99STATEMENT OF THE ISSUE
103The issue in this case is whether the Florida Commission on
114Human Relations (Commission) has jurisdiction over Petitioners
121claims of discrimination.
124PRELIMINARY STATEMENT
126Petitioner, Peter Garcia, M.D. (Dr. Garcia), filed an
134Employment Complaint of Discrimination with the Commission on
142April 8, 2009. In the complaint, he alleged that he began
153working for respondent [Heart of Florida Medical Center] and
162Preferred Emergency Physicians in March 2007 and that
170Respondent, Heart of Florida Medical Center, had discriminated
178against him based on a disability. On September 30, 2009, the
189Commission issued a Determination: No Jurisdiction, stating
196that the Commission lacked jurisdiction to consider the
204complaint because Heart of Florida Medical Center was not an
214employer as defined in Subsection 760.02(7), Florida Statutes
222(2008). 1
224Dr. Garcia filed a Petition for Relief (Petition) with the
234Commission, alleging that Heart of Florida Medical Center had
243committed an unlawful employment practice and a public
251accommodation discriminatory practice. The Petition was
257forwarded to the Division of Administrative Hearings on
265October 26, 2009, for assignment to an Administrative Law Judge.
275The case was originally assigned to Administrative Law
283Judge J.D. Parrish, but was transferred to Administrative Law
292Judge Susan B. Harrell to conduct the final hearing. The final
303hearing was originally scheduled for February 12, 2010, but was
313continued and rescheduled for April 16, 2010.
320At the final hearing, Dr. Garcia testified in his own
330behalf. Heart of Florida Medical Center called Trudie Kramer
339and John Finnegan as its witnesses. Neither party submitted any
349exhibits.
350No transcript of the final hearing was ordered. Dr. Garcia
360filed his proposed recommended order on April 26, 2010, and
370Heart of Florida Medical Center filed its proposed recommended
379order on April 27, 2010. Both proposed recommended orders have
389been given consideration in the preparation of this Recommended
398Order.
399FINDINGS OF FACT
4021. Dr. Garcia is board-certified in emergency medicine and
411family medicine.
4132. Beginning on or about March 2007, Dr. Garcia had been
424given hospital privileges by Heart of Florida Medical Center to
434practice in its emergency department. Dr. Garcia was not
443employed by Heart of Florida Medical Center.
4503. His privileges came up for renewal in 2009. Because of
461unresolved concerns regarding Dr. Garcias ability to
468appropriately assess and treat emergency room patients as a
477result of a hearing deficiency, Dr. Garcias privileges with
486Heart of Florida Medical Center were not renewed.
4944. The non-renewal of his privileges at Heart of Florida
504Medical Center did not preclude Dr. Garcia from practicing
513medicine. It precluded Dr. Garcia from practicing medicine at
522Heart of Florida Medical Center. Dr. Garcia has practiced
531medicine in Texas since his privileges at Heart of Florida
541Medical Center were not renewed. There are other physicians in
551Florida who do not have privileges at Heart of Florida Medical
562Center and who practice medicine in Florida.
5695. The Board of Medicine licenses physicians in the State
579of Florida. Heart of Florida Medical Center does not license
589physicians.
5906. The non-renewal of his privileges at Heart of Florida
600Medical Center does not preclude Dr. Garcia from billing third-
610party insurance companies in connection with medical services he
619provides to insured individuals.
623CONCLUSIONS OF LAW
6267. The only issue considered in this proceeding is whether
636the Commission has jurisdiction over Dr. Garcias claims of
645discrimination. Dr. Garcia is claiming that Heart of Florida
654Medical Center has committed an unlawful employment practice as
663set forth in Subsection 760.10(5), Florida Statutes, and a
672public accommodation discriminatory practice in violation of
679Section 760.08, Florida Statutes.
6838. Subsection 760.10(5), Florida Statutes, provides:
689Whenever, in order to engage in a
696profession, occupation, or trade, it is
702required that a person receive a license,
709certification, or other credential, become a
715member or an associate of any club,
722association, or other organization, or pass
728any examination, it is an unlawful
734employment practice for any person to
740discriminate against any other person
745seeking such license, certification, or
750other credential, seeking to become a member
757or associate of such club, association, or
764other organization, or seeking to take or
771pass such examination, because of such other
778person's race, color, religion, sex,
783national origin, age, handicap, or marital
789status.
7909. Dr. Garcia contends that the language of
798Subsection 760.10(5), Florida Statutes, means that any person,
806not just an employer, who discriminates against Petitioner while
815he is attempting to engage in his profession as an Emergency
826Physician at Heart of Florida Medical Center commits an unlawful
836employment practice. Dr. Garcia is correct that a person does
846not have to be an employer to be guilty of violating
857Subsection 760.10(5), Florida Statutes. However, his contention
864that the granting of hospital privileges is covered by
873Subsection 760.10(5), Florida Statutes, is incorrect.
87910. The language of Subsection 760.10(5), Florida
886Statutes, is clear and unambiguous. Dr. Garcia is attempting to
896add additional language to the statute in order to modify the
907statute to include actions which preclude a doctor from
916practicing at a particular facility. When interpreting a
924statute, courts are not at liberty to add words to the statute
936that were not placed there by the legislature. State v. J.M. ,
947824 So. 2d 105, 111 (Fla. 2002). This is precisely what
958Appellant's interpretation of the statute would do. University
966of Florida Board of Trustees v. Andrews , 961 So. 2d 375 (Fla.
9781st DCA 2007).
98111. Subsection 760.10(5), Florida Statutes, is referring
988to the requirements that are necessary to engage in a
998profession. Such as those licenses, certifications,
1004credentials, or memberships that are required for a physician to
1014practice medicine in Florida. It is not a necessary requirement
1024that, in order to practice medicine in Florida, a physician has
1035to have hospital privileges at any hospital, much less a
1045specific hospital.
104712. Section 760.08, Florida Statutes, provides:
1053All persons shall be entitled to the full
1061and equal enjoyment of the goods, services,
1068facilities, privileges, advantages, and
1072accommodations of any place of public
1078accommodation, as defined in this chapter,
1084without discrimination or segregation on the
1090ground of race, color, national origin, sex,
1097handicap, familial status, or religion.
110213. Subsection 760.02(11), Florida Statutes, defines
1108public accommodations as follows:
"1112Public accommodations" means places of
1117public accommodation, lodgings, facilities
1121principally engaged in selling food for
1127consumption on the premises, gasoline
1132stations, places of exhibition or
1137entertainment, and other covered
1141establishments. Each of the following
1146establishments which serves the public is a
1153place of public accommodation within the
1159meaning of this section:
1163(a) Any inn, hotel, motel, or other
1170establishment which provides lodging to
1175transient guests, other than an
1180establishment located within a building
1185which contains not more than four rooms for
1193rent or hire and which is actually occupied
1201by the proprietor of such establishment as
1208his or her residence.
1212(b) Any restaurant, cafeteria, lunchroom,
1217lunch counter, soda fountain, or other
1223facility principally engaged in selling food
1229for consumption on the premises, including,
1235but not limited to, any such facility
1242located on the premises of any retail
1249establishment, or any gasoline station.
1254(c) Any motion picture theater, theater,
1260concert hall, sports arena, stadium, or
1266other place of exhibition or entertainment.
1272(d) Any establishment which is physically
1278located within the premises of any
1284establishment otherwise covered by this
1289subsection, or within the premises of which
1296is physically located any such covered
1302establishment, and which holds itself out as
1309serving patrons of such covered
1314establishment.
131514. The definition of public accommodation does not
1323include medical facilities. See Sheely v. MRI Radiology
1331Network, P.A. , 505 F.3d 1173, 1204 (11th Cir. 2007).
134015. Dr. Garcia has failed to establish that the Commission
1350has jurisdiction to determine his claims of discrimination.
1358RECOMMENDATION
1359Based on the foregoing Findings of Fact and Conclusions of
1369Law, it is RECOMMENDED that a final order be entered dismissing
1380the Petition for lack of jurisdiction.
