. As a result of APDs termination of its contract with
535Petitioner, AHCA cancelled Petitioners Medicaid provider
541number. Both actions are in litigation in the Escambia County
551Circuit Court and the issues and evidence surrounding those
560actions are not relevant to this proceeding.
5675. On the other hand, the evidence was clear, and
577Petitioner admitted, that no application for renewal of
585Petitioners license was submitted to APD. Petitioner also
593admitted that she knew an application was required for license
603renewal. Given these facts, Petitioner is not entitled to
612renewal of its license as a group home since it failed to submit
625an application for renewal of its license.
632CONCLUSIONS OF LAW
6356. The Division of Administrative Hearings has
642jurisdiction over the limited subject matter of and the parties
652to this proceeding. § 120.57(1), Fla. Stat. (2008).
6607. Petitioner has the burden of proving entitlement to a
670license. Florida Department of Transportation v. J.W.C. Co.,
678Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981). Department of Banking
690and Finance v. Osborne Stern and Company , 670 So. 2d 932, 934
702(Fla. 1996). Additionally, Petitioner must show that it meets
711all of the relevant statutory criteria to satisfy this burden.
7218. Section 393.067, Florida Statutes, states, in relevant
729part:
730(1) The agency shall provide through its
737licensing authority and by rule license
743application procedures, provider
746qualifications, facility and client care
751standards, requirements for client records,
756requirements for staff qualifications and
761training, and requirements for monitoring
766foster care facilities, residential
770habilitation centers, and comprehensive
774transitional education programs that serve
779agency clients.
781* * *
784(3) An application for a license under this
792section must be made to the agency on a form
802furnished by it and shall be accompanied by
810the appropriate license fee.
8149. Petitioner has admitted that it failed to submit an
824application for license renewal. By its terms, its license
833expired on September 30, 2008. There was no evidence in the
844record that the agency took any action regarding Petitioners
853now-expired license. Given these facts, Petitioner is not
861entitled to a renewal of its license and the Petition for Formal
873Administrative Hearing should be dismissed.
878RECOMMENDATION
879Based on the foregoing Findings of Fact and Conclusions of
889Law, it is, therefore,
893RECOMMENDED that a final order be entered finding
901Petitioner is not entitled to renewal of its license and
911dismissing the Petition for Formal Administrative Hearing.
