13,2010,andthe2nd Amended Order of PenaltyAssessmentissuedonOctober6,2010,

hereinbyreference,areherebyadoptedasthe Department's Findings of Factinthiscase.

CONCLUSIONSOFLAW

12.BasedupontheFindings of Factadoptedherein,theDepartmentconcludesthat

GGR,L.L.C.violatedthespecificstatutesandrulesallegedintheStop-WorkOrderandOrder of

PenaltyAssessment,theAmendedOrder of PenaltyAssessment,andthe2ndAmendedOrder of

PenaltyAssessment,andherebyadoptstheviolation(s)chargedintheStop-WorkOrderand

Order of PenaltyAssessment,theAmendedOrder of PenaltyAssessment,andthe2ndAmended

Order of PenaltyAssessmentastheConclusions of Lawinthiscase.

PENALTYIMPOSED

13.TheOrderClosingFilefromtheDivision of AdministrativeHearings,theStop-

WorkOrderandOrder of PenaltyAssessment,theAmendedOrder of PenaltyAssessment,and

the2ndAmendedOrder of PenaltyAssessment,takentogetherwiththeFindings of Factand

Conclusions of Lawadoptedherein,constitutegroundsforthe Chief FinancialOfficertoimpose

thepenaltyassetforthherein.

ITISTHEREFOREORDEREDthat:

a.GGR, L.L.c. shallimmediatelypaythetotalpenalty of $284,375.20infulltothe

Department of FinancialServicesfordepositintotheWorkers'CompensationAdministration

TrustFund;and

b.GGR,L.L.C.shallimmediatelyceaseallbusinessoperationsintheState of

FloridauntilsuchtimeastheDepartmentissuesanorderreleasingtheStop-WorkOrderand

Order of Penalty Assessment.TheDepartmentshallnotissueanOrderreleasingtheStop-Work

OrderandOrder of PenaltyAssessmentuntilGGR,L.L.C.hascomeintocompliancewiththe

coveragerequirements of Chapter440,FloridaStatutes,andhaspaidatotalpenalty of

$284,375.20totheDepartment.
