107The issue relates to the amount of attorney's fees and costs owed Petitioner by Respondent The Leather Galleries, Inc.
126PRELIMINARY STATEMENT
128On February 26, 2010, the Florida Commission on Human
137Relations (FCHR) entered a Final Order Awarding Affirmative
145Relief from an Unlawful Employment Practice and Remanding Case
154to Administrative Law Judge for Issuance of Recommended Order
163Regarding Amounts of Attorney's Fees and Costs Owed Petitioner
172by Respondent The Leather Galleries (Respondent) in Division of
181Administrative Hearings (DOAH) Case No. 09-3961. The Florida
189Commission on Human Relations referred the case to DOAH on
199March 3, 2010. On March 3, 2010, DOAH issued a Notice that the
212undersigned would consider the merits of this case.
220On March 4, 2010, the undersigned issued an Initial Order
230in the case now identified as DOAH Case No. 10-1081F. The
241Initial Order required Petitioner Cira Caiminti (Petitioner) to
249file an itemized claim for fees and costs and an affidavit of
261counsel.
262The Initial Order required Respondent to file a written
271statement either admitting the reasonableness of the fees and
280costs or stating the basis for disputing those amounts, together
290with a supporting counter-affidavit.
294The Initial Order specifically stated that Respondent's
301failure to file a timely response might result in a finding that
313Respondent does not contest Petitioner's claim and the issuance
322of an order awarding attorney's fees and costs without further
332notice. Petitioner filed her Statement for Attorney's Fees and
341an Affidavit of Counsel for the Petitioner on March 15, 2010.
352Respondent has not filed a response to the Initial Order.
362FINDINGS OF FACT
3651. Respondent has not challenged the reasonableness of the
374attorney's fees as set forth in Petitioner's claim.
382Petitioner's counsel spent a total of 10.40 hours preparing for
392the hearing, attending the hearing, drafting and filing
400Petitioner's Proposed Recommended Order, and preparing the
407statement relating to fees and the supporting affidavit.
4152. At $150 per hour, the fee for services performed by
426Petitioner's counsel is $1,560. Petitioner is not claiming
435reimbursement for costs.
4383. An attorney's fee in the amount of $1,560 is reasonable
450under the circumstances.
453CONCLUSIONS OF LAW
4564. The Division of Administrative Hearings has
463jurisdiction over the subject and the parties to this proceeding
473pursuant to Sections 120.569, 120.57(1), and 760.11, Florida
481Statutes (2009), and the Final Order in FCHR Order No. 10-
492022/DOAH Case No. 09-3961.
4965. Petitioner seeks attorney's fees pursuant to Section
504760.11(6), Florida Statutes (2009), which provides as follows in
513relevant part:
515In any action or proceeding under this
522subsection, the commission, in its
527discretion, may allow the prevailing party a
534reasonable attorney's fee as part of the
541costs. It is the intent of the Legislature
549that this provision for attorney's fees be
556interpreted in a manner consistent with
562federal case law involving Title VII action.
5696. Petitioner was the prevailing party in FCHR Order No.
57910-022/DOAH Case No. 09-3961. Respondent does not contest the
588claim that Petitioner has incurred attorney's fees in the amount
598of $1,560.
601RECOMMENDATION
602Based on the foregoing Findings of Facts and Conclusions of
612Law, it is
615RECOMMENDED:
616That the Florida Commission on Human Relations enter a
625final order awarding Petitioner attorney's fees in the amount of
635$1,560.
