115STATEMENT OF THE ISSUE
119In this proceeding, the issues are: (1) Whether William
128Kleinschmidt ( " Petitioner " or " Kleinschmidt " ) possesses or
136demonstrat es a mental or physical impairment that qualifies
145Petitioner as a disabled person within the meaning of the Fair
156Housing Act, and therefore establishes that Petitioner belongs
164to a protected class of persons whom the Fair Housing Act
175protects from unlawful discrimination; (2) Whether Three
182Horizons North Condominium, Inc. ( " Respondent " or " Three
190Horizons " ), discriminated against Petitioner by enforcing the no
199pet restriction policy and requiring Petitioner to remove his
208cat(s); and (3) Whether Respondent di scriminated against
216Petitioner by failing to properly call a plumber in a timely
227manner after Petitioner notified Respondent of raw sewage
235seeping into his unit, No. 206.
241PRELIMINARY STATEMENT
243In a Housing Discrimination Complaint filed on July 6,
2522009, and subsequently investigated by the Florida Commission on
261Human Relations ( " Commission " ) , Kleinschmidt charged that Three
270Horizons unlawfully discriminated against Petitioner by not
277allowing hi m to keep his cats in his condominium unit as an
290accommodatio n b ecause he was disabled , and that Respondent
300retaliated against Kleinschmidt by failing to call a plumber in
310a timely manner after he notified Respondent of raw sewage
320seeping into his unit .
325The Commission investigated Petitioner's claim and on
332October 7 , 2009, issued a notice setting forth its determination
342that reasonable cause did not exist to believe that a
352discriminatory housing practice had occurred. Thereafter ,
358Petitioner filed a Petition for Relief, which the C ommission
368sent to the Division of Ad ministrative Hearings ( " DOAH " ) on
380November 10, 2009 .
384At the final hearing, Kleinschmidt testified on his own
393behalf and presented five witnesses : Judith He isler, Alfred
403Cariano, R uth Pearson, Jeffrey Humes, and Jacklyn Cue.
412Petitioner's E xhibits 1 through 12 were offered and admitted
422in to evidence. Respondent offered E xhibits 1 th r ough 8 during
435its cross - examination and all eight exhibits were received into
446evidence. Respondent did not otherwise present a case. During
455the hearing, the undersigned ruled that the O rder of Pre - Hearing
468Instructions dated December 1, 2009, would be adhered to and any
479exhibits presented at hearing that were not previously disclosed
488and prefiled would not be admitted into evidence.
496On January 7, 2011, t he five - volume T ranscrip t of the
510proceeding was filed with the DOAH . Both parties filed timely
521P roposed R ecommended O rders at DOAH . Petitioner filed
532Petitioner's V erified Notice of Filing Objections to the Late
542Served Respondent's Proposed Recommended Order and Affidavit in
550Sup port of Same ( " Notice " ) . The Notice is denied and both
564parties ' timely filed Proposed Recommended Orders, have been
573duly considered in preparation of this order .
581FINDINGS OF FACT
5841. In January 1999 , Petitioner purchased a condominium
592( " condo " ) at Thr ee Horizons . H e has resided in Unit 206
607continuously since he purchased the condo .
6142. Three Horizons Association is the entity responsible
622for operating and managing the condo property in which
631Kleinschmidt 's unit is located. At all times relevant to this
642proceeding, Respondent had a no pets policy .
6503. When Kleinschmidt moved into Three H orizons, he had two
661cats. His pet cats are named Princess and Marischa . H e keeps
674the pets in his unit. He considers them to be his family and
687feels like they are m ore like his children than cats since he is
701alone. His pets make him feel good. The pets were trained by
713his mother.
7154. Petitioner wants to keep his cats because they provide
725companionship and comfort, which makes Petitioner happy. In
733addition, the ca ts have made life tolerable for Kleinschmidt.
743Kleinschmidt has an emotional bond with his cats.
7515. Petitioner has filed two prior housing discrimination
759complaints against Three Horizons. 1
7646. From July 5, 2008, to July 6, 2009, 2 Kleinschmidt
775neither no tified Respondent of an alleged handicap nor requested
785an accommodation either verbally or in writing from Three
794Horizons. Specifically during the year, Kleinschmidt never
801asked for a waiver of Respondent's no pet rule or asked that the
814Petitioner's cats remain as service animals. 3
8217. Over about a nine - month period , two different main
832sewer line s backed up raw sewage into Petitioner's unit seven
843times. Each time a back up occurred in unit 206 and Respondent
855was notified o f the problem , Three Horizons cal led a plumber and
868had the main lines and pipes fixed t he same day , expending a
881total of $2,630 .00 for all the repairs .
8918. Three Horizons ' policy is to maintain and fix the
902common area of the facilities outside of individual units , and
912unit owners are re sponsible to fix any problems within their
923unit.
9249. On October 3, 2008, at around 4:00 p.m. Petitioner
934first noticed a leak in the main line under his unit in the
947parking garage. Kleinschmidt informed Ruth Pearson, Three
954Horizons ' day - to - day operation s manager and treasurer of the
968a ssociation. Pearson went to look at it and informed Petitioner
979that she would take care of it.
98610. When Kleinschmidt returned home that same day sewage
995was flowing into his unit from the toilet. Petitioner called
1005Jeffrey Humes ( " Humes " ), a m ason ry c ontractor, and made an
1019appointment for Humes to come to unit 206 the next day, which
1031was on October 4, 2008, at 2:00 p.m. to handle the backflow
1043problem since it was not a huge amount. During the night, the
1055backflow stopped .
105811 . On October 4, 2008, Humes reported to u nit 206 around
10711:00 p.m. and determined that the backflow was a main line
1082problem. Pearson was notified that it was the main line that
1093was causing the problem , and she called Feliz Fera Plumbing
1103C ompany ( " Feliz " ) . Feliz came out that same evening and fixed
1117the problem by provid ing " emergency plumbing service to clear
1127main line using K - 60 machine and cable. " 4 Feliz billed Three
1140Horizons $320.00.
114212. On October 6 , 2008, Petitioner had a second backflow
1152of sewage into his unit . Upon discov er ing it, Kleinschmidt
1164called Pearson and informed her of the problem. Respondent
1173immediately contacted Felix again to work on the main line.
1183Petitioner also called Humes back to assist him with his unit ' s
1196backflow. To prevent a ny future backflows into Petitioner's
1205toilet , Humes plugged it and capped it off separating it from
1216the main sewer line so sewage would not come in anymore. Humes
1228also helped Kleinschmi d t wet vac and clean up the unit.
124013. Three Horizons ' invoice from F eliz for October 6,
12512008, services st ated, " Plumbing service to clear main stoppage
1261line for Unit Number 206 and test the drain in Unit Number 206.
1274All is clear at this time. " 5 Respondent was charged $225.00 for
1286Feliz' s services.
128914. O n or about Novembe r 29, 2008 , Petitioner 's kitchen
1301backflowed from a different main line. His floors and cabinets
1311underneath the sink flooded , and Petitioner reported the sewage
1320back up to Pearson who contacted Feliz again to check the main
1332line . Felix repaired the proble m the same day and the invoice
1345stated , " Emergency plumbing service to clear stoppage in
1353Apartment 206. After troubleshooting found line to be clear.
1362Called in by Ms. Pearson. " 6 The cost to Respondent was $195.00
1374for the services.
137715. On December 3, 200 8, Pearson contacted Felix again
1387after being notified by Petitioner that his sink was backing up
1398with sewage. Felix returned to Three Horizons and fixed the
1408problem outlining the services in the invoice as " Plumbing
1417service to cut 4 " cast iron in parking garage for unit #206,
1429installed new clean out and jetted sink stack. " 7 Respondent was
1440charged $950.00 for the service.
144516. On May 2, 2009, sewage back ed up into Petitioner's
1456kitchen. When Petitioner notified Pearson of the problem she
1465called Felix . Th at same day, Felix serviced Three Horizons and
1477detailed the services on the invoice stating, " Emergency
1485plumbing service to clear stoppage in kitchen stack per Ruth . " 8
1497R espondent was charge d $295 for the plumbing services.
150717. On or about July 7 , 2009, P etitioner's unit had a back
1520up of sewage again. Kleinschmit contacted Pearson about the
1529problem , and Pearson called Felix , but the company had other
1539jobs and could not get to Three Horizons immediately . After
1550several hours of not having a response, Petit ioner called
1560Pearson again. Pearson became impatient because Felix had not
1569arrived immediately and called Enzo Bellanc a ( " Bellanca " ), Three
1580Horizons ' maintenance man , 9 to come check out the problem.
1591Bellanca fixed the common line plumbing problem on the s ame date
1603and wrote on the invoice, " Obstruction in drain line, 4 "
1613undercover parking lot. Remove 2 feet of cast iron pipe
1623replace d with P [V] C pipe 4 " and clean s n[ake] d , thru all pipe
1639drainage s[ys]tem and clean up the blockage. " 10 Bellanca charged
1649Three Horizons $385 .00 for labor and materials.
165718. When Petitioner notified Pearson of another sewage
1665back up in u nit 206 on July 15, 2009, Pearson called Bellanca
1678back again. Another stoppage had occurred under unit 206.
1687Bellanca fixed the problem and det ailed his services on the
1698invoice as " Drainage systems for Apartment 206 under cover
1707parking area, remove elbow four inch clear blo ckage, replace a
1718new P[V]C fo ur inch elbow, plus a [clear - [o ut] Labor and
1732materials, $260. 00 " 11
173619. Petitioner 's doctors are Drs. Gottlieb and Siegal .
1746Kleinschmidt takes medicine daily .
175120. Kleinschmidt receive s Social Security benefits.
175821. Kleinschmidt has asthma and was once told that he had
1769post traumatic stress . However, no evidence was presented that
1779Kleinschmidt's life activities are substantially limit ed or that
1788he i s in capable of perform ing all life activities he chooses.
1801CONCLUSIONS OF LAW
180422. The Division of Administrative Hearings has
1811jurisdiction over the subject matter of this proceeding and of
1821the parties pursuant to s ections 120.569 and 120.57(1), Florida
1831Statutes .
183323. As the person complaining of discrimination in this
1842administrative proceeding, Kleinschmit has the burden of proving
1850by a preponderance of the evidence that he was discriminated
1860against by Three Horizons on the basis of his handicap. See
1871§ 760.34(5) ( " In any proceeding brought pursuant to this section
1882[Section 760.34] or s. 760.35, the burden of proof is on the
1894complainant " ).
189624. The preponderance of the evidence standard requires
1904proof by " the greater weight of the evidence, " Black's Law
1914Dictionary 1201 (7th ed. 1999), or evidence that " more likely
1924than not " tends to prove a certain proposition. See Gross v.
1935Lyons , 763 So. 2d 276, 289 n.1 (Fla. 2000)(relying on Am .
1947Tobacco Co. v. State , 697 So. 2d 1249, 1254 (Fla. 4th DCA 1997) ,
1960quoting Bourjaily v. United States , 483 U.S. 171, 175 (1987)).
197025. Petitioner has the burden of proving that Respondent
1979violated either of the Act s 12 by failing to waive its no pets
1993policy as a reasonable accomm odation . See Fl a. Dept . of T ransp .
2009v. J.W.C. Co . , Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).
202226. Section 760.34, provide s in pertinent part:
2030(4) If, within 180 days after a complaint
2038is filed with the commission or within
2045180 days after expiration of a ny period of
2054reference under subsection (3), the
2059commission has been unable to obtain
2065voluntary compliance with ss. 760.20 - 760.37,
2072the person aggrieved may commence a civil
2079action in any appropriate court against the
2086respondent named in the complaint or
2092pe tition for an administrative determination
2098pursuant to s. 760.35 to enforce the rights
2106granted or protected by ss. 760.20 - 760.37 .
2115. . .
211827. Florida recognizes handicap - based housing
2125discrimination. Section 760.23(8)(b), provides:
2129(8) It is unlawful to discriminate against any
2137person in the terms, conditions, or privileges
2144of sale o r rental of a dwelling, or in the
2155provision of services or facilities in
2161connection with such dwelling, bec a use of a
2170handicap of:
2172* * *
2175(b) A person residing in or i ntending to reside
2185in that dwelling after it is sold , rented, or
2194made available; or . . . .
220128. 42 U.S.C. s ection 3602(h) provides, in pertinent part,
2211the following definition of the term " handicap " for purposes of
2221the Federal Act:
2224(h) " Handicap " means, with respect to a
2231person --
2233(1) a physical or mental impairment which
2240substantially limits one or more of such
2247person's major life activities,
2251(2) a record of having such an impairment,
2259or
2260(3) being regard ed as having such an
2268impairment . . .
227229. " Han dicap " is defined in the Florida Act in
2282s ection 760.22 (7)(a) , as follows:
2288(7) " Handicap " means:
2291(a) A person has a physical or mental
2299impairment which substantially limits one or
2305more major life activities, or he or she has
2314a record of having, or is reg arded as
2323having, such physical or mental impairment;
232930. 42 U.S.C. s ection 3604(f)(3)(B), provides that the
2338following constitutes housing discrimination within the meaning
2345of the Federal Act:
2349( f)(3)(B) a refusal to make reasonable
2356accommodations in rule s, policies,
2361practices, or services, when such
2366accommodations may be necessary to afford
2372such person equal opportun ity to use and
2380enjoy a dwelling . . .
238631. The Florida Act has a similar provision. Section
2395760.23(9) , provides as follows:
2399For purposes of subsections (7) and (8),
2406discrimination includes:
2408* * *
2411( b) A refusal to make reasonable
2418accommodations in rules, policies,
2422practices, or services, when such
2427accommodations may be necessary to afford
2433such person equal opportunity to use and
2440enjoy a dwelling.
244332. Kleinschmidt asserts that Three Horizons discriminated
2450against him by enforcing the pet restrictions policy and
2459requiring Petitioner to remove his cats.
246533. T o prevail in this proceeding under either of the
2476Act s , Petitioner has the burd en of proving : (1) he suffered
2489from a handicap within the meaning of the Florida Fair Housing
2500Act, (2) the Association knew or should have known that he was
2512handicapped, (3) a reasonable accommodation was necessary to
2520afford him or her an opportunity to u se and enjoy his dwelling,
2533and (4) the Respondent refused to make the requested
2542accommodation. See Giebler v. M & B Assoc . , 343 F.3d 1143, 1147
2555(9th Cir. 2003).
255834. Based o n the facts as found herein , P etitioner has
2570failed to prove by a preponderance of the evidence that he is
" 2582handicapped " as defined in s ection 760.22(7)(a ) . Even though
2593Petitioner established that he received Social Security benefits
2601at the times pertinent to this proceeding, this is not
2611sufficient, as a matter of law, to prove that he was handicapped
2623under the the Act s .
262935. In addition, Kleinschmidt failed to demonstrate that
2637he even informed Three Horizons that he was handicapped or
2647requested a reasonable accommodation. Further, based on the
2655findings of fact herein, Kleinschmidt fai led to prove by the
2666greater weight of the evidence that he was entitled to a
2677reasonable accommodation under the Act s . In the absence of
2688proof of the nature and extent of a physical or mental condition
2700and of the manner in such a condition substantially li mited a
2712major life activity, it is a legal impossibility for a person to
2724prove that an accommodation is " necessary to afford him [or her]
2735an opportunity to use and enjoy his dwelling. " Schwarz v. City
2746of Treasure Island , 544 F.3d 1201, 1218 - 19 (11th Cir. 2008).

276136. Based on the legal principles discussed above, as
2770applied to the findings of fact herein, Kleinschmidt failed to
2780meet his burden of proving the first three elements of a claim
2792of discrimination on the basis of handicap. Petit ioner,
2801therefore, failed to prove by a preponderance of the evidence
2811that the Three Horizons discriminated against him because of a
2821handicap.
282237. Finally, Petitioner's claims of retaliation are
2829without merit. T he great er weight of evidence shows that eac h
2842time Petitioner contacted Thre e Horizons regarding a back up of
2853sewage in his unit that Three Horizons took care of the matter
2865in a timely manner by notif ying a plumber to check and fix the
2879main line problem s . Therefore, Petitioner failed to establish
2889t hat any of Three Horizons actions were harassing or retaliatory
2900in nature based on the previous cases filed.
2908RECOMMENDATION
2909Based on the foregoing Findings of Fact and Conclusions of
2919Law, it is RECOMMENDED that the Florida Commission on Human
2929Relations enter a final order dismissing Petitioner's Petition
2937for Relief.
