32SUMMARY FINAL ORDER

35This matter was filed at the Division of Administrative

44Hearings on April 27, 2010, by Petitioner. Pursuant to

53Subsection 120.25(5), Florida Statutes (2009), the matter was

61assigned to the undersigned Administrative Law Judge. On May 3,

712010, Petitioner served its Firs t Request for Admissions and

81First Interrogatories on Respondent. Responses to the discovery

89requests were due on or before June 7, 2010.

98On June 10, 2010, Petitioner filed a Motion for Summary

108Final Order setting forth the following facts which are deem ed

119admitted by Respondent:

1221. On or about July 3, 2007, Respondent filed a State of

134Florida Appointment of Campaign Treasurer and Designation of

142Campaign Depository for Candidates form with the Clerk's Office

151of the City of Largo, designating himself as the treasurer for

162his upcoming political campaign.

1662. On or about July 6, 2007, Respondent filed a Statement

177of Candidate form, indicating that he had read and understands

187the requirements of Chapter 106, Florida Statutes.

1943. On or about July 2, 2007, Respondent received a

204candidate packet from the City of Largo which included an

214Election Calendar and a Campaign Treasurer Reporting Periods and

223Due Dates form.

2264. On or about August 11, 2007, Respondent attended a

236candidate training class.

2395. Respond ent received a letter from Diane L. Bruner,

249clerk of the City of Largo, dated January 9, 2008, reminding

260Respondent that his campaign termination report was due no later

270than February 4, 2008.

2746. Respondent received a letter dated February 11, 2008,

283fro m Ms. Bruner reminding him that his campaign termination

293report had not been timely filed.

2997. As of this date, Respondent has willfully failed to

309file his campaign termination report as required by law.

318Based upon the foregoing, it is

324ORDERED that Resp ondent is in violation of Subsection

333106.141(1), Florida Statutes (2009), in that he has failed to

343file a campaign termination report listing the disposition of

352surplus campaign funds as required by law. Respondent shall pay

362a civil penalty in the amount of One Thousand Dollars

372($1,000.00) to the Florida Elections Commission within 30 days

382of the date of this Order.
