101NEUROLOGICAL INJURY PURSUANT TO CHAPTER 766, FLORIDA STATUTE S
110This cause came on for consideration pursuant to Sections
119766.304 and 766.305(7), Florid a Statutes, upon the Stipulation
128and J oint P etition of the parties, filed November 19, 2010 , for
141the entry of an order approving the resolution of a formal claim
153for compensation benefits heretofore filed in this cause in
162accordance with the provisions of Chapter 766, Florida Statutes,
171and a resolution of the exclusive remedy otherwise available as
181outlined in Chapter 766, Florida Statutes.
187By the terms of their stipulation, the parties have agreed
197that Cassandra LeBreux is the mother and legal guardian of
207Jordan Horner (Jordan ), a minor; that Jordan was born a live
219infant on or about February 6, 2008, at St. Petersburg General
230Hospital, a "hospital" as defined by Section 766.302(6), Florida
239Statutes, located in St. Petersburg, Florida; and that Jordan's
248bi rth weight exceeded 2,500 grams. The parties have further
259agreed that Jeffrey Carlson, M.D. , and Megan Tirone, M.D. ,
268delivered obstetrical services at Jordan's birth, and at all
277times material hereto, w ere "participating physician s " in the
287Florida Birth - R elated Neurological Injury Compensation Plan, as
297defined by Section 766.302(7), Florida Statutes. Finally, by
305their stipulation, the parties have agreed that Jordan suffered
314a "birth - related neurological injury," as that term is defined
325by Section 766.302 (2), Florida Statutes.
331After due consideration of the interests of all parties,
340and being otherwise fully advised in the premises, including but
350not limited to the fact that Petitioner has, at all times, been
362represented by legal counsel, it is
368ORDERED th at:
3711. The Stipulation and Joint Petition, filed November 19 ,
3802010, is hereby approved, and the parties are directed to comply
391with the provisions thereof.
3952. Petitioner, Cassandra LeBreux , as the mother and legal
404guardian of Jordan Horner , a minor, is awarded One hundred
414thousand dollars ($100,000.00), pursuant to Section
421766.31(1)(b)1., Florida Statutes, to be paid in lump sum.
4303. Morgan & Morgan, P.A., attorneys for P etitioner, is
440awarded an agreed attorney's fee of Ten thousand dollars
449($10,000.00) and agreed expenses /costs of One thousand t wo
460hundred fifty - one dollars and ninety - five cents ($1, 251.95 ),
473totaling Eleven thousand t wo hundred f ifty - one dollars and
485ninety - five cents ($11, 251.95 ), as payment in full, for services
498rendered in the filing of this claim.
5054. Upon payment of the award of One hundred thousand
515dollars ($100,000.00), attorney's fees and other expenses , and
524past benefits/ expenses, the claims of Petitioner ( C laimant)
534shall be deemed fully satisfied and extinguished, except for the
544i ssues reserved in the parties' Stipulation and Joint Petition
554filed November 19 , 2010, including Respondent's continuing
561obligation under Section 766.31(2), Florida Statutes, to pay
569future expenses as incurred.
5735. With regard to the issues reserved in th e parties'
584Stipulation, including but not limited to any dispute regarding
593past benefits/expenses, a hearing will be scheduled by a
602separate notice of hearing to address those issues. As for the
613date of hearing, the parties shall, on or before March 30, 2 011 ,
626advise the undersigned Administrative Law Judge, with
633specificity, of the matters remaining in dispute, of
641several mutually agreeable dates for hearing, and of the time
651required for such hearing.
6556. The Division of Administrative Hearings retains
662ju risdiction over this matter to resolve any disputes, should
672they arise, regarding the parties' compliance with the terms of
682this Order.
