121STATEMENT OF THE ISSUES

125The issues are: (1) whether Petitioner passed the Practical

134Examination for Firefighter Retention test; and (2) whether

142Petitioner's application for firefighter recertification was

148properly denied.

150PRELIMINARY STATEMENT

152On or about September 25, 2009, Respondent, Department of

161Financial Services ("Department"), Division of State Fire

170Marshal ("Division"), notified Petitioner, Antron Rondell Pope

179("Petitioner"), that he did not pass the Practical Examination

190for Firefighter Retention ("Retention Examination") re-test.

198The notice also advised Petitioner that because he did not pass

209the Retention Examination re-test, his Firefighter Certificate

216of compliance No.117349 expired on September 24, 2009.

224Petitioner challenged the scoring on certain parts of the

233Retention Examination re-test and requested a formal

240administrative hearing. The Division referred the matter to the

249Division of Administrative Hearings on November 2, 2009, for

258assignment of an Administrative Law Judge to conduct the

267hearing. On February 3, 2010, the Division stipulated that the

277re-test results for Petitioner contained a computer error and

286Petitioner had worn and activated his Self Contained Breathing

295Apparatus ("SCBA") pass device.

301At hearing, Petitioner testified on his own behalf.

309Petitioner's Exhibit A was received into evidence. The Division

318presented the testimony of Henry Sheffield and Dennis Hackett.

327The Division's Exhibits A through D were received into evidence.

337At the request of the Division, the undersigned took

346official recognition of Florida Administrative Code Rules 69A-

35437.0527 and 69A-37.056.

357The proceedings were transcribed and the transcript of the

366final hearing was filed with the Division of Administrative

375Hearings on March 1, 2010. Respondent timely filed a Proposed

385Recommended Order, which has been considered in the preparation

394of this Recommended Order. Petitioner did not file a Proposed

404Recommended Order.

406All citations are to Florida Statutes (2009) unless

414otherwise indicated.

416FINDINGS OF FACT

4191. Petitioner completed his minimum standards training and

427took the standardized state test in 2004 and Respondent issued

437him a Firefighter Certificate that year.

4432. Florida law requires Petitioner to be employed by a

453fire agency within a three year period after passing the state

464examination to keep his minimum standards credentials active.

4723. Petitioner is a full-time employee at American Medical

481Response. Because Petitioner has not been active as a

490firefighter during the past three years, Petitioner made

498application to the Department to take the Retention Examination.

507The practical portion consists of four sections or "evolutions"

516including the SCBA, 1 the hose pull, the ladder operation, and the

528fire ground skills section.

5324. To pass the four practical evolutions, an applicant

541must achieve a score of at least 70 percent on each component.

5535. Each evolution of the practical exam has certain

562elements or skills that are graded. The SCBA portion of the

573test contains skills related to checking, donning, and properly

582activating the SCBA that enables a firefighter to breathe in a

593hostile environment, such as a burning building.

6006. The SCBA portion of the Retention Examination also has

610an established maximum time allotted for the examinee to

619complete a minimum of 70 percent of the skills. The time

630limitation is a mandatory requirement.

6357. If an examinee completes a minimum of 70 percent of the

647skills in a particular part, but fails to do so within the

659maximum allotted time specified for that part, the examinee has

669not met the mandatory time requirement and, thus, is not awarded

680any points for that part.

6858. Petitioner took the initial Retention Examination in

693May 2009. Petitioner did not pass the SCBA and fire ground

704skills components of the practical portion of the initial exam.

7149. On September 24, 2009, Petitioner took the Retention

723Examination re-test for the SCBA and fire skills components.

732Petitioner passed the fire skills component.

73810. The maximum time allotted for completion of the SCBA

748part of the Retention Examination is two minutes. Petitioner's

757completion time on the September 2009 Retention Examination re-

766test was two minutes and 30 seconds.

77311. Because Petitioner failed to complete a minimum of 70

783percent of skills in the SCBA portion of the Retention

793Examination within the maximum time allotted, the Bureau

801properly awarded him zero points. It is an automatic failure if

812an examinee does not complete the exam in time. Therefore,

822Petitioner did not earn a passing score on the Retention

832Examination re-test.

83412. As a result of Petitioner's failing to pass the

844Retention Examination, his Firefighter Certificate of compliance

851expired.

85213. The Division employs field representatives to

859administer the Retention Examination to examinees in accordance

867with the applicable rules and procedures.

87314. Dennis Hackett is and has been a field representative

883with the Bureau of Fire Standards and Training for six years.

894As a field representative, Mr. Hackett administers and scores

903the minimum standards examination for firefighters, including

910the Retention Examination.

91315. Mr. Hackett has administered well over a thousand SCBA

923tests. Mr. Hackett was the examiner who tested Petitioner on

933the September 24, 2009, for re-test of the SCBA portion of the

945practical exam. Mr. Hackett timed Petitioner at two minutes and

95530 seconds.

95717. Petitioner testified that before taking the retest, he

966practiced the SCBA test and had completed it within the time

977limit.

97818. Petitioner first learned SCBA skills in 2004 at the

988Coral Springs Fire Academy. At the academy, Petitioner took a

998three month, 450-hour course of fundamental firefighter skills.

100619. On or about September 16, 2009, Petitioner took a

1016refresher course in Ocala, Florida. The course was two days and

1027taught the SCBA skills in a manner different from how Petitioner

1038had been taught at Coral Springs Fire Academy.

104620. Petitioner testified that the refresher course wasn't

1054fair because he didn't have enough time to learn the new method.

1066He asserted that the two day course was too short to learn the

1079new method and techniques to compensate for errors.

108721. Petitioner admitted that a minor hiccup slowed him

1096down while taking the re-test on September 24, 2009. Petitioner

1106said, "It's not like I can't do it because I could do it, it's

1120just I went over the time limit. I didn't have ample enough

1132time to learn the new way of doing it or to overcome any minor

1146obstacles."

114722. In a memorandum dated September 25, 2009, the

1156Department formally advised Petitioner that he had failed the

1165SCBA portion of the Minimum Standards Practical Retention

1173Retest. The memorandum also informed Petitioner that, "Because

1181you did not pass the retest, your Firefighter Certificate of

1191compliance #117349, has expired as of 09/24/2009. It will be

1201necessary for you to repeat the firefighter Minimum Recruit

1210Training Program and submit a new application before any

1219additional testing can be allowed."

122423. An individual is allowed to re-take the Retention

1233Examination one time. If the person does not pass the re-test,

1244he must repeat the Firefighter Minimum Recruit Training Program

1253before he is eligible to re-take the Retention Examination. See

1263§ 633.352, Fla. Stat., and Fla. Admin. Code R. 69A-37.0527.

127324. As noted above, Petitioner did not pass the SCBA

1283portion of the Retention Examination re-test. Therefore, before

1291he is eligible to re-take that examination, he must repeat the

1302Firefighter Minimum Recruit Training Program.

130725. Petitioner failed to establish that he was entitled to

1317a passing grade for his performance on the Retention Examination

1327re-test.

132826. The greater weight of the credible evidence

1336established that Petitioner's performance on the Retention

1343Examination re-test was appropriately and fairly graded.

1350CONCLUSIONS OF LAW

135327. The Division of Administrative Hearings has

1360jurisdiction over the subject matter of this proceeding and the

1370parties thereto pursuant to Sections 120.569 and 120.57(1),

1378Florida Statutes.

138028. The Department has jurisdiction over firefighter

1387training and certification in the State of Florida pursuant to

1397Chapter 633, Florida Statutes.

140129. Subsection 633.35(2), Florida Statutes, authorizes the

1408Division to establish firefighting training and to issue

1416certificates of compliance to individuals who meet the

1424prescribed eligibility requirements and provides in relevant

1431part:

1432(2) The [D]ivision shall issue a

1438certificate of compliance to any person

1444. . . who has successfully passed an

1452examination as prescribed by the [D]ivision.

145830. Section 633.352, Florida Statutes, which establishes

1465the process by which a certified firefighter who has not worked

1476as a firefighter for a three-year period may retain his or her

1488certification, provides in pertinent part:

1493Retention of firefighter certification. --

1498Any certified firefighter who has not been

1505active as a firefighter, or as a volunteer

1513firefighter with an organized fire

1518department, for a period of 3 years shall be

1527required to retake the practical portion of

1534the minimum standards state examination

1539specified in rule 4A-37.056(6)(b), Florida

1544Administrative Code, in order to maintain

1550her or his certification as a firefighter;

1557however, this requirement does not apply to

1564state-certified instructors, as determined

1568by the division. The 3-year period begins

1575on the date the certificate of compliance is

1583issued or upon termination of service with

1590an organized fire department.

159431. Pursuant to its rulemaking authority, the Division is

1603authorized to promulgate rules for firefighter training,

1610certification, and re-certification. See § 633.45(2)(a), Fla.

1617Stat.

161832. Florida Administrative Code Rule 69A-37.0527 provides

1625in part:

1627(1) The examination for retention of

1633certificate referenced in Section 633.352,

1638F.S., shall be known as the retention

1645examination. Being active as a volunteer

1651firefighter with an organized fire

1656department means the individual has been

1662actively involved for a continuous period of

1669time of not less than 6 months during the

16783 year period since certified or the

1685certification was last renewed, or since

1691termination from a fire department.

1696Verification of being active shall be

1702evidenced by documentation from the chief or

1709ranking person of the volunteer fire

1715department.

1716* * *

1719(6) Any individual who does not obtain a

1727passing score of 70% or more on the

1735retention examination will be permitted one

1741opportunity to repeat the examination. The

1747examination must be repeated within 6 months

1754of the original examination or the

1760opportunity is forfeited.

1763(7) Failure to pass the examination

1769within the timeframes set forth above will

1776result in the individual’s having to

1782successfully complete Firefighter training

1786as defined in Rule 69A-37.055, F.A.C.,

1792before a new application and additional

1798testing can occur.

180133. The general procedures for administering the State

1809Firefighter Certification Examination set forth in Florida

1816Administrative Code Rule 69A-37.062 provide that the individual

1824practical examinations are timed.

182834. As an applicant for re-certification, Petitioner has

1836the burden of proving entitlement to the recertification he

1845seeks. Florida Department of Transportation v. J.W.C. Co.,

1853Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).

186235. To prevail, Petitioner must establish facts by a

1871preponderance of the evidence that the Department improperly

1879denied his application for certification as a firefighter.

1887Department of Banking and Finance v. Osborne Stern and Company ,

1897670 So. 2d 932 (Fla. 1996).

190336. Petitioner failed to satisfy his burden. Petitioner

1911exceeded the maximum time to complete the SCBA portion of the

1922exam. Petitioner's assertion that the refresher course did not

1931provide enough time to learn the new method and how to

1942compensate for errors did not demonstrate that the retest was in

1953any way faulty or resulted in an incorrect completion time being

1964recorded for Petitioner.

196737. The greater weight of the credible evidence

1975established that Petitioner's performance on the SCBA section of

1984the practical examination was appropriately and fairly graded.

199238. Thus, as found above, the Petitioner failed to

2001establish a legal basis that he was entitled to a passing grade

2013for his performance on the SCBA portion of the Retention

2023Examination re-test.

2025RECOMMENDATION

2026Upon consideration of the Findings of Fact and the

2035Conclusions of Law reached, it is

2041RECOMMENDED that the Department enter a final order denying

2050Petitioner's application to retain his certification as a

2058firefighter in the State of Florida.
