100STATEMENT OF THE ISSUE

104The issue in this case is whether Petitioner’s application

113for certification as a firesafety inspector should be granted.

122PRELIMINARY STATEMENT

124Respondent, Department of Financial Services (Department),

130issued Petitioner, Jeffrey Bates (Mr. Bates), a State Fire

139Marshall, Bureau of Fire Standards and Training (Bureau)

147Examination Grade Report, notifying Mr. Bates that he failed to

157achieve a passing score for the firesafety inspector examination

166given on June 27, 2009. Mr. Bates requested an administrative

176hearing concerning the examination results, and the case was

185forwarded to the Division of Administrative Hearings for

193assignment of an Administrative Law Judge. The case was

202originally assigned to Administrative Law Judge J.D. Parrish,

210but was transferred to Administrative Law Judge Susan B. Harrell

220to conduct the final hearing.

225At the final hearing, Mr. Bates testified in his own

235behalf. Petitioner’s Exhibits 1 through 4 were admitted in

244evidence. The Department called Charles Brush as its witness.

253Respondent’s Exhibits 1 through 5 were admitted in evidence.

262The Transcript was filed on March 24, 2010. A corrected

272Transcript was filed on March 26, 2010. At the final hearing,

283the parties agreed to file their proposed recommended orders

292within ten days of the filing of the Transcript. The Department

303filed its Proposed Recommended Order on April 5, 2010. As of

314the date of this Recommended Order, Mr. Bates had filed no post-

326hearing submittals.

328FINDINGS OF FACT

3311. The Department is the state agency responsible for the

341certification of firesafety inspectors in the State of Florida

350pursuant to Chapter 633, Florida Statutes (2009). 1

3582. In September 2008, Mr. Bates completed his coursework

367for certification as a firesafety inspector. In November 2008,

376Mr. Bates submitted an application for certification as a

385firesafety inspector.

3873. Sometime between November 19, 2008, and December 5,

3962008, the Department notified Mr. Bates that the Department did

406not have a copy of his high school diploma and the certificate

418showing that course work for the building construction for the

428fire service had been completed. On December 5, 2008, the

438Department received documentation showing that Mr. Bates had

446graduated from high school and had completed the course work for

457the building construction for the fire service.

4644. Scheduling a time to take the firesafety inspector

473examination can be done online by going to the Pearson Vue

484testing center website and entering the ID and password provided

494by the Bureau. Mr. Bates attempted to schedule the examination

504by telephone and was unsuccessful, but he did not attempt to

515schedule the examination online. Sometime during January or

523February 2009, Mr. Bates was able to obtain a date for the

535examination.

5365. Mr. Bates took the examination for firesafety inspector

545certification for the first time on February 13, 2009. A

555passing score on the examination was 70 percent. The Bureau

565sent a notice to Mr. Bates that his score was 56 percent. The

578notice of the test results advised that he could retake the

589examination within six months of his test date of February 13,

6002009, and that he could review his test questions by contacting

611the Promissor at www.promissor.com.

6156. On April 3, 2009, Mr. Bates contacted Charles Brush,

625who was the standards supervisor for the Bureau, to schedule a

636review of his examination taken in February. Mr. Brush was

646responsible for the testing for certifications and renewals

654issued by the Bureau. Due to miscommunications with the Bureau,

664Pearson Vue testing center, and Mr. Bates, Mr. Bates was not

675scheduled for a review of his examination until May 2009.

6857. Mr. Bates reviewed his examination in May 2009;

694however, after he had gone through the examination one time, he

705was not allowed to again review the examination. This

714restriction on the review process is designed to prevent

723applicants from memorizing questions from the examination. Many

731of the questions on the examination may be used again in another

743examination.

7448. Because of the communication issues concerning the test

753review, Mr. Brush gave Mr. Bates an open-ended time extension to

764retake the examination. Sometime between February 13, 2009, and

773June 27, 2009, Mr. Bates took a weekend course to practice for

785the examination.

7879. On June 27, 2009, Mr. Bates retook the firesafety

797inspector examination and again scored 56 percent, which was a

807failing score. The notice of the test results provided that

817“[s]hould you fail the retest or waive your right to a retest,

829the only way to obtain certification is retake the course(s)

839required, submit a new application for approval, and pass the

849certification examination.”

85110. Mr. Bates does not contest the scores that he received

862on the examinations. He contends that he should be entitled to

873be certified as a firesafety inspector due to the amount of time

885that passed between the completion of his coursework in

894September 2008 and the taking of the examinations in February

904and June 2009. He was not able to retain coursework information

915from September 2008, when he completed his courses, until

924February 2009, when he first took the test.

932CONCLUSIONS OF LAW

93511. The Division of Administrative Hearings has

942jurisdiction over the parties to and the subject matter of this

953proceeding. §§ 120.569 and 120.57, Fla. Stat.

96012. Subsection 633.081(2)(f), Florida Statutes, states

966that certification as a firesafety inspector is conditioned on,

975among other things, the passing of the firesafety inspector

984certification examination. Florida Administrative Code

989Rule 69A-39.007 requires that a minimum score of 70 percent is

1000necessary to pass the examination.

100513. Mr. Bates bears the ultimate burden of proving his

1015entitlement to a firesafety inspector certification. Department

1022of Transportation v. J.W.C. Co., Inc. , 396 So. 2d 778 (Fla. 1st

1034DCA 1981). He must establish by a preponderance of the evidence

1045that he satisfied relevant statutory criteria to be certified as

1055a firesafety inspector.

105814. In order to establish that he should be granted

1068certification, Mr. Bates must demonstrate that he received or

1077should have received a passing score on the examination. He

1087must show that the examination was faulty, arbitrarily or

1096capriciously worded or graded, or that he was arbitrarily or

1106capriciously denied credit through a grading process devoid of

1115logic or reason. Harac v. Department of Professional

1123Regulation , 484 So. 2d 1333, 1338 (Fla. 3rd DCA 1986); State ex

1135rel. I.H. Topp v. Board of Electrical Examiners for Jacksonville

1145Beach, Florida , 101 So. 2d 583 (Fla. 1st DCA 1958). Mr. Bates

1157has failed to meet this burden. His score on both examinations

1168was 56 percent, a failing score. He is ineligible for

1178certification as a firesafety inspector.

118315. Mr. Bates’ contention that he should be granted

1192certification, regardless of his test score, is without merit.

1201There is no statutory provision that would allow Mr. Bates to be

1213certified without having received a passing score.

1220RECOMMENDATION

1221Based on the foregoing Findings of Fact and Conclusions of

1231Law, it is RECOMMENDED that a final order be entered denying

1242Mr. Bates’ request that he be certified as a firesafety

1252inspector.
