129PRELIMINARY STATEMENT
131Petitioner filed a Housing Discrimination Complaint
137(Complaint) against Respondent in January 2010. On March 23,
1462010, the Florida Commission on Human Relations (Commission),
154through its Executive Director, issued a Determination of No
163Cause, advising that, following an investigation, the Commission
171had "determined that reasonable cause d[id] not exist to believe
181that a discriminatory housing practice ha[d] occurred."
188On April 5, 2010, Petitioner filed with the Commission a
198Petition for Relief (Petition). The Commission transmitted the
206Petition to DOAH on April 8, 2010.
213The final hearing in the instant case was scheduled by
223video teleconference at sites in Miami and Tallahassee for
232July 2, 2010, commencing at 9:00 a.m. Petitioner and Respondent
242were provided with written notice of the scheduled hearing in
252accordance with Section 120.569(2)(b), Florida Statutes. Such
259notice was in the form of a Notice of Hearing by Video
271Teleconference mailed on April 20, 2010, to Petitioner and to
281Respondent's counsel of record, Benjamin Esco, Esquire.
288Respondent appeared at the hearing, which was held as
297scheduled on July 2, 2010, through its counsel of record,
307Mr. Esco. Petitioner, on the other hand, did not make an
318appearance at the hearing, either in person or through counsel
328or any other authorized representative.
333After waiting approximately 50 minutes for Petitioner to
341appear, and not having heard from her, the undersigned went on
352the record. Mr. Esco, on behalf of Respondent, declined to
362present any evidence, arguing, persuasively, that it was
370Petitioner, not Respondent, who had the burden of proof and that
381therefore Petitioner's failure to appear at the hearing and
390offer evidence in support of her allegations of discrimination
399should result in the Commission's dismissing Petitioner's
406Complaint and Petition. The undersigned indicated that he
414agreed and that he would issue an order recommending that the
425Commission take such action. The hearing was thereupon
433concluded.
434FINDINGS OF FACT
4371. Because no evidence was offered at the final hearing
447held in the instant case, no findings of fact are made.
458CONCLUSIONS OF LAW
4612. DOAH has jurisdiction over the subject matter of this
471proceeding and of the parties hereto pursuant to Chapter 120,
481Florida Statutes.
4833. Florida's Fair Housing Act (Act) is codified in
492Sections 760.20 through 760.37, Florida Statutes.
4984. Among other things, the Act makes certain acts
"507discriminatory housing practices" and gives the Commission the
515authority, if it finds (following an administrative hearing
523conducted by an administrative law judge) that such a
"532discriminatory housing practice" has occurred, to issue an
540order "prohibiting the practice" and providing "affirmative
547relief from the effects of the practice, including quantifiable
556damages and reasonable attorney's fees and costs."
563§ 760.35(3)(b), Fla. Stat.
5675. In the instant case, Petitioner has claimed, in her
577Complaint and Petition, that she was the victim of a
587discriminatory housing practice committed by Respondent.
5936. Pursuant to Section 760.34(5), Florida Statutes, it was
602Petitioner's burden to prove at the final hearing held in this
613matter that this discriminatory housing practice in fact
621occurred.
6227. Petitioner, however, failed to make an appearance at
631the hearing and present any evidence in support of her
641allegations of discrimination, despite having been afforded
648proper notice of the hearing.
6538. Accordingly, Petitioner's Complaint and Petition must
660be dismissed.
662RECOMMENDATION
663Based upon the foregoing, it is hereby
670RECOMMENDED that the Commission issue a Final Order
678dismissing Petitioner's Complaint and Petition.
