101STATEMENT OF THE ISSUE

105The issue is whether Petitioners are entitled to a motor vehicle dealership that is proposed to be located in Gainesville, Florida.

126PRELIMINARY STATEMENT

128On May 29, 2009, Galaxy Powersports, LLC d/b/a JCL

137International, LLC, and Solano Cycle, Inc. (Petitioners)

144published a Notice of Publication for a New Point Franchise

154Motor Vehicle Dealer in a County of Less than 300,000 Population

166in the Florida Administrative Weekly . Respondent Austin Global

175Enterprises, LLC d/b/a New Scooters 4 Less (Respondent) filed a

185protest with the Department of Highway Safety and Motor Vehicles

195(Department) on June 3, 2009. By letter dated June 3, 2009, the

207Department referred the matter to DOAH to assign an

216Administrative Law Judge to conduct a hearing "for the sole

226purpose of determining the propriety of the protest regarding

235issues specifically within the purview of Sections 320.642 and

244320.699, Florida Statutes."

247The hearing was convened as scheduled. Respondent was

255present and ready to proceed. Petitioners made no appearance.

264Collin Austin, the owner of Austin Global Enterprises, LLC,

273testified at the hearing. Respondent's Exhibit 1, a map

282indicating the distance between the places of business of Solano

292Cycle, Inc., and New Scooters 4 Less, was admitted into

302evidence.

303The hearing was not transcribed. Respondent waived the

311filing of a proposed recommended order. All references to the

321Florida Statutes are to the 2009 edition unless otherwise

330indicated.

331FINDINGS OF FACT

3341. Respondent is an existing franchised dealer of

342motorcycles manufactured by Shanghai Shenke Motorcycle Co. Ltd.

350(SHEN).

3512. Petitioners have proposed the establishment of a new

360dealership to sell the same line and make of motorcycles as

371those sold by Respondent.

3753. Respondent's dealership is located at 118 Northwest

38314th Avenue, Gainesville, Florida 32601.

3884. Petitioners' proposed dealership would be located at

3961024 South Main Street, Gainesville, Florida 32601.

4035. The proposed dealership is within a 20-mile radius of

413Respondent's dealership.

4156. Respondent has standing to protest the establishment of

424the proposed dealership.

427CONCLUSIONS OF LAW

4307. DOAH has jurisdiction over the parties and the subject

4408. The Department is the agency responsible for regulating

449the licensing and franchising of motor vehicle dealers.

457§§ 320.60-320.70, Fla. Stat.

4619. Subsection 320.642(1), Florida Statutes, requires a

468motor vehicle dealer who proposes to establish an additional

477motor vehicle dealership within an area already represented by

486the same line-make vehicle to give written notice to the

496Department of its intent to establish a new franchise. The

506statute also provides that any affected dealership may protest

515the establishment of a new franchise in its territory.

52410. Subsection 320.642(2), Florida Statutes, establishes

530the standards of review to determine if establishment of a new,

541competing motor vehicle franchise should be granted. Subsection

549320.642(2)(a), Florida Statutes, provides in relevant part:

556An application for a motor vehicle dealer

563license in any community or territory shall

570be denied when:

5731. A timely protest is filed by a presently

582existing franchised motor vehicle dealer

587with standing to protest as defined in

594subsection (3); and

5972. The licensee fails to show that the

605existing franchised dealer or dealers who

611register new motor vehicle retail sales or

618retail leases of the same line-make in the

626community or territory of the proposed

632dealership are not providing adequate

637representation of such line-make motor

642vehicles in such community or territory.

648The burden of proof in establishing

654inadequate representation shall be on the

660licensee.

66111. Pursuant to Subsection (3)(a)2. of Section 320.642,

669Florida Statutes, "if the proposed additional . . . motor

679vehicle dealer is to be located in a county with a population of

692less than 300,000" as in the instant case, then any existing

704motor vehicle dealer of the same line-make whose licensed

713franchise location is within a radius of 20 miles of the

724proposed additional dealer has standing to file a protest within

734the meaning of Subsection (2)(a)1. of the statute.

74212. Respondent is an existing motor vehicle dealer who has

752standing to file a protest of the proposed new dealership in

763this case.

76513. The burden is therefore on Petitioners to prove that

775there is "inadequate representation" in the community or

783territory of the proposed new dealership, according to the

792criteria set forth in Subsection 320.642(2)(b), Florida

799Statutes.

80014. Petitioners made no appearance and presented no

808evidence at the final hearing. Petitioners failed to meet their

818burden of proof.

82115. The approval sought by Petitioners must therefore be

830denied.

831RECOMMENDATION

832Based on the foregoing Findings of Fact and Conclusions of

842Law, it is

845RECOMMENDED:

846That the Department of Highway Safety and Motor Vehicles

855enter a final order denying the establishment of Petitioners'

864proposed franchise.
