103STATEMENT OF THE ISSUE
107The issue is whether Respondent should deny an application
116for certification as a Firefighter II on the alleged grounds
126that Petitioner failed the Firefighter Minimum Standards
133Equivalency Examination.
135PRELIMINARY STATEMENT
137By Notice of Intent to Deny (Notice of Denial) dated
147November 20, 2009, Respondent notified Petitioner that
154Respondent proposed to deny Petitioner's certification as a
162Firefighter II. Petitioner timely requested a formal hearing,
170and Respondent referred the matter to DOAH to conduct the
180hearing.
181At the hearing, Petitioner presented the testimony of one
190witness and submitted 14 exhibits for admission into evidence.
199Respondent presented the testimony of two expert witnesses and
208submitted five exhibits for admission into evidence.
215The identity of the witnesses and exhibits, and the rulings
225regarding each, are reported in the one-volume Transcript of the
235hearing filed on March 5, 2010. Petitioner and Respondent each
245requested a Transcript of the hearing.
251Petitioner requested an extension of time to file a
260proposed recommended order (PRO). The ALJ entered an Order,
269extending the time for each party to file the party's respective
280PRO until March 19, 2010. Respondent timely filed its PRO on
291March 19, 2010. Petitioner filed her PRO on March 22, 2010.
302FINDINGS OF FACT
3051. Respondent is the state agency responsible for the
314certification of firefighters in the State of Florida, pursuant
323to Chapter 633, Florida Statutes (2009). 1 At a date not
334disclosed in the record, Petitioner applied for a certification
343as a Firefighter II.
3472. On September 21, 2009, Petitioner took the Firefighter
356Minimum Standards Equivalency Examination (initial
361examination). Petitioner failed to pass the Ladder, Hose, and
370Self Contained Breathing Apparatus (SCBA) components of the
378practical portion of the initial examination.
3843. On November 17, 2009, Petitioner took the Firefighter
393Minimum Standards Equivalency Examination Re-test (examination
399re-test) for the Ladder, Hose, and SCBA components. Petitioner
408failed to pass the Ladder component of the examination re-test.
4184. By Notice of Denial dated November 20, 2009, Respondent
428notified Petitioner that Petitioner had failed the Firefighter
436Minimum Standards Equivalency Examination. Petitioner requested
442an administrative hearing.
4455. Petitioner alleges that, during her initial examination
453on September 21, 2009, there was an equipment malfunction during
463the Ladder component of the practical portion of the
472examination. Petitioner bases her allegations on the Ladder
480component score sheet for the initial examination (score
488sheet) that was received by Petitioner after she completed the
498initial examination and examination re-test.
5036. The score sheet for the initial examination states that
513Petitioner failed the Ladder component of the initial
521examination because Petitioner exceeded the time period to
529complete the ladder evolution and failed to fully extend the
539ladder with the dogs locked. In the Comments Required for
549Failure section, the score sheet listed, Safety latch on dawgs
559[sic] stuck in top of rung. Unsafe act. Over time.
5697. Petitioner alleges that the statement that a piece of
579equipment was "stuck" is proof of an equipment malfunction. Two
589experts testified during the hearing that the "stuck" equipment
598was caused by operator error rather than an equipment
607malfunction. The testimony of the two experts was credible and
617persuasive.
6188. Petitioner, as the examinee, could have remedied the
"627stuck" equipment by raising the ladder to release the finger
637and then lowering the ladder to allow the dogs to lock onto the
650rung. The failure to do so was an "unsafe act that created a
663safety hazard in which the fly section of the ladder could have
675fallen down to the ground.
6809. A preponderance of the evidence does not show that
690Petitioner failed the Ladder component of the initial
698examination because of an equipment malfunction. Rather, the
706preponderance of evidence shows that Petitioner failed to have
715the dogs locked, which is required by the examination.
72410. A preponderance of the evidence also shows that
733Petitioner did not complete the ladder evolution within the
742required time during the re-take examination. The excessive
750time resulted in an automatic failure of the re-take
759examination.
760CONCLUSIONS OF LAW
76311. DOAH has jurisdiction over the parties to and subject
773matter of this proceeding. §§ 120.569 and 120.57(1). DOAH
782provided the parties with adequate notice of the final hearing.
79212. Petitioner bears the ultimate burden of proving her
801entitlement to a license. Florida Department of Transportation
809v. J.W.C. Co., Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).
821Petitioner must show by a preponderance of the evidence that she
832satisfied relevant statutory criteria to be certified as a
841Firefighter II.
84313. Petitioner must show by a preponderance of evidence
852that the examination was faulty, arbitrarily or capriciously
860worded or graded, or that Respondent arbitrarily or capriciously
869denied credit through a grading process devoid of logic or
879reason. Espinoza v. Department of Business and Professional
887Regulation , 739 So. 2d 1250, 1251 (Fla. 3d DCA 1999), citin g
899Harac v. Department of Professional Regulation , 484 So. 2d 1333,
9091338 (Fla. 3d DCA 1986); State ex rel Glaser v. J.M. Pepper ,
921155 So. 2d 383 (Fla. 1st DCA 1963); State ex rel I.H Topp v.
935Board of Electrical Contractors for Jacksonville Beach, Florida ,
943101 So. 2d 583 (Fla. 1st DCA 1958). Petitioner did not satisfy
955her burden of proof. Petitioner is not eligible for
964certification as a Firefighter II. § 633.35(2); Fla. Admin.
973Code R. 69A-37.056(6).
976RECOMMENDATION
977Based upon the foregoing Findings of Fact and Conclusions
986of Law, it is
990RECOMMENDED that the Department of Financial Services enter
998a final order denying Kim Lashawn Edmonds application for
1007certification as a Firefighter II.
