149Whether El Sol Trading, Inc. ( El Sol ) should be permitted ,

192PRELIMINARY STATEMENT
194On A pril 2 , 2010 , a notice was published in the Florida
206Administrative Weekly that El Sol intended "to allow the
215establishment of Eco Green Machine LLC, d/b/a Eco Green Machine ,
225LLC, as a dealership for the sale of motorcycles manufactured by
236Jiangmen Qipai Motorcycle Co, Ltd . (QIPA) at 7000 Park
246Boulevard, Pinellas Park, Florida . . . ." On April 30, 2010 ,
258Respondent filed with Department of Highway Safety and Motor
267Vehicles (Department) a letter protesting the establishment of
275this additional dealership. On May 5, 2010 , the matter was
285referred to DOAH to "be heard by an Administrative Law Judge."
296The final hearing was originally scheduled for June 17,
3052010, but was continued and rescheduled for November 9, 2010 .
316Petitioners and Respondent were provided with written notice of
325the re scheduled hearing in accordance with Section
333120.569(2)(b), Florida Statutes (2010) .
338As noted above, the fi nal hearing was held, as scheduled,
349on November 9, 2010 . Petitioner Eco Green Machine LLC, d/b/a
360Eco Green Machine and Respondent appeared at the hearing through
370their respective representative s . Petitioner El Sol , on the
380other hand, made no appearance.
385One witness , David Dubin , Respondent's secretary and
392business manager , testified at the hearing. In addition to
401M r. Dubin's testimony, one exhibit (Respondent's Exhibit 1) was
411offered and received into evidence.
416At the conclusion of the evidentiary portio n of the
426hearing, the undersigned announced on the record that, if the
436parties desired to file proposed recommended orders, they were
445required to do so no later than November 15, 2010. Later that
457sam e day, the undersigned issued a written order advising t hat
469the deadline for the filing of proposed recommended orders was
479November 15, 2010 (as had been announced at the final hearing).
490The proposed recommended order filing deadline passed
497without any party having filed a proposed recommended order.
506FINDINGS OF FACT
509Based on the evidence adduced at hearing, and the record as
520a whole, the following findings of fact are made :
5301. Respondent is an existing franchised dealer of QIPA
539Motorcycles .
5412. Its dealership is located at 6239 Park Boulevard ,
550Pinellas Park, Florida .
5543. The driving distance between Respondent's dealership
561and the location of the new dealership El Sol proposes to
572establish at 7000 Park Boulevard, Pinellas Park, Florida, is
581roughly one mile .
585CONCLUSIONS OF LAW
5884. DOAH has jurisdiction o ver the subject matter of this
599proceeding and of the parties hereto pursuant to Chapter 120,
609Florida Statutes (2010) .
6135. El Sol is seeking the Department's approval of a
623proposal to establish a new dealership for the sale of QIPA
634Motorcycles at 7000 Park Boulevard, Pinellas Park, Florida . It
644is seeking such approval pursuant to Section 320.642, Florida
653Statutes (2010) .
6566. Subsection (2)(a) of Section 320.642, Florida Statutes
664(2010) , provides that such approval shall be denied if:
6731. A timely protest is filed by a presently
682existing franchised motor vehicle dealer
687with standing to protest as defined in
694subsection (3); and
6972. The licensee fails to show that the
705existing franchised dealer or dealers who
711register new motor vehicle retail sales or
718retail l eases of the same line - make in the
729community or territory of the proposed
735dealership are not providing adequate
740representation of such line - make motor
747vehicles in such community or territory.
753The burden of proof in establishing
759inadequate representation s hall be on the
766licensee.
7677. Pursuant to Subsection (3)(b)1. of Section 320.642,
775Florida Statutes (2010) , "if the proposed additional . . . motor
786vehicle dealer is to be located in a county with a population of
799more than 300,000," such as in the instant case, "[a]ny existing
811motor vehicle dealer or dealers of the same line - make hav[ing] a
824licensed franchise location w ithin a radius of 12.5 miles of the
836location of the proposed additional . . . motor vehicle dealer"
847has standing to file a "protest," within the meaning of
857Subsection (2)(a)1. of the statute.
8628. To be timely , the protest " must be filed within 30 days
874foll owing the date of publication of the notice [of the proposed
886new dealership] in the Florida Administrative Weekly."
893§ 320.642(1), Fla. Stat. (2010).
8989 . With respect to the proposed new dealership in the
909instant case ( notice of which was given in the Apri l 2, 2010,
923publication o f Florida Administrative Weekly) , Respondent is an
"932existing motor vehicle dealer" who has standing to file a
942protest.
94310 . By timely filing its protest (on April 30, 2010) and
955establishing (through its evidentiary presentation at h earing)
963its standing to file this protest , Respondent effectively
971imposed upon El Sol , by operation of the provisions of
981Subsection (2)(a)2. of Section 320.642, Florida Statutes (2010) ,
989the burden of proving there is "inadequate representation" in
998the community or territory of the proposed new dealership.
100711 . H aving presented no evidence at the final hearing, El
1019Sol failed to meet this burden of proof.
102712 . The approval that El Sol is seeking in the instant
1039case must therefore be denied.
1044RECOMMENDATION
1045Based upon the foregoing Findings of Fact and Conclusions
1054of Law, it is hereby
1059RECOMMENDED that the Department of Highway Safety and Motor
1068Vehicles issue a Final Order denying El Sol approval to
1078establish a new QIPA Motorcycle dealership at 7000 Park
1087Bou levard, Pinellas Park, Florida .
