95STATEMENT OF THE CASE

991. On March 5, 2010, Lashaunda Katrice Mason (mother) and

109Alonzo Cochease Mason (father) on behalf of and as parents and

120natural guardians of Z aivion Joel Mason , a minor, whose date of

132birth is alleged as March 6, 2005, filed a petition (claim) with

144the Division of Administrative Hearings (DOAH) for compensation

152under the Florida Birth - Related Neurological Injury Compensation

161Plan ( Plan). Dr. George Buchanan and Shands at University of

172Florida were named in the Petition as associated with Z aivion's

183b irth.

1852. DOAH served NICA with a copy of the claim on March 9,

1982010; served University of Florida Shands Hospital on March 11,

2082010; a nd served George Buchanan, M.D., on June 15, 2010.

2193. No person or entity has moved to intervene.

2284. On September 29, 2010, NICA filed a Motion for Summary

239Final Order, pursuant to Section 120.57(1)(h), Florida Statutes.

247The predicate for NICA's motion was its assertion that,

256indisputably, the physician, George Buchanan, M.D., named in the

265Petition as having provided obstetrical services at Z aivion 's

275birth, was not a "participating physician," as defined by law,

285inasmuch as he was not a participating phy sician at the time of

298the injury to the minor child, because he had not paid the

310required assessment for participation in the Plan , nor was he

320exempt from payment of the assessment . § 766.302(7), Fla. Stat.

331See also § 766.314(4)(c), Fla. Stat. Attached to the motion was

342an affidavit of NICA's Custodian of Records , attesting that

351George Buchanan , M.D., had not paid the required assessment for

361participation in the Plan at the time of the injury. The

372affidavit further attested that NICA's policy is to annu ally

382document exemptions pursuant to Section 766.314(4)(c), Florida

389Statutes, and that the " NICA Cares" physician payment history

398report attached to the affidavit shows that in 2005, the year of

410Z aivion 's birth, Dr. Buchanan paid the Two Hundred and Fifty

422Dollars ($250.00) assessment required by Section

428766.314(4)(b)1., Florida Statutes, for non - participating, non -

437exempt licensed physicians.

4405. Petitioners did not timely respond to NICA's Motion for

450Summary Final Order. Consequently, an Order to Show Caus e was

461entered on October 13, 2010, which provided:

468On September 29, 2010, Respondent served a

475Motion for Summary Final Order. To date,

482Petitioners have not responded to the

488motion. Fla. Admin Code R. 28 - 106.103 and

49728 - 106.204(4). Nevertheless, and

502notwi thstanding they have been accorded the

509opportunity to do so, it is

515ORDERED that by October 25, 2010,

521Petitioners shall show good cause in

527writing, if any they can, why the relief

535requested by Respondent should not be

541granted.

5426. On October 25, 2010, Pet itioners filed a " Response to

553this Court's October 13, 2010 to Show Cause and a Request for

565Extension of Time to File a Response to Respondent's Motion for

576Summary Final Order. " The thrust of this Response was that

586Petitioners needed time to examine addit ional medical records.

5957. On October 27, 2010, an Order was entered which

605provided, in pertinent part, "Petitioners are granted to and

614until November 30, 2010, in which to respond to the Motion for

626Summary Final Order or to move for additional time for di scovery

638in aid of a response. "

6438. On November 30, 2010 , Petitioners filed a Response,

652stating, in pertinent part, "The additional hospital records

660have been reviewed and Petitioner reluctantly concurs that no

669NICA doctor assisted Dr. Buchanan."

6749. Given the record, there is no dispute of material fact.

685Specifically, there is no dispute that the only physician named

695in the Petition as providing obstetrical services during

703Z aivion's birth was not a "participating physician," as that

713term is defined by Sect ion 766.302(7), Florida Statutes.

722Accordingly, NICA's Motion for Summary Final Order is, for

731reasons appearing more fully in the Conclusions of Law, well -

742founded. 1

744CONCLUSIONS OF LAW

74710. The Division of Administrative Hearings has

754jurisdiction over the p arties to, and the subject matter of,

765these proceedings. § 766.301, et seq. , Fla. Stat.

77311. The Florida Birth - Related Neurological Injury

781Compensation Plan was established by the Legislature "for the

790purpose of providing compensation, irrespective of fau lt, for

799birth - related neurological injury claims" relating to births

808occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

81912. The injured infant, her or his personal

827representative, parents, dependents, and next of kin may seek,

836compensation u nder the Plan by filing a claim for compensation

847with the Division of Administrative Hearings. §§ 766.302(3),

855766.303(2), and 766.305(1), Fla. Stat. NICA, which administers

863the Plan, has "45 days from the date of service of a complete

876claim . . . in whic h to file a response to the petition and to

892submit relevant written information relating to the issue of

901whether the injury is a birth - related neurological injury."

911§ 766.305(4), Fla. Stat.

91513. If NICA determines that the injury alleged in a claim

926is a compensable birth - related neurological injury, it may award

937compensation to the claimant, provided that the award is

946approved by the administrative law judge to whom the claim has

957been assigned. § 766.305(7), Fla. Stat. If, on the other hand,

968NICA disp utes the claim, as it has in the instant case, the

981dispute must be resolved by the assigned administrative law

990judge in accordance with the provisions of Chapter 120, Florida

1000Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

100814. In discharging this r esponsibility, the administrative

1016law judge must make the following determination based upon the

1026available evidence:

1028(a) Whether the injury claimed is a

1035birth - related neurological injury. If the

1042claimant has demonstrated, to the

1047satisfaction of the adm inistrative law

1053judge, that the infant has sustained a brain

1061or spinal cord injury caused by oxygen

1068deprivation or mechanical injury and that

1074the infant was thereby rendered permanently

1080and substantially mentally and physically

1085impaired, a rebuttable presu mption shall

1091arise that the injury is a birth - related

1100neurological injury as defined in s.

1106766.303(2).

1107(b) Whether obstetrical services were

1112delivered by a participating physician in

1118the course of labor, delivery, or

1124resuscitation in the immediate post delivery

1130period in a hospital; or by a certified

1138nurse midwife in a teaching hospital

1144supervised by a participating physician in

1150the course of labor, delivery, or

1156resuscitation in the immediate postdelivery

1161period in a hospital.

1165§ 766.309(1), Fla. Stat. An award may be sustained only if the

1177administrative law judge concludes that the "infant has

1185sustained a birth - related neurological injury and that

1194obstetrical services were delivered by a participating physician

1202at birth." § 766.31(1), Fla. Stat.

12081 5. Pertinent to this case, "participating physician" is

1217defined in Section 766.302(7), Florida Statutes, to mean:

1225. . . a physician licensed in Florida to

1234practice medicine who practices obstetrics

1239or performs obstetrical services either

1244full - time or part - time and who had paid or

1256was exempted from payment at the time of the

1265injury the assessment required for

1270participation in the birth - related

1276neurological injury compensation plan for

1281the year in which the injury

1287occurred. . . .

129116. Here, indisputab ly, the only physician, named/shown to

1300have provided obstetrical services during Ja ivion 's birth, was

1310not a "participating physician," as that term is defined in

1320Section 766.302(7), Florida Statutes, and as that term is used

1330in Sections 766.301 through 766 .316, Florida Statutes.

1338Consequently, Z aivion (and derivatively, his parents) does not

1347qualify for coverage under the Plan.

135317. Where, as here, the administrative law judge

1361determines that ". . . obstetrical services were not delivered

1371by a particip ating physician at the birth, she or he shall enter

1384an order [to such effect] and shall cause a copy of such order

1397to be sent immediately to the parties by registered or certified

1408mail." § 766.309(2), Fla. Stat. Such an order constitutes

1417final agency act ion subject to appellate court review.

1426§ 766.311(1), Fla. Stat.

1430CONCLUSION

1431Based on the Statement of the Case and Conclusions of Law,

1442it is

1444ORDERED that Respondent Neurological Injury Compensation

1450Association's Motion for Summary Final Order is granted, and the

1460petition for compensation filed by Lashaunda Katrice Mason and

1469Alonzo Cochease Mason on behalf of , and as parents and natural

1480guardians of Z aivion Joel Mason , a minor, is dismissed with

1491prejudice.
