194PRELIMINARY STATEMENT
196On October 28, 2009, Leigha Myers and Cur tis Myers, as
207parents and natural guardians of Jaden Myers (Jaden), a minor,
217filed a petition (claim) with the Division of Administrative
226Hearings (DOAH) entitled "Petition for Determination of
233Compensability Pursuant to Florida Statutes Section 766.301 et
241seq." The petition sought a determination of whether Jaden's
250injuries are qualifying injuries under the Florida Birth - Related
260Neurological Injury Compensation Association (NICA) plan.
266DOAH served NICA with a copy of the claim on October 29,
2782009; served Mitzi Brock, M.D., on November 2, 2009; and served
289Baptist Medical Center on November 2, 2009.
296On February 9, 2010, NICA filed its response to the
306petition and gave notice that it was of the view that Jaden did
319not suffer a "birth - related neurological inju ry," as defined by
331s ection 766.302(2), Florida Statutes, and requested that a
340hearing be scheduled to resolve whether the claim was
349compensable. By Order entered August 5, 2010, Southern Baptist
358Hospital, Inc., d/b/a Baptist Medical Center was granted lea ve
368to intervene.
370Thereafter, the parties pursued discovery, and the case was
379twice scheduled for hearing and continued upon agreement of the
389parties.
390An Order entered June 1, 2011, granted the parties' Joint
400Motion to Submit Stipulated Factual Record and W ritten Argument
410in Lieu of a Contested Hearing . On August 5, 2011, a Joint
423Prehearing Stipulation was filed. On August 8, 2011, a
432Stipulated Record was transmitted to DOAH. On August 17, 2011,
442an Amended Stipulated Record (a supplement by agreement of t he
453parties) was transmitted to DOAH. 1/ Upon motion, and by Order
464entered August 18, 2011, the parties were accorded until
473August 26, 2011, to file their proposed final orders.
482Only Respondent NICA filed a proposal , and that proposed
491final order has been c onsidered.
497FINDINGS OF FACT
5001. Leigha Myers and Curtis Myers are the natural parents
510and guardians of Jaden Myers, a minor. Jaden was born a live
522infant on November 13, 2008, at Southern Baptist Hospital of
532Florida, Inc., d/b/a Baptist Medical Center he reafter, Baptist
541Medical Center , a licensed hospital located in Jacksonville,
549Florida, and his birth weight was in excess of 2,500 grams.
5612. The physician providing obstetrical services at the
569time of Jaden's birth was Mitzi Brock, M.D. Dr. Brock was, at
581all times material, a participating physician in the Florida
590Birth - Related Neurological Injury Compensation Plan.
5973. Notice is not a contested issue in this case.
6074. Mrs. Myers ' prenatal course was complicated by
616pregnancy - induced hypertension. She was admitted to Baptist
625Medical Center on November 13, 2008, at 40 weeks' gestation, for
636induction of labor.
6395. Mrs. Myer s was admitted at 7:24 a.m., on November 13,
651200 8 . Oxytocin (Pitocin) IV was started at 7:44 a.m. At
6638:47 a.m., Mrs. Myers ' membranes were artificially ruptured by
673Dr. Brock , and clear fluid was noted. A vaginal exam was
684performed at 8:49 a.m., with findings indicat ing Mrs. Myers was
6953 - 4 cm dilated; 60% effaced and at a - 2 station. Fetal movement
710was reported and audible.
7146. The same day, b etween 8:57 a.m., and 11:13 a.m., the
726Pitocin dosage was increased from 6 mu/min to 14 mu/min. At
737about 11:57 a.m., the infant had an episode of bradycardia. 2/ An
749epidural bolus was administered at 12:07 p.m. (Noon).
7577. A vaginal exam was perfor med at 12:17 p.m., with
768findings indicating that Mrs. Myers was 4 cm dilated; 80%
778effaced and at a - 2 station. At 1:36 p.m., an oxygen face mask
792was started as a fetal intervention. Mrs. Myers ' labor
802continued to progress , and a vaginal exam at 2:26 p.m. ,
812indicated she was 4 - 5 cm dilated; 90% effaced and at a
825station - 2.
8288. A vaginal exam was performed at 3:15 p.m., indicating
838that Mrs. Myers was 7 cm dilated; 90% effaced and at a - 2
852station. At this time, Dr. Brock also reviewed the fetal
862monitor st rips. At 4:17 p.m., a Foley catheter was placed in
874preparation for a cesarean section. Another vaginal exam was
883performed at 5:2 4 p.m., indicating the mother was 7 - 8 cm
896dilated; 90% effaced and at a - 2 station.
9059. Dr. Brock was at Mrs. Myers ' bedside an d performed
917another vaginal exam at 7:09 p.m. This examination indicated
926Mrs. Myers was 9 - 10 cm dilated and 100% effaced. At 7:29 p.m.,
940Dr. Brock indicated that she would try to rotate the infant.
951Mrs. Myers began to push, starting at 7:30 p.m., and con tinued
963pushing with contractions until 8:30 p.m.
96910. The fetal monitor strips reveal that the infant
978experienced an episode of tachycardia 3/ between 7:50 p.m. and
9887:53 p.m.
99011. While Mrs. Myer s was pushing between 7:30 p.m., and
10018:30 p.m., the Kiwi vac uum extractor was positioned and there
1012were four pop - offs at 8:01 p.m., 8:04 p.m., 8:10 p.m., and
10258:21 p.m.
102712. At 8:31 p.m., the baby's head was out. Supra pubic
1038pressure and the McRoberts maneuver were used, resulting in
1047delivery of Jaden Myers at 8:32 p.m. Delivery complications
1056included shoulder dystocia suprapubic pressure, McRoberts
1062maneuver and possible right clavicle fracture with limp right
1071arm. Jaden's Apgar 4/ scores were 1 at 1 minute; 3 at 5 minutes;
1085and 6 at 10 minutes. There was evidence of acidosis.
109513. At 8:33 p.m., Jaden was bagged and masked. He was
1106transferred to NICU with oxygen bagging and masking in progress
1116at 8:41 p.m. He was admitted to NICU at 8:42 p.m., for neonatal
1129depression and was noted to be cyanotic, depressed, floppy and
1139flaccid in minimal respiratory distress. A subgaleal hemorrhage
1147was present, as was a denuded scalp lesion and vacuum mark.
1158Jaden had generalized decreased tone and activity. Delivery
1166complications included shoulder dystocia and deep variable
1173decel erations. At two minutes of age, Jaden was very pale,
1184receiving oxygen with bag mask with chest compressions at 45
1194seconds of age for initial heart rate of 40. Color improved
1205slightly , and his heart rate increased to 100. By five minutes
1216of age, Jaden h ad been intubated.
122314. At 1 0:40 p.m., Jaden was approximately two hours old.
1234At that time, he was assessed as having a head circumference of
124636 cm . H is scalp abrasions were covered with tegaderm , and Cool
1259Cap equipment was applied per protocol. At 11 :00 p.m., Jaden
1270had bicycling - like movements of his arms and legs, which did not
1283stop with touch. At 11:30 p.m., he was noted to have mild,
1295intermittent grunting. At 11:52 p.m., Phenobarbital was
1302administered for continuous movement of his arms and legs.
1311Jaden continued with bicycling movements of his arms and legs at
132212:45 a.m., on November 14, 2008, and at 1:10 a.m., another dose
1334of Phenobarbital was administered. The medical record reflects
1342that there were no further bicycl ing movements after the sec ond
1354dose of Phenobarbital.
135715. Jaden remained on the Cool Cap until November 17,
13672008, when it was removed at 6:00 a.m., and he was rewarmed.
1379Scalp abrasions and weeping were noted. A CT scan performed on
1390November 17, 2008, at 12:44 p.m., identified ext ensive
1399cephalohematoma; trace amounts of hyperdense hemorrhage beneath
1406the left coronal suture; hyperdensity of the tentorium , which
1415could represent a trace amount of subdural hematoma;
1423obliteration of both external auditory canals, secondary to soft
1432tissu e swelling/hemorrhage with fluid in both ears.
144016. According to the NICU Discharge Summary, Jaden's
1448hospital course from November 13, 2008, through November 26,
14572008, was complicated by respiratory distress, metabolic
1464acidosis, hypoperfusion , disseminat ed intravascular coagulation,
1470thrombocytopenia, seizures, jaundice surveillance, renal
1475dysfunction, hyperglycemia, and hypocalcemia , all of which
1482subsequently resolved themselves prior to discharge. Upon
1489Jaden's discharge, diagnoses included anemia, neona tal
1496depression, subgaleal hemorrhage and fracture of the clavicle.
150417. Nonetheless, d espite w hat on its face appears to be a
1517difficult delivery, Jaden's development has continued to improve
1525as he has grown. Jaden has been followed by Dr. Rodolfo Pena -
1538Ariet, a pediatrician with Northeast Florida Pediatric
1545Association, P.A., from November 29, 2008, to the present.
155418. Jaden has been treated for normal childhood illnesses
1563and has met all of his development al milestones.
157219. On January 4, 2009, David O . Childers , M.D. ,
1582University of Florida, Department of Pediatrics, Division of
1590Developmental Pediatrics, gave Jaden a newborn neurobiologic
1597risk score of " three, " whereby a score of greater than " six "
1608indicated the child was at risk. Jaden scored a "one" or
"1619normal" for sensory and behavioral response, axial tone,
1627extremity tone, deep tendon reflexes and primitive reflexes for
1636an overall combined score of " five. " A core of "five to eight"
1648indicates low risk. However, Dr. Childers diagnosed Jaden with
1657tor ticollis, 5 / recommended physical therapy and made a referral
1668to the Early Intervention Program for evaluation.
167520. A referral was made on January 26, 2009, to "Early
1686Steps" for a development al evaluation. "Early Steps" is
1695Children's Medical Services ' Ear ly Intervention Program provided
1704by the Department of Pediatrics of the University of Florida ,
1714and sponsored by the Florida Department of Health. In addition ,
1724on March 19, 2009, Jaden's well - child visit at four months of
1737age indicated that he was doing we ll, being seen by
1748Dr. Childers, Early Steps , and Brooks Rehabilitation and that
1757his only problem was torticollis. According to his chart,
1766subsequent well - child visits with Dr. Pena - Ariet did not
1778identify any concerns for Jaden's growth and development.
178621 . On February 12, 2009, Mr. and Mrs. Myers had concerns
1798regarding Jaden's motor development , and regarding the diagnosis
1806of torticollis , as well as concerns regarding his overall
1815development as might be observed by clinicians. During the
1824evaluation, Jade n was holding his head turned to the left, or
1836when his head was midline, it was flexed to his right shoulder.
1848His thumbs tended to be flexed into his palms. Jaden was
1859referred to Brooks Rehabilitation to work at being able to turn
1870his head in all directi ons when on his tummy , when on his back ,
1884or when he was held so that he could explore and interact with
1897toys and people in his everyday activities. The goal for
1907achieving these improvements was set variously at May 2009 and
1917August 2009 .
19202 2 . Jaden recei ved physical therapy at Brooks
1930Rehabilitation, a provider of physical therapy, from March 12,
19392009, until May 21, 2009 , for torticollis affecting his right
1949side. Jaden's evaluation on March 12, 2009 , found that he kept
1960his head rotated to the left side on "pull to sit" (head lag),
1973but that he was able to keep his head in line with his trunk
1987with no head lag. His head's range of motion in supine position
1999was limited to right rotation when turning his head to track
2010objects. Jaden also kept his head rotated to the left side when
2022holding his head midline with supported sitting. However,
2030p hysical therapist Shawn T. Hubbard noted in the Discharge
2040Summary dated May 27, 2009, that Jaden and his caregiver (mom)
2051had attended all sessions; that Ja d e n had shown an i mprovement
2065with his cervical range of motion, both actively and passively;
2075that he was able to sit supported for short periods of time with
2088good head control; and that he had completed his treatment
2098program. There have been no subsequent physical therapy
2106sessions .
21082 3 . In his Follow - Up Neurodevelopment Assessment, dated
2119May 4, 2009, Dr. Childers indicated that at 5.75 months of age ,
2131Jaden was saying one word other than "mama" and "dada" ; was able
2143to support himself on his forearms in prone position and s upport
2155himself on his wrists in prone position ; and that Jaden had full
2167range of motion with his extremities. Also, Jaden's muscle
2176bulk, power and tone were age appropriate. His fine motor
2186skills, including grasp and release, finger opposition and
2194finger - to - nose skills were normal. Jaden's gross motor skills,
2206including gait and tandem gait were normal. " Sit - to - stand " was
2219normal . H is unipedal stand and single leg hop was normal .
2232Follow - up was recommended in one year.
22402 4 . On August 10, 2009, Ellen Hop kins of the Northeastern
2253Early Steps Program indicated on the Individualized Family
2261Support Plan Periodic Review that Jaden had successfully reached
2270his outcome by being able to turn his head in all directions and
2283was now very mobile, crawling and pulling - up without any
2294difficulty. Jaden was subsequently released from physical
2301therapy because he had reached his goals. On February 12, 2010,
2312Jaden's file at Early Steps was placed on inactive status.
23222 5 . On November 2, 2010, at age 23 months and 13 days,
2336Ja den was again assessed by Dr. Childers, using the Bayley
2347Scales of Infant and Toddler Development, Third Edition. Upon
2356cognitive testing, Jaden could discriminate between objects;
2363regard an object continuously for five seconds; show visual
2372preference; hab ituate to an object within 30 seconds; prefer to
2383look longer at a novel object; habituate to picture and prefer a
2395novel picture; take blocks out of a cup; engage in relational
2406play to self and others; had visual displacement; could attend
2416to a whole story; had pegboard series testing; object assembly;
2426picture matching; representational and imaginative play;
2432understand the concept of one; and engage in multi - scheme
2443combination play.
24452 6 . Dr. Childers' testing further indicated that Jaden's
2455receptive language abilities included interaction with others;
2462that he could identify pictures and three items of clothing;
2472identify action pictures and five body parts; follow two - part
2483directions; understand the use of objects; and understand
2491pronouns. Regarding expressiv e language, Jaden was able to use
2501two words appropriately, use at least one word to make his wants
2513known; combine a word or gesture; name pictures; use eight words
2524appropriately; answer "yes" and "no" in response to questions;
2533imitate a two - word utterance; make a two - word and multiple word
2547utterance; and use pronouns.
25512 7 . Jaden's fine motor skills at that time of testing with
2564Dr. Childers included: stacking a series of blocks; imitating
2573strokes with a crayon, horizontally and vertically; placing ten
2582pelle ts in a bottle within 60 seconds; transitional grasp with
2593crayon or pencil; placing three coins in a slot; taking blocks
2604apart; using his hand to hold paper in place while scribbling ;
2615and connecting a series of blocks. His gross motor skills
2625included the ability to: throw a small ball forward; squat
2635without support; stand up without support; walk up and down
2645stairs; walk backward and forward; run with good coordination;
2654balance on one foot, right and left; walk sideways; jump from
2665bottom step and kick a l arge ball.
26732 8 . Respondent offered, via deposition, the findings and
2683expert opinion of Dr. Michael S. Duchowny, a board - certified
2694pediatric neurologist, who reviewed and analyzed Jaden's medical
2702records and who had personally performed an independent medic al
2712examination of Ja d e n on February 3, 2010, when Jaden was
2725fourteen months old.
27282 9 . Dr. Duchowny did not believe that Jaden had any
2740permanent and substantial mental or physical impairments as of
2749the age of fourteen months. He further testified that at t he
2761time of his evaluation, Jaden's parents indicated that he had
2771met his age - appropriate developmental milestones. Based on
2780Dr. Duchowny's evaluation and review of the records, the
2789acidosis and any oxygen deprivation that Jaden may have
2798experienced during the birthing process has not had any
2807permanent or substantial impact on him.
281330 . These expert opinions are demonstrated by t he
2823following excerpts from Dr. Duchowny's deposition of August 4,
28322011:
2833A . [Dr. Duchowny] . . .
2840The neurologic examination
2843r evealed him [Jaden] to be an
2850alert, cooperative and socially
2854interactive boy. He was curious,
2859he was easily engaged. In fact,
2865he sat quietly in his father's lap
2872and he did make sounds, but I did
2880not hear him speak words. There
2886was a slight amount of dro oling,
2893very small. His cranial nerve
2898examination was essentially
2901normal, as detailed in the report.
2907Similarly, the motor examination
2911revealed full strength. Muscle
2915bulk and tone was also normal.
2921There were no abnormal movements,
2926no weakness. He actual ly walked
2932fairly steadily for his age, he
2938didn't fall, and he climbed well.
2944He had age - appropriate manual
2950dexterity with both hands. He had
2956good fine motor movements and
2961thumb/finger opposition. He could
2965transfer an object between his
2970hands and did not show a hand
2977preference. That was all normal.
2982His sensory examination was also
2987normal. There were no
2991abnormalities of his neurovascular
2995examination and, essentially, my
2999impression of these findings was
3004that his neurological examination
3008was normal for dev elopmental age.
3014Q. All right. And would you describe his
3022physical examination as normal as well?
3028A. Yes, sir. In fact, both the physical
3036and neurological examinations were
3040absolutely fine.
3042Q. Would you consider your findings
3048consistent with what yo u read in the
3056deposition transcripts from the parents as
3062to how they described Jaden's growth and
3069development and how he was performing at the
3077time of those depositions?
3081A. I would, yes.
3085Q. In other words, your findings are
3092consistent with their own pe rspective as to
3100how Jaden was doing and what, if any, issues
3109he may be experiencing?
3113A. Yes, sir.
3116Q. Based on your review and examination of
3124Jaden, did you form an opinion as to whether
3133or not he suffered from any permanent and
3141substantial mental impai rment?
3145A. In my opinion, he had neither a
3153substantial mental nor substantial motor
3158impairment.
3159Q. Based on your examination, did you form
3167an opinion as to whether or not he would
3176qualify for coverage under the NICA program?
3183A. Based on my understandi ng of the NICA
3192program requirements -- and that is that in
3200order to be eligible a child should suffer
3208from a permanent mental -- a permanent and
3216substantial mental and physical impairment.
3221I felt that Jaden did not qualify for
3229eligibility into the NICA progra m.

3253Q. . . . At the end of your report -- and I
3266think it may have been attached as an
3274exhibit now to the deposition -- of
3281February 3, 2010, you write his, meaning
3288Jaden, "his neurological examination today
3293is entirely normal." Entirely normal for a
3300fourteen - month old?
3304A. Yes, sir.
3307Q. Is that what you meant?
3313A. Yes, sir.
3316Q. And so you were asked by Mr. Bajalia
3325what your conclusion was and you said that
3333he had neither a substantial mental or mot or
3342impairment. At the time you examined him,
3349did Jaden have any mental impairment that
3356you could identify ?
3359A. No, sir.
3362Q. Did he have any physical impairment that
3370you could identify?
3373A. No.
3375* * *
3378Q. Okay. Now in your initial discussion of
3386your February 3, 2010 report, you talked
3393about the medical history that was obtained
3400from the parents. You talked about his
3407growth and developmental parameters and the
3413fact, from the parents' perspective, they
3419were all normal.
3422Do you recall that?
3426A. Ye s. ( Exhibit N : Depo. pages 28 - 29 ;
3438Bates 1587 - 1588 ) (emphasis added).
344531 . Leigha Myers' deposition testimony further shows that ,
3454despite Jaden's initial hospital course , he has shown no
3463physical or mental impairments , but rather , has grown up as any
3474oth er child. Specifically, Mrs. Myers testified on May 18,
34842011, as follows:
3487Q. . . . Tell me as his parent generally
3497how -- how he is doing now.
3504A. He seems to be doing what every other
3513kid does that I know of.
3519Q. When you say he seems to be doing what
3529e very other kid is doing that you know of,
3539it is your opinion that he appears to be
3548normal from a physical standpoint?
3553A. Yes.
3555Q. Does he appear to be normal from a
3564mental perspective?
3566A. Yes.
3568Q. Or cognitively?
3571A. Yeah.
3573Q. . . . From a physic al perspective, what,
3583if any, issues does he have?
3589A. He doesn't have any that I know of right
3599now.
3600Q. . . . And from a mental perspective, or
3610cognitive perspective, what, if any, issues
3616does he have?
3619A. None that I know of --
3626Q. Okay.
3628A. -- at thi s time.
3634Q. As his parents -- as his parent, are there
3644any concerns from your perspective from a
3651developmental perspective as far as Jaden is
3658concerned?
3659A. No, no. (Exhibit M: Depo. pages 8 - 9 ;
3669Bates 1533 - 1535)
36733 2 . Jaden's mother also denied that there were any chronic
3685physical developmental issues for which Dr. Pena - Ariet is
3695currently treating Jaden; that there is any ongoing physical
3704therapy for Jaden; and that Jaden was ever below the standard
3715child development curve for growth and development. She also
3724acknowledged that on formal testing "of everything" (presumably
3732cognitive and physical abilities) Jaden scored " average or
3740better. "
3741Q. Has Jaden had any formal testing done to
3750assess his cognitive level or abilities?
3756* * *
3759A. [Mrs. Myers] Yes, I think it was kind of
3769everything. He had, like, a book he had to
3778go through, to do all these little tests an d
3788stuff, but he -- he scored average on it --
3798Q. Okay.
3800A. -- like average or better.
3806Q. Were there any issues or concerns that
3814were relayed to yo u about his development as
3823a result of that testing?
3828A. No. ( Exhibit M: Depo pages 28 - 29 ;
3838Bates 1553 - 1534)
38423 3 . Leigha Myers further testified that Jaden had physical
3853therapy to resolve an issue with torticollis after he was born
3864but that he has not r equired speech therapy, occupational
3874therapy or any additional therapies. Jaden has also never seen
3884a neurologist. She does not believe Jaden will need physical or
3895occupational therapy in the future.
39003 4 . According to Curtis Myers, Jaden's father , who al so
3912testified via a May 18, 2011, deposition, Jaden is physically
3922active playing horseshoes and basketball and appears to have met
3932his developmental milestones, as follows:
3937* * *
3940Q. . . . And you know, from a physical
3950perspective, when you guys play out side, he
3958doesn't appear to have any issues running?
3965A. [Curtis Myers] No.
3969Q. Or jumping?
3972A. No.
3974Q. Or picking up objects like a horseshoe?
3982A. No.
3984Q. And throwing it?
3988A. No.
3990* * *
3993A. Right. I think as far as physically, he
4002seems to be f ine. (Exhibit L: depo pages
401110 - 12 ; Bates 1513 - 1515)
4018* * *
4021Q. And while you don't remember the exact
4029timing or dates as to when he met those
4038milestones, to your knowledge, did he meet
4045his milestones and develop normally?
4050A. Yes. He -- you know, it's funny, because,
4059I mean, he had someone to compare it to with
4069his little friend Isaac being two years old

4156delivery, given the record, it is resolved that Jaden does not
4167suffer from permanent or substantial mental or physical
4175impairments.
4176CONCLUSIONS OF LAW
417936 . The Division of Administrative Hearings has
4187jurisdiction over the parties to, and the subject matter of,
4197these proceedings. §§ 766.301 - 766.316, Fla. Stat.
420537 . T he Florida Birth - Related Neurological Injury
4215Compensation Plan was established by the Legislature "for the
4224purpose of providing compensation, irrespective of fault, for
4232birth - related neurological injury claims" relating to births
4241occurring after January 1, 1989. § 766.303(1), Fla. Stat.
425038 . The injured infant, her or his personal
4259representative, parents, dependents, and next of kin, may seek
4268compensation under the plan by filing a claim for compensation
4278with the Divisi on of Administrative Hearings. §§ 766.302(3),
4287766.303(2), and 766.305(1), Fla. Stat. The Florida Birth -
4296Related Neurological Injury Compensation Association, which
4302administers the Plan, has "45 days from the date of service of a
4315complete claim . . . in wh ich to file a response to the petition
4330and submit relevant written information relating to the issue of
4340whether the injury is a birth - related neurological injury."
4350§ 766.305(4), Fla. Stat.
435439 . If NICA determines that the injury alleged in a claim
4366is a co mpensable birth - related neurological injury, it may award
4378compensation to the claimant, provided that the award is
4387approved by the Administrative Law Judge to whom the claim has
4398been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
4409NICA disputes the claim, as it has in the instant case, the
4421dispute must be resolved by the assigned Administrative Law
4430Judge in accordance with the provisions of chapter 120, Florida
4440Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
444840 . In discharging this resp onsibility, the Administrative
4457Law Judge must make the following determination based upon
4466available evidence:
4468(a) Whether the injury claimed is a
4475birth - related neurological injury. If the
4482claimant has demonstrated, to the
4487satisfaction of the administrat ive law
4493judge, that the infant has sustained a brain
4501or spinal cord injury caused by oxygen
4508deprivation or mechanical injury and that
4514the infant was thereby rendered permanently
4520and substantially mentally and physically
4525impaired, a rebuttable presumption s hall
4531arise that the injury is a birth - related
4540neurological injury as defined in s.
4546766.303(2).
4547(b) Whether obstetrical services were
4552delivered by a participating physician in
4558the course of labor, delivery, or
4564resuscitation in the immediate postdelivery
4569period in a hospital; or by a certified
4577nurse midwife in a teaching hospital
4583supervised by a participating physician in
4589the course of labor, delivery, or
4595resuscitation in the immediate postdelivery
4600period in a hospital.
4604§ 766.309(1), Fla. Stat. An award may be sustained only if the
4616Administrative Law Judge concludes that the "infant has
4624sustained a birth - related neurological injury and that
4633obstetrical services were delivered by a participating physician
4641at birth." § 766.31(1), Fla. Stat.
464741 . Pertinent to this case "birth - related neurological
4657injury" is defined by section 766.302(2), to mean:
4665injury to the brain or spinal cord of a live
4675infant weighing at least 2,500 grams for a
4684single gestation or, in the case of a
4692multiple gestation, a live infant we ighing
4699at least 2,000 grams at birth caused by
4708oxygen deprivation or mechanical injury
4713occurring in the course of labor, delivery,
4720or resuscitation in the immediate
4725postdelivery period in a hospital, which
4731renders an infant permanently and
4736substantially me ntally and physically
4741impaired . This definition shall apply to
4748live births only and shall not include
4755disability or death caused by genetic or
4762congenital abnormality. (emphasis added).
476642 . As the proponent of the issue, the burden rested on
4778Petitioner s to demonstrate that Ja d ed suffered a "birth - related
4791neurological injury." § 766.309(1)(a), Fla. Stat. See also
4799Balino v. Dep't of Health and Rehab. Servs. , 348 So. 2d 349, 350
4812(Fla. 1st DCA 1997)("[T]he burden of proof, apart from statute,
4823is on the part y asserting the affirmative of an issue before an
4836administrative tribunal." ).
483943 . More specifically, it has been held in Florida Birth -
4851Related Neurological Injury Compensation Ass'n v. Division of
4859Administrative Hearings , 686 So. 2d 1349, 1356 (Fla. 199 7) that,
4870the plan "is written in the conjunctive and can only be
4881interpreted to require permanent and substantial impairment that
4889has both physical and mental elements." See also Masterton v.
4899Fla. Bir t h - Related Neurological Injury Comp. Ass'n , Case 08 -
4912603 2N (Fla. DOAH Jan. 29, 2010)(Corrected Final Order).
492144 . Here, the proof failed to support the conclusion that,
4932more likely than not, Jaden has any permanent and substantial
4942mental or physical impairments irrespective of the timing or
4951cause of any such im pairment. Consequently, given the
4960provisions of section 766.302(2), Jaden does not qualify for
4969coverage under the Plan. See also §§ 766.309(1) and 766.31(1),
4979Fla. Stat.; Humana of Florida, Inc. v. McKaughan , 652 So. 2d
4990852, 859 (Fla. 5th DCA 1995)("[B]ec ause the Plan . . . is a
5005statutory substitute for common law rights and liabilities, it
5014should be strictly constructed to include only those subjects
5023clearly embraced within its terms."), approved , Florida Birth -
5033Related Neurological Injury Compensation Ass ociation v.
5040McKaughan , 668 So. 2d 974, 979 (Fla. 1996).
5048CONCLUSION
5049Based upon the foregoing Findings of Fact and Conclusions
5058of Law, it is ORDERED:
5063The claim for compensation filed by Leigha Myers and Curtis
5073Myers, as parents and natural guardians of Ja d ed Myers , a minor ,
5086is dismissed with prejudice.
