107STATEMENT OF THE ISSUE

111The issue is whether Petitioner is eligible to receive a

121license to operate a group home.

127PRELIMINARY STATEMENT

129Petitioner owned and operated a licensed group home for

138persons with developmental disabilities. She was notified by

146letter dated March 30, 2010, that her application to renew the

157license was denied by the Respondent pursuant to Sections

166393.067 and 393.0673, Florida Statutes (2009). On April 16,

1752010, Respondent received Petitioner's Election of Rights

182disputing the facts upon which the denial was based and

192requesting an evidentiary hearing. Respondent transferred the

199case to the Division of Administrative Hearings on April 27,

2092010. The final hearing was scheduled, by Notice dated May 11,

2202010, and was held on June 11, 2010.

228At the hearing, Respondent called five witnesses: Child

236Protective Investigator Kathleen Forsman; Adult Abuse Protective

243Investigator Martin Markowitz; Adult Protective Investigator

249Sonia Dixon; Human Services Program Analyst Cordroy Charles; and

258Area 15 Program Administrator Peter Karlan. Respondent's

265Exhibits 1 through 6 were received in evidence. At the request

276of Respondent, Petitioner testified on her own behalf and

285presented the testimony of a person who is developmentally

294disabled and will be identified only by the initials P. A. M.

306Petitioner's Exhibits C, D, E, F, and G were received in

317evidence. Proposed Recommended Orders were received July 8,

3252010. No transcript of the proceedings was filed.

333FINDINGS OF FACT

3361. In 2006, Petitioner Francoise Antoine ("Petitioner" or

"345Ms. Antoine") operated an Agency for Persons with Disabilities

355("APD") licensed group home for persons with developmental

365disabilities. It was called "Just Like Home" and was located on

376Ranch Avenue in Port St. Lucie, Florida.

3832. Respondent Agency for Persons with Disabilities ("APD"

392or "Respondent") is the State agency responsible for licensing

402group homes for persons with developmental disabilities,

409pursuant to Section 393.067, Florida Statutes (2009).

4163. In December 2006, the Department of Children and Family

426Services ("DCF") responded to a hotline allegation of abuse of a

439resident, F. G., at Just Like Home, by sending Child Protective

450Investigator Kathleen Forsman to the home. She found that

459F. G., a non-verbal, severely mentally handicapped 15-year-old,

467had scratches on her arms and face, bite marks, and a swollen

479hand, and determined that her wounds were inflicted by another

489resident. As a result, F. G. was moved to another home and

501Ms. Forsman made verified findings of inadequate supervision by

510the responsible caretaker, Ms. Antoine, for failing to

518adequately protect F. G. from injury.

5244. Ms. Antoine knew that F. G. was bitten by her roommate.

536Ms. Antoine noticed marks on F. G. when she was dressing her for

549school and notified her school. Someone at the school

558apparently reported the injuries over the abuse hotline.

566Ms. Antoine submitted the required incident report to APD and,

576at the suggestion of the DCF investigator, she called the

586police, and the resident who inflicted injuries on F. G. was

597arrested.

5985. The DCF investigator notified APD of her findings. APD

608Program Analyst Cordroy Charles saw F. G. and other residents on

619January 8, 2007, when F. G.'s bite marks with teeth prints and

631her swollen arm were still visible. Because Ms. Antoine seemed

641to lack any sense of urgency about getting medical care for

652F. G., Mr. Charles recommended relocating all of the residents,

662and the group home on Ranch Avenue was closed. The license

673expired in January 2008.

6776. On or about April 16, 2007, Ms. Antoine received a

688license from the Agency for Health Care Administration ("AHCA")

699to operate an adult family care home, called "Abbie's AFCH,"

709located on Del Rio Boulevard in Port St. Lucie. On August 1,

7212008, Ms. Antoine took E. B., a resident of the Del Rio home,

734with her to the Ranch Avenue location, so that she could use a

747computer. She left him at the home alone while, she said, she

759had went to get him a hamburger for lunch.

7687. E. B. is a vulnerable adult with physical limitations.

778He walks with a cane. He is also mentally ill and requires

790psychotropic medications. While he was alone, E. B. telephoned

799911, and expressed concern that someone was going to hurt him.

8108. When law enforcement personnel and DCF Adult Protective

819Investigator Martin Markowitz arrived, E. B. was alone and

828disoriented. There was old food in the refrigerator and

837evidence that he had fixed macaroni for himself. The

846temperature in the house was uncomfortably hot, in the mid-to-

856upper-80s with only a ceiling fan running. Mr. Markowitz found

866empty bottles of psychotropic prescription drugs with E. B.'s

875name on them, but was unable to determine if E. B. had been

888given his medication as prescribed.

8939. E. B. was committed pursuant to the Baker Act, and a

905different subsequent placement for him was recommended by

913Mr. Markowitz. After being called by a law enforcement person,

923Ms. Antoine arrived at the house. Mr. Markowitz recalled her

933saying that she had fed E. B. a hamburger for lunch but left him

947because he did not want to return to the licensed Del Rio home.

960Ms. Antoine was arrested for operating, owning, or maintaining

969an assisted living facility without a license. The charges

978later were dropped by the State Attorney.

98510. Mr. Markowitz made verified findings of inadequate

993supervision and medical neglect of a vulnerable adult by the

1003responsible caretaker, Ms. Antoine, with regard to her treatment

1012of E. B. Residents were removed but later allowed to return to

1024the Del Rio home. Ms. Antoine's current AHCA-issued license to

1034operate an adult family care home on Del Rio was effective

1045April 16, 2009, and expires April 15, 2011.

105311. On October 20, 2008, P. A. M., a developmentally

1063disabled vulnerable adult resident of the group home on Del Rio,

1074called 911 for another resident, O. J., after she told him that

1086she was depressed and thinking of hurting herself. At the time,

1097Ms. Antoine was in the home, in her bedroom watching television.

1108She was not aware of the emergency telephone call until the

1119police arrived, according to P. A. M.

112612. Ms. Antoine had responded earlier in the day to

1136O. J.'s complaint of a headache and had taken her to the doctor

1149who prescribed a pain reliever for O. J. Nevertheless, after

1159meeting O. J. in an acute care unit of a mental health facility,

1172Adult Protective Investigator Sonia Dixion made verified

1179findings of medical neglect against Ms. Antoine, the responsible

1188caretaker for O. J.

119213. Ms. Antoine submitted an application that was

1200notarized January 26, 2010, to APD for licensure of a

1210residential facility at the same Ranch Avenue address of the

1220previous APD-licensed "Just Like Home." The facility was to be

1230named "Excell Group Care Home." Ms. Antoine did not check

1240whether the application was for an initial license or renewal of

1251a license. She also represented falsely that she had not been

1262identified as a person responsible for the abuse or neglect of a

1274child or vulnerable adult.

127814. APD treated the application as an initial application

1287because the license for "Just Like Home" had expired in 2008.

1298The Area Program Administrator said the use of the word

"1308renewal" in the Notice to Ms. Antoine was a scrivener's error.

1319CONCLUSIONS OF LAW

132215. The Division of Administrative Hearings has

1329jurisdiction over the subject matter and the parties to this

1339proceeding. §§ 120.569 and 120.57, Fla. Stat. (2010).

134716. In general, an applicant has the burden of proving

1357entitlement to a license by a preponderance of the evidence.

1367See Dept. of Banking & Finance v. Osborne Stern & Co. , 670 So.

13802d 932, 934 (Fla. 1996). If, however, a licensing agency

1390proposed to deny a renewal license based upon specific statutory

1400or rule violations, then it has the burden of proving a lack of

1413entitlement to the renewal. See Robert's Large Family Daycare

1422Home v. Dept of Children and Family Services , DOAH Case No. 08-

14343027 (R.O. September 5, 2008, F.O. January 5, 2009), citing Coke

1445v. Dept of Children and Family Services , 704 So. 2d 726 (Fla.

14575th DCA 1998).

146017. Initially, there was some confusion over whether the

1469Petitioner was applying for an initial or a renewal license.

1479Petitioner did not indicate which it was on the application

1489form, and the notice given by Respondent said;"[Y]our

1498application for renewal for licensure as a group home has been

1509denied . . .." At hearing Respondent took the position that

1520this was an initial application. Florida Administrative Code

1528Rule 65G-2.005 provides, in relevant part, that:

1535(4) A license shall be revoked whenever an

1543operator does not make his/her annual

1549written application for license renewal.

155418. An application for renewal must be filed before the

1564expiration of the existing license. Dept. of Children and

1573Family Services v. Ms. Sylvia's It's A Better World Daycare and

1584Learning Center , 2003 Fla.Div.Admin.Hear LEXIS 1108, DOAH Case.

1592No. 03-3153 (R.O. December 12, 2003, F.O. March 19, 2004). By

1603its terms the prior application expired in January 2008, and the

1614application at issue in this case, filed January 2010, is a new

1626application. See Lamar's Companion Service Corp., etc. v.

1634Agency for Person's with Disabilities , 2009 Fla.Div.Admin.Hear.

1641LEXIS 625, DOAH Case No. 09-1540 (R.O. August 19, 2009; F.O.

1652November 6, 2009). Therefore, the Petitioner has the burden in

1662this case.

166419. Section 393.0673, Florida Statutes, provides, in

1671relevant part, as follows:

1675(1) The agency may revoke or suspend a

1683license or impose an administrative fine,

1689not to exceed $1,000 per violation per day,

1698if:

1699(a) The licensee has:

17031. Falsely represented or omitted a

1709material fact in its license application

1715submitted under s. 393.067:

17192. Had prior action taken against it

1726under the Medicaid or Medicare program; or

17333. Failed to comply with the applicable

1740requirements of this chapter or rules

1746applicable to the licensee; or

1751(b) The Department of Children and

1757Family Services has verified that the

1763licensee is responsible for the abuse,

1769neglect, or abandonment of a child or the

1777abuse, neglect, or exploitation of a

1783vulnerable adult.

1785(2) The agency may deny an application for

1793licensure submitted under s. 393.067 if :

1800(a) The applicant has:

18041. Falsely represented or omitted a

1810material fact in its license application

1816submitted under s. 393.067:

18202. Had prior action taken against it

1827under the Medicaid or Medicare program;

18333. Failed to comply with the applicable

1840requirements of this chapter or rules

1846applicable to the applicant; or

18514. Previously had a license to operate a

1859residential facility revoked by the agency,

1865the Department of Children and Family

1871Services, or the Agency for Health Care

1878Administration; or

1880(b) The Department of Children and Family

1887Services has verified that the applicant is

1894responsible for the abuse, neglect, or

1900abandonment of a child or the abuse,

1907neglect, or exploitation of a vulnerable

1913adult.

1914(Emphasis added.)

191618. In light of the statutory provisions, Respondent APD

1925was justified in denying Petitioner's application for making a

1934false statement in the license application that she had not been

1945identified as responsible for the abuse or neglect of a child or

1957vulnerable adult; and for having been verified by DCF as the

1968caretaker responsible for the abuse or neglect of both a child

1979and a vulnerable adult.

1983RECOMMENDATION

1984Based on the foregoing Findings of Fact and Conclusions of

1994Law, it is recommended that the Agency for Persons with

2004Disabilities enter a Final Order denying the application filed

2013by Petitioner for a license to operate a group home in Port St.

2026Lucie, Florida.
