134PRELIMINARY STATEMENT

136On July 16, 2009, Petitioner, Dr. Eric J. Smith,

145Commissioner of Education, filed an Administrative Complaint

152advising Respondent, Michael Allen Simmons, that he was seeking

161disciplinary sanctions against his Florida educator's

167certificate.

168On September 10, 2009, Respondent requested an

175administrative hearing if a settlement was not reached. On

184November 25, 2009, Petitioner forwarded the case to the Division

194of Administrative Hearings for assignment of an Administrative

202Law Judge.

204On November 25, 2009, an Initial Order was sent to both

215parties requesting, inter alia , mutually-convenient dates for

222the final hearing. Based on the response of the parties on

233December 3, 2009, the case was scheduled for final hearing on

244February 2, 2010, in Orlando, Florida. On January 28, 2010,

254Respondent requested a continuance, and on February 1, 2010, the

264case was rescheduled for March 5, 2010.

271The hearing took place as scheduled on March 5, 2010.

281Petitioner presented four witnesses: Dr. Stephanie Shames,

288Michael Longmire, Rivers Lewis, and C.F. Petitioner submitted

296four exhibits that were received into evidence and marked

305Petitioner's Exhibits 1 through 4. At the hearing, Respondent

314testified in his own behalf and had with him a conductor's

325baton.

326The Transcript of Proceedings was filed on March 17, 2010.

336Both parties timely submitted Proposed Recommended Orders.

343All statutory references are to Florida Statutes (2007),

351unless otherwise noted.

354FINDINGS OF FACT

357Based on the oral and documentary evidence presented at the

367final hearing, the following Findings of Fact are made:

3761. Respondent holds Florida Professional Educator's

382Certificate No. 1045332, covering the area of music, which is

392valid through June 30, 2011. At the time of the incident

403alleged in the Administrative Complaint, he was employed as a

413band teacher at Memorial Middle School, Orlando, Florida.

4212. Petitioner is the head of the state agency responsible

431for certifying and regulating public school teachers in Florida.

4403. On December 12, 2007, Respondent, pursuant to his

449teaching responsibility, was conducting the seventh-grade band

456ensemble which was performing in the school cafeteria.

464Apparently, this is where the band class meets.

4724. C.F., a sixth-grade band student, was in the cafeteria

482as a part of the class. Students who were not actively

493performing had been instructed to remain quiet, to read music,

503to be courteous and not to distract the performing ensemble.

5135. Notwithstanding the admonition to remain quiet, C.F.

521became "bored" and began "banging" rhythmically on a lunch

530table.

5316. Initially, Respondent attempted to get C.F.'s

538attention. Another student also attempted to stop C.F.

546Respondent moved across the cafeteria as he continued to conduct

556the ensemble, reached out and "tapped" C.F. on the wrist/forearm

566with a conductor's baton "to get his attention," and instructed

576him by facial expressions to stop banging on the table.

5867. A conductor's baton is approximately eight inches long,

595has a cork end that allows it to be grasped between the thumb

608and forefinger, and is smaller in circumference than a pencil.

618It looks similar to a small knitting needle, only shorter.

6288. When the ensemble concluded the musical selection it

637was performing, Respondent returned his attention to C.F. who

646began arguing with him. Respondent told C.F. to remove himself

656from the cafeteria and stand in the hallway.

6649. Instead of standing in the hallway as instructed, C.F.

674went to the assistant principal, Mr. Campbell, and complained

683that Respondent had struck him.

68810. Mr. Campbell called Mr. Longmire, the sixth-grade dean

697of men, to his office, and Mr. Longmire observed a small red

709mark on C.F.'s arm.

713CONCLUSIONS OF LAW

71611. The Division of Administrative Hearings has

723jurisdiction over the parties to and the subject matter of this

734proceeding. § 120.57, Fla. Stat. (2009); Sublett v. District

743School Board of Sumter County , 617 So. 2d 374, 377 (Fla. 5th DCA

7561993).

75712. Section 1012.795, Florida Statutes (2009), reads, in

765pertinent part, as follows:

769(1) The Education Practices Commission

774may suspend the educator certificate of any

781person as defined in s. 1012.01(2) or

788(3) for up to 5 years, thereby denying that

797person the right to teach or otherwise be

805employed by a district school board or a

813public school in any capacity requiring

819direct contact with students for that period

826of time, after which the holder may return

834to teaching as provided in subsection (4);

841may revoke the educator certificate of any

848person, thereby denying that person the

854right to teach or otherwise be employed by a

863district school board or public school in

870any capacity requiring direct contact with

876students for up to ten years, with

883reinstatement subject to the provisions of

889subsection (4); may revoke permanently the

895educator certificate of any person thereby

901denying that person the right to teach or

909otherwise be employed by a district school

916board or public school in any capacity

923requiring direct contact with students; may

929suspend the educator certificate, upon an

935order of the court or notice by the

943Department of Revenue relating to the

949payment of child support; or may impose any

957other penalty provided by law, if the

964person:

968(j) Has violated the Principles of

974Professional Conduct for the Education

979Profession prescribed by the State Board of

986Education rules.

98813. Florida Administrative Code Rule 6B-1.006 states, in

996pertinent part, as follows:

1000(1) The following disciplinary rule shall

1006constitute the Principles of Professional

1011Conduct for the Education Profession in

1017Florida.

1018(2) Violation of any of these principles

1025shall subject the individual to revocation

1031or suspension of the individual educator's

1037certificate, or the other penalties as

1043provided by law.

1046(3) Obligation to the student requires

1052that the individual:

1055(a) Shall make reasonable effort to

1061protect the student from conditions harmful

1067to learning and/or to the student's mental

1074and/ or physical health and/or safety.

1080* * *

1083(e) Shall not intentionally expose a

1089student to unnecessary embarrassment or

1094disparagement.

109514. Because Respondent's Florida educator's certificate is

1102at risk of being sanctioned, Petitioner bears the burden of

1112proving the allegations in the Administrative Complaint by clear

1121and convincing evidence. Ferris v. Turlington , 510 So. 2d 292

1131(Fla. 1987). The definition of clear and convincing evidence is

1141found in the case of Slomowitz v. Walker , 429 So. 2d 797 (Fla.

11544th DCA 1983).

115715. Because the statute and rules providing grounds for

1166disciplining Respondent's Florida educator's certificate are

1172penal in nature, they must be construed in favor of Respondent.

1183Rosario v. Burke , 605 So. 2d 523 (Fla. 2d DCA 1992); Lester v.

1196Department of Professional Regulations , 348 So. 2d 923 (Fla. 1st

1206DCA 1977).

120816. Petitioner has failed to prove by "clear and

1217convincing evidence" that Respondent violated the Principles of

1225Professional Conduct for the Education Profession in Florida in

1234that he failed to "make reasonable effort to protect the student

1245from conditions harmful to learning and/or to the student's

1254mental and/ or physical health and/or safety." The evidence

1263clearly suggests that Respondent was simply attempting to gain

1272the attention of a disruptive student by tapping his hand/wrist

1282with the conductor's baton.

128617. It is also alleged that Respondent violated the

1295Principles of Professional Conduct for the Education Profession

1303in Florida in that he "intentionally expose[d] a student to

1313unnecessary embarrassment or disparagement." While it is not

1321hard to imagine that a student would be embarrassed by being

1332asked to leave the classroom, based on the evidence presented,

1342removing the student appears to be an appropriate remedy for

1352the disruption caused by the student and arguing with a teacher.

1363Petitioner has failed to prove that Respondent violated Florida

1372Administrative Code Rule 6B-1.006(3)(e) by "clear and

1379convincing" evidence.

1381RECOMMENDATION

1382Based on the foregoing Findings of Fact and Conclusions of

1392Law, it is

1395RECOMMENDED that Respondent, Michael Allen Simmons, be

1402found not guilty of the violations alleged in the Administrative

1412Complaint and that no disciplinary action be taken.
