172STATEMENT OF THE ISSUE S
177The issue s in this case are whether the statement contained
188in Respondent's letter dated September 9, 1997 (1997 Letter),
197establishing a $24.00 payment for hospital outpatient services
205billed as revenue code 451 constitutes a rule as defined by
216Subsection 120.52(15), Florida Statutes (2010), 1 and, if so,
225whether Respondent violated Subsection 120.54(1), Florida
231Statutes, by not adopting the statement in accordance with
240applicable rulemaking procedures.
243PRELIMINA RY STATEMENT
246On June 1, 2010, Petitioners, Baptist Hospital, Inc., Bay
255Medical Center, Holmes Regional Medical Center, Inc., Lee
263Memorial Health System, Lifemark Hospitals of Florida, Inc. ,
271d/b/a Palmetto General Hospital, Munroe Regional Medical Center,
279N orth Broward Hospital District , d/b/a Broward Health,
287St. Joseph's Hospital, Inc., South Broward Hospital District ,
295d/b/a Memorial Regional Hospital, Tallahassee Memorial
301Healthcare, Inc., and Wuesthoff Health System (collectively
308referred to as Petitione rs), filed a Petition for Determination
318of Invalidity of Non - Rule Policy. Specifically, Petitioners are
328challenging certain provisions of a letter from Respondent,
336Agency for Health Care Administration (AHCA), dated September 9,
3451997, to hospital administ rators.
350On October 15, 2010, AHCA filed AHCA's Motion for Summary
360Final Order , in which AHCA conceded that the challenged
369statement of the 1997 L etter constitutes a rule, which has not
381been promulgated pursuant to Section 120.54, Florida Statutes.
389At the request of Petitioners, the motion was heard by
399telephonic conference call on October 18, 2010. Petitioners
407requested and were granted leave to file a proposed final order.
418Petitioners filed their Proposed Final Order on October 29,
4272010.
428FINDINGS OF FAC T
4321. AHCA is the s tate agency responsible for the
442administration of the Florid a Medicaid Program. § 409.902, Fla.
452Stat.
4532. Petitioners are acute care hospitals that are and were
463enrolled as Medicaid providers of outpatient services in
471Florida, at all ti mes relevant to this proceeding.
4803. On September 9, 1997, AHCA issued a letter to hospital
491administrators, which provided the following:
496This letter is to inform you that Medicaid
504coverage for hospital emergency room
509screening and examination services is now in
516effect. Hospitals will be reimbursed a
522$24.00 flat fee for providing these services
529to Medipass and Medicaid fee - for - service
538recipients who do not require further
544treatment beyond the screening an d
550examination services. This policy is
555retroactive to July 1, 1996.
560The letter further provides that the $24.00 reimbursement would
569be billed under the revenue code 451.
5765. The statement in the letter applies to hospitals which
586are Medicaid providers and, therefore, is a statement of general
596applicabilit y. The statement meets the definition of a rule.
606AHCA concedes that the statement, which provides "payment of a
616$24 rate for Medicaid Hospital Outpatient Services billed under
625Revenue Code 451, constitutes a rule under s. 120.52(16), Fla .
636Stat."
6376. AHCA concedes that the statement has not been adopted
647as a rule by the rule adoption procedures provided in
657Section 120.54, Florida Statutes.
6617. AHCA has discontinued all reliance on the challenged
670statement.
671CONCLUSIONS OF LAW
6748. The Division of Administ rative Hearings has
682jurisdiction over the parties to and the subject matter of this
693proceeding. § 120.56, Fla . Stat . (2010).
7019. S ubs ection 120.52(16), Florida Statutes , defines a rule
711as follows:
713ÐRuleÑ means each agency statement of
719general applicabilit y that implements,
724interprets, or prescribes law or policy or
731describes the procedure or practice
736requirements of an agency and includes any
743form which imposes any requirement or
749solicits any information not specifically
754required by statute or by an existi ng rule.
763The term also includes the amendment or
770repeal of a rule. The term does not include:
779(a) Internal management memoranda which do
785not affect either the private interests of
792any person or any plan or procedure
799important to the public and which have no
807application outside the agency issuing the
813memorandum.
814(b) Legal memoranda or opinions issued to an
822agency by the Attorney General or agency
829legal opinions prior to their use in
836connection with an agency action.
841(c) The preparation or modification of:
8471. Agency budgets.
8502. Statements, memoranda, or instructions to
856state agencies issued by the Chief Financial
863Officer or Comptroller as chief fiscal
869officer of the state and relating or
876pertaining to claims for payment submitted
882by state agencies to the Chief Financial
889Officer or Comptroller.
8923. Contractual provisions reached as a
898result of collective bargaining.
9024. Memoranda issued by the Executive Office
909of the Governor relating to information
915resources management.
91710. S ubs ection 120.56(4), Florida Statutes, provides that
"926[a]ny person substantially affected by an agency statement may
935seek an administrative determination that the statement violates
943Subsection 120.54(1)(a)," Florida Statutes. Petitioners must
949show that the statement constitutes a rul e and that the
960statement has not been adopted as a rule by the rulemaking
971procedures described in Section 120.54, Florida Statutes.
97811. The challenged statement of reimbursing $24.00 for
986screening and examination is a rule, which has not been
996promulgate d as a rule in accordance with the rulemaking
1006procedures in Section 120.54, Florida Statutes, and, therefore,
1014violates Subsection 120.54(1)(a), Florida Statutes.
1019ORDER
1020Based on the foregoing Findings of Fact and Conclusions of
1030Law, it is ORDERED that the c hallenged statement contained in
1041AHCA's letter dated September 9, 1997, establishing a $24.00
1050payment for Medicaid hospital outpatient services billed under
1058revenue code 451 is invalid.
