187PRELIMINARY STATEMENT
189On September 1, 2009, Ms. Weiss filed a Housing
198Discrimination Complaint with the Florida Commission on Human
206Relations (Commission). The Commission issued its Notice of
214Determination of Cause on October 28, 2009. The Commission
223filed a Petition for Relief on Ms. Weiss's behalf on
233November 30, 2009 . The Commission referred the Petition to the
244Division of Administrative Hearings (Division) on December 1,
2522009, for conduct of a hearing. The Division assigned it Case
263Number 09 - 6593 and scheduled the matter to be heard January 19,
2762010. Based upon the parties ' representation that they were in
287active settlement discussions likely to resolve the case, the
296Division, on January 15, 2010, closed its file and relinquished
306jurisdiction over the matter to the Commissi on.
314On March 19, 2010, the Commission moved to reopen the case
325because the parties had not reached an agreement. The Division
335reopened the matter under Case Number 10 - 1828 and scheduled the
347hearing for July 1, 2010. On Rolling Green's Motion to
357Continue , the hearing was rescheduled to August 19, 2010 , to be
368heard by video teleconference.
372The undersigned conducted the hearing as scheduled. The
380Commission offer ed the testimony of Leslie Goldstein, R obert
390Scott, and Michelle Weiss. It also offered Comm ission Exhibits
4001, 2, 3, 4, and 5 , which were admitte d into evidence. Rolling
413Green offered t he testimony of Selma Winston a nd Rolling Green
425Exhibits 3, 4, 6, and 7 , which were admitted into evidence.
436T he transcript was filed on September 13, 2010 . It
447a pparently was not served on all parties. The Commission filed
458its proposed recommended order on September 23, 2010. On
467September 28, 2010, Rolling Green filed a Motion to Require
477Filing of Entire Transcript of Proceedings and Extension of Time
487to File Pr oposed Recommended Order. An Order of September 28,
4982010, extended the date for filing proposed recommended orders
507until October 12, 2010 , and informed the parties that the
517recommended order would issue on or before November 12, 2010.
527Rolling Green filed its Proposed Recommended Order on
535October 12, 2010.
538FINDINGS OF FACT
541Based on the testimony and other evidence presented at the
551final hearing and on the entire record of this proceeding, the
562following findings of fact are made:
5681. Ms. Weiss lives with her son , Jeremy, in Rolling Green
579Cond omin i um. At the time of the hearing, Jeremy was 15 years
593old . Early in his life, Jeremy experienced a number of
604difficult events. The events included abandonment by his
612father, a painful growth inhibiting illness , t he drowning of his
623dog, and discovering, in their shared home, the body of his
634beloved grandfather , who committed suicide.
6392. T he Rolling Green Declaration of Condominium and the
649Association Rules, Regulations, and Procedures prohibit pets,
656except bird s and fishes, unless permitte d by written exception.
667When Ms. Weiss purchased her condominium , she was well aware of
678the pet prohibition and had signed two documents acknowledging
687the prohibition .
6903 . Despite the pet prohibition, Ms. Weiss obtained a ca t
702in 2006. Ms. Weiss still has the cat. She never sought an
714exception from the A ssociation to permit keep ing the cat.
7254 . In January of 2 009 , the dog of one of Ms. Weiss's co -
741workers birthed miniature Pomeranian puppies. Despite the
748prohibition against pets, Ms. Weiss took a puppy home to care
759for it while her co - worker looked for a home for it .
773Ms. Weiss's son , Jeremy, named the dog Wolf and quickly warmed
784to him. The boy and dog played together and grew close. Jeremy
796a ssumed responsib ili ty for the car e of Wolf.
8075 . Ms. Weiss believed that the relationship with the dog
818improved her son's dem e anor . Because of this, s he wanted to
832keep Wolf , who is now full grown and weighs about seven pounds .
845Ms. Weiss did not seek an exception to the Rolling Green
856prohibit i on of pets.
8616 . When the A ssociation learned of the dog, it sent
873Ms. Weiss a letter reminding her of the pet prohibition and
884directing her to remove the dog from the premises . This
895triggered Ms. Weiss's effort to obtain an exception to the pet
906p rohibition.
9087 . Ms. Weiss took Jeremy to Mr. Scott , a therapist .
920Mr. Scott is a licensed clinical social worker and c ertified
931a ddiction p rofessional. Mr. Scott had provided Ms. Weiss
941services before. But h e had never seen Jeremy or provided him
953servic es. Other mental health couns e l o rs , however, had treated
966Jeremy before.
9688 . Mr. Scott evaluated Jeremy using diagnostic tools. He
978concluded , and the undersigned finds , that Jeremy had a major
988depressive disorder - mild. Dr. Scott also concluded , and the
998undersigned finds , that a support animal is helpful tr eatment
1008for Jeremy's disorder.
10119 . At the time of the hearing, Jeremy was in the eighth
1024grade, the appropriate grade for his age. He had attended
1034school and successfully moved from grade to grade desp ite the
1045experiences of his youth and his disorder. Jeremy rides the bus
1056home from school with friends and cares for himself after school
1067until Ms. Weiss comes home from work. Jeremy completed his Bar
1078Mitzvah ceremony. In the ceremony he recited portions of the
1088Torah in Hebrew to over 100 guests. There is no persuasive
1099evidence that Jeremy's disorder substantially limits one or more
1108major life activities .
11121 0 . Rolling Hills has previously permitted exceptions to
1122its no pets polic y . The current manageme nt recognized that
1134previous management had not follow ed the procedures for
1143exceptions and had approved exceptions inappropriately and
1150inconsistently. The current management gave all owners notice,
1158before Jeremy obtained Wolf , that it intended to uniformly
1167enforce the pet prohibition in the future, while recognizing it
1177should honor the previously approved exceptions.
11831 1 . Rolling Green did not grant Ms. Weiss an exception to
1196the pet prohibition for Wolf and does not intend to grant an
1208exception .
1210CONCLUSIONS OF LAW
12131 2 . T he Division of Administrative Hearings has
1223jurisdiction over the subject matter of this proceeding and of
1233the parties pursuant to Sections 120.569, 120.57(1), and 760.35
1242Florida Statutes (2010) .
12461 3 . The Commission brings this cla im, on behalf of
1258Ms. Weiss and Jeremy, under Florida's Fair Housing Act, Sections
1268760.20 - 760.37, Florida Statutes (Fair Housing Act). It claims
1278that Rolling Green discriminated against Jeremy on account of a
1288handicap by denying a reasonable accommodation for a handicap.
1297The alleged reasonable accommodation is granting an exception
1305from the no pets rule for Wolf.
13121 4 . The Commission bears the burden of proving by a
1324preponderance of the evidence that Rolling Green violated the
1333F air Housing Act . See §§ 760. 34(5) a nd 120.57(1)(j), Fla. Stat.
1347(2010).
13481 5 . Section 760.23( 8 ), Florida Statutes, makes it unlawful
1360to discriminate against anyone on account of a handicap in the
1371sale or rental of housing. Discrimination includes refusal to
1380make a reasonable accommoda tion that will allow a person with a
1392handicap an equal opportunity to use and enjoy a dwelling.
1402§ 760.23(9)(b), Fla. Stat.
14061 6 . A person has a handicap if the "person has a physical
1420or mental impairment which substantially limits one or more
1429major life ac tivities, . . . ." § 760.22(7)(a), Fla. Stat. The
1442facts establish the first half of the definit i on. Jeremy has
1454the mental impairment of major depressive disorder - mild. The
1464facts do not establish the second half.
14711 7 . Depression can be a serious illness. But depression
1482alone is not a handicap as defined in statute. Pritchard v
1493Southern Company Services , 92 F. 3d 113 0, 1133 (11th Cir. 1996) ,
1505reh. denied , Pritchard v. Southern Co. Servs. , 102 F.3d 1118
1515(1996) . 2 Diagnosi s of a mental impairment does not establish a
1528handicap. Limitation of one or more major life activities
1537resulting from depression must be proven to establish a
1546handicap. Pritchard v. Southern Servs. , at 1132.
15531 8 . The Commission relies upon Auburn Woods I Homeowners
1564Assn. v. Fair Employment & Housing Comm. , 121 Cal. App. 4th 1578
1576(Cal. App. 3d Dist. 2004) , and Majors v. Housing Authority of
1587County of De Kalb , 652 F.2d 454 (5th Cir. 1981). Both cases
1599hold that permitting a companion or therapy animal may be a
1610required reasonable accommodation for a mental impairment,
1617including depression. The holdings of each case depend heavily
1626upon the facts. Those facts differ from the facts proven here.
163719 . The stipulated facts in Majors included that
1646Ms. Majors wa s handicapped as defined in statute and that she
1658required the companionship of her dog. The holding does not
1668address the issue here, which is whether the mental impairment
1678substantially limits one or more major life activities.
168620. The facts in Auburn Wo ods I , were determined by
1697findings of fact of an administrative law judge made af t er an
1710evidentiary hearing. The opinion notes the importance to its
1719decision of the standard of review and emphasizes that the
1729appellate court's function is to determine if there ha s been an
1741abuse of discretion and if the findings a re based on substantial
1753evidence. The opinion also notes that the appellate court may
1763not reweigh the evidence and must review the evidence in the
1774light most favorable to the findings. Here, of c ourse, the
1785issue is what findings the evidence will support in the first
1796instance.
179721. In Auburn Woods I , t he facts included a finding that
1809both complainants suffered from multiple mental disorders. One
1817complainant engaged in self mutilation, had sleep ing problems,
1826and avoided social interaction. The other was incapable of
1835working due to bipolar disorder, obsessive - compulsive
1843personality disorder, and seizure disorder following a severe
1851automobile accident that r equired three brain surgeries. Self -
1861mu tilation, inability to sleep, and inability to work were all
1872substantial limitations upon major life activities. Whether the
1880complainants' impairments amounted to handicaps was not a
1888disputed issue in the case. The issue was whether permitting a
1899companio n animal was a required reasonable accommodation to the
1909handicap. The court held, based up on the specific facts of the
1921case , that it was. The opinion emphasizes that the question of
1932what i s a reasonable accommodation i s a question of fact. The
1945court al so noted that its decision did not mean that permitting
1957a companion animal is always a required reasonable
1965accommodation . Auburn Woods I Homeowners Assn. v. Fair
1974Employment & Housing Comm. , 121 Cal. App. 4th 1578 , 1595 (Cal.
1985App. 3d Dist. 2004)
19892 2 . Estab lishing substantial limits on one or more major
2001life activities requires proof that the mental impairment
2009prevents or restricts an individual from doing activities that
2018are of central importance to the person's life. Toyota Motor
2028Mfg., Ky. v. Williams , 53 4 U.S. 184 , 198 - 202 (2002); Hutcheson v
2042MacFarland and Sand Dune Properties , Case No. 07 - 1087 (Fla. DOAH
2054Dec. 7, 2007) , p. 16 , adopted by FCHR Order No. 08 - 014 (Feb. 8,
20692008). The Commission established that Jeremy had a mental
2078impairment. But the Commission did not present persuasive
2086evidence that the impairment "substantially limits one or more
2095major life activities."
2098RECOMMENDATION
2099Based on the foregoing Findings of Fact and Conclusions of
2109Law, it is RECOMMENDED that the Florida Commission o n Human
2120Relations enter a Final Order deny ing the Petition of Michelle
2131Weiss and finding that Rolling Green Condominium D, Association,
2140did not unlawfully discriminate against Michelle Weiss or her
2149son .
