114STATEMENT OF THE ISSUES

118The issues for determination are whether Respondents are

126indebted to Petitioner in the amount of $4,273.15 for

136agriculture products, plus a $50.00 filing fee, totaling

144$4,323.15; and whether Respondents are indebted to Petitioner in

154the amount of $551.00 for agriculture products, plus a $50.00

164filing fee, totaling $601.00.

168PRELIMINARY STATEMENT

170Edward L. Myrick, d/b/a Edward L. Myrick Produce,

178hereinafter Myrick Produce, filed an Amended Claim before the

187Florida Department of Agriculture and Consumer Services,

194hereinafter Department, against Sun-Rich America, Inc., d/b/a

201Royal Palm Produce, hereinafter Royal Palm Produce, for

209indebtedness due to the failure of Royal Palm Produce to pay

220Myrick Produce for agriculture products sold to Royal Palm

229Produce. Royal Palm Produce filed a response admitting that the

239claim by Myrick Produce in the amount of $4,273.15, was valid,

251but that it had made partial payment to Myrick Produce and was

263making periodic payments on the balance; and filed a response

273admitting that the claim by Myrick Produce in the amount of

284$551.00, was valid, but that the indebtedness had been

293satisfied. However, Myrick Produce responded that no payments

301had been received and that the debts remained outstanding. On

311August 14 and 20, 2009, respectively, the Department referred

320these matters to the Division of Administrative Hearings.

328At hearing, Myrick Produce presented the testimony of one

337witness and entered one composite exhibit (Petitioner's

344Composite Exhibit numbered 1) into evidence. No one

352representing Royal Palm Produce appeared, no witnesses

359testified, and no exhibits were entered into evidence.

367No transcript of the final hearing was ordered. Myrick

376Produce chose not to file a post-hearing submission.

384FINDINGS OF FACT

3871. No dispute exists that, at all times material hereto,

397Myrick Produce was a producer of agriculture products.

4052. No dispute exists that, at all times material hereto,

415Royal Palm Produce was a dealer in agriculture products.

4243. No dispute exists that, at all times material hereto,

434Royal Palm Produce purchased agriculture products from Myrick

442Produce.

4434. Edward L. Myrick testified on behalf of Myrick Produce.

453He is the sole owner of Myrick Produce.

4615. No one testified on behalf of Royal Palm Produce.

4746. Myrick Produce had an invoice and a corresponding

483signed bill of lading for each order of Florida produce that was

495sold to Royal Palm Produce by Myrick Produce. Each invoice

505provides, among other things, payment terms of 21 days.

5147. The bill of lading for each order indicates, among

524other things, that the produce was received in good condition

534and that the quantity was verified.

5408. Invoice No. 124814 dated January 15, 2009, reflects,

549among other things, 60 cartons of choice eggplant at a cost of

561$381.00. Choice eggplant was at a cost of $6.35 per carton.

5729. Invoice No. 124994 dated January 21, 2009, reflects,

581among other things, 60 cartons of choice eggplant at a cost of

593$381.00.

59410. Invoice No. 125139 dated January 27, 2009, reflects,

603among other things, 27 cartons of choice eggplant at a cost of

615$171.45.

61611. Invoice No. 125263 dated January 30, 2009, reflects,

625among other things, 60 cartons of choice eggplant at a cost of

637$381.00.

63812. Invoice No. 125383 dated February 3, 2009, reflects,

647among other things, 60 cartons of choice eggplant at a cost of

659$501.00. Choice eggplant increased from $6.35 per carton to

668$8.35 per carton.

67113. Invoice No. 125618 dated February 10, 2009, reflects,

680among other things, 60 cartons of choice eggplant at a cost of

692$501.00.

69314. Invoice No. 126132 reflects, among other things, 60

702cartons of choice eggplant at a cost of $441.00. Choice

712eggplant decreased from $8.35 per carton to $7.35 per carton.

72215. As to the date of the Invoice No. 126132, the invoice

734only reflects the month of February; however, the corresponding

743Bill of Lading reflects the same invoice number, the same

753agriculture produce, and the date of February 19, 2009.

762Consequently, an inference is drawn and a finding of fact is

773made that the date of the invoice is February 19, 2009.

78416. Invoice No. 126570 dated March 3, without a year,

794reflects, among other things, two cartons of long hot pepper at

805a cost of $48.70. Long hot pepper was $24.35 per carton.

81617. As to the date of Invoice No. 126570, the

826corresponding Bill of Lading reflects the same invoice number,

835the same agriculture produce, and a date of March 3, 2009.

846Consequently, an inference is drawn and a finding of fact is

857made that the date of the invoice is March 3, 2009.

86818. Invoice No. 128289 reflects, among other things, 60

877cartons of choice eggplant at a cost of $501.00. Choice

887eggplant increased from $7.35 per carton to $8.35 per carton.

89719. The corresponding Bill of Lading reflects a signature

906bill of lading reflects a signature as the “Shipper.”

915Furthermore, the answer by Royal Palm Produce indicates that the

925claim by Myrick Produce is admitted and valid. Consequently, an

935inference is drawn and a finding of fact is made that the

947signature as the “Shipper” was a mistake and that the signature

958is the “Carrier.”

96120. Invoice No. 128378 reflects, among other things, 50

970cartons of large cucumber at a cost of $267.50; 50 cartons of

982select cucumber at a cost of $317.50; and 60 cartons of choice

994eggplant at a cost of $381.00. Large cucumber was at a cost of

1007$5.35 per carton. Select cucumber was at a cost of $6.35 per

1019carton. Choice eggplant decreased from $7.35 per carton to

1028$6.35 per carton.

103121. Myrick Produce’s total claimed indebtedness for

1038agriculture produce is $4,273.15.

104322. Royal Palm Produce admits that Myrick Produce’s claim

1052is valid. 1

105523. However, Royal Palm Produce asserts that it has

1064partially satisfied and is making payments toward the

1072indebtedness. 2 No evidence was presented to support this

1081assertion.

108224. Royal Palm Produce has not satisfied any amount of the

1093debt owed. Further, Royal Palm Produce is not making any

1103payments on the debt owed.

110825. Royal Palm Produce is indebted to Myrick Produce in

1118the total amount of $4,273.15.

112426. Additionally, Myrick Produce is claiming $50.00 for

1132filing the Amended Claim with the Department.

113927. No appearance was made by the casualty company,

1148Capitol Insurance Companies.

115428. Myrick Produce is not pursuing any claim against Royal

1164Palm Produce in this case.

1169CONCLUSIONS OF LAW

117229. The Division of Administrative Hearings has

1179jurisdiction over the subject matter of this proceeding and the

1189parties thereto, pursuant to Sections 120.569 and 604.21,

1197Florida Statutes (2009), and Subsection 120.57(1), Florida

1204Statutes (2009).

120630. Dealers of agricultural products are licensed by the

1215Department. § 604.17, Fla. Stat. (2008). Dealers must post a

1225bond or other security as a precondition to licensure, ensuring

1235payment to producers for all agricultural products purchased.

1243§§ 604.19 and 604.20, Fla. Stat. (2008).

125031. These proceedings are de novo . § 120.57(1)(k), Fla.

1260Stat. (2009).

126232. The standard of proof is preponderance of the

1271evidence. § 120.57(1)(j), Fla. Stat. (2009).

127733. The general rule is that "the burden of proof, apart

1288from statute, is on the party asserting the affirmative of an

1299issue before an administrative tribunal." Florida Department of

1307Transportation v. J. W. C. Company, Inc. , 396 So. 2d 778, 788

1319(Fla. 1st DCA 1981). The burden of proof is upon Myrick Produce

1331to show by a preponderance of the evidence that it is entitled

1343to the relief sought.

134734. Myrick Produce has met its burden. The evidence

1356demonstrates that Royal Palm Produce is indebted to Myrick

1365Produce in the total amount of $4,273.15 for agriculture produce

1376and that Royal Palm Produce has not satisfied any of the debt.

138835. Hence, Royal Palm Produce is obligated to pay the

1398total indebtedness to Myrick Produce.

1403RECOMMENDATION

1404Based on the foregoing Findings of Fact and Conclusions of

1414Law, it is

1417RECOMMENDED that the Florida Department of Agriculture and

1425Consumer Services enter a final order in Case No. 09-4306

1435finding that Sun-Rich America, Inc., d/b/a Royal Palm Produce is

1445indebted to Edward L. Myrick, d/b/a Edward L. Myrick Produce in

1456the amount of $4,273.15 and ordering the payment of same, plus a

1469filing fee of $50.00 for filing the Amended Claim; and in Case

1481No. 09-4606 dismissing the Amended Claim.
