120Whether Respondent, Designing Women Landscaping, Inc.
126(Respondent), a dealer in agricultural products, owes
133Petitioner, Landscape Nursery, Inc. (Petitioner), a producer of
141Florida agricultural products, a sum of money for plants
150purchased from Petitioner's nursery.
154SUMMARY DISPOSITION
156On or about February 27, 2009, Petitioner filed an amended
166complaint with the Florida Department of Agriculture and
174Consumer Services (the "Department"), alleging that Respondent
182owes Petitioner the sum of $4,924.40, for plants delivered from
193Petitioner's nursery to Respondent's place of business.
200Respondent conceded that it owed some amount to the Petitioner,
210but prior to the hearing the parties could not agree on the
222amount owed. The Department forwarded the case to the Division
232of Administrative Hearings on March 27, 2009. The case was
242assigned to the undersigned and initially set for hearing on
252May 8, 2009. One continuance was granted, and the hearing was
263re-scheduled for May 22, 2009.
268The hearing was convened as re-scheduled. Prior to the
277taking of testimony, the parties discussed settlement of the
286matter. At the conclusion of their discussions, the parties
295stipulated: that the Division of Administrative Hearings has
303jurisdiction over this matter and the parties thereto pursuant
312to Section 120.569 and Subsection 120.57(1), Florida Statutes
320(2009); that, at all times relevant to this proceeding,
329Petitioner was a "producer" pursuant to Subsection 604.15(9),
337Florida Statutes (2009); that, at all times relevant to this
347proceeding, Respondent was a "dealer in agricultural products"
355pursuant to Subsection 604.15(2), Florida Statutes (2009); that
363Respondent owes Petitioner $3,033.84 for plants delivered by
372Petitioner to Respondent; and, that no further interest would be
382sought or assessed against Respondent on the agreed principal
391amount owed to Petitioner.
395Based on the foregoing stipulations, it is
402RECOMMENDED that the Florida Department of Agriculture and
410Consumer Services enter a final order requiring Respondent,
418Designing Women Landscaping, Inc., to pay Petitioner, Landscape
426Nursery, Inc., the principal sum of $3,033.84, without interest.
