145Whether El Sol Trading, Inc. (El Sol) should be permitted ,

187PRELIMINARY STATEMENT
189On A ugust 6 , 2010, a notice was published i n the Florida
202Administrative Weekly that El Sol intended "to allow the
211establishment of Eco Green Machine LLC, d/b/a Eco Green Machine ,
221LLC, as a dealership for the sale of motorcycles manufactured by
232Taizhou Zhongneng Motorcycle Co., Ltd. at 7000 Park Bou levard,
242Pinellas Park, Florida . . . ." On A ugust 18 , 2010, Respondent
255filed with the Department of Highway Safety and Motor Vehicles
265(Department) a letter protesting the establishment of this
273additional dealership. On August 20 , 2010, the matter was
282ref erred to DOAH to "be heard by an Administrative Law Judge."
294The final hearing was then scheduled for November 9, 2010 .
305Petitioners and Respondent were provided with written notice of
314the scheduled hearing in accordance with Section 120.569(2)(b),
322Florida Statutes (2010) .
326As noted above, the final hearing was held, as scheduled,
336on November 9, 2010 . Petitioner Eco Green Machine LLC, d/b/a
347Eco Green Machine and Respondent appeared at the hearing through
357their respective representative s . Petitione r El Sol , on the
368other hand, made no appearance.
373One witness , David Dubin , Respondent's secretary and
380business manager , testified at the hearing. In addition to
389M r. Dubin's testimony, one exhibit (Respondent's Exhibit 1) was
399offered and received into evid ence.
405At the conclusion of the evidentiary portion of the
414hearing, the undersigned announced on the record that, if the
424parties desired to file proposed recommended orders, they were
433required to do so no later than November 15, 2010. Later that
445same day, the undersigned issued a written order advising that
455the deadline for the filing of proposed recommended orders was
465November 15, 2010 (as had been announced at the final hearing).
476The proposed recommended order filing deadline passed
483without any party hav ing filed a proposed recommended order.
493FINDINGS OF FACT
496Based on the evidence adduced at hearing, and the record as
507a whole, the following findings of fact are made :
5171. Respondent is an existing franchised dealer of ZHNG
526Motorcycles .
5282. Its dealership is located at 6239 Park Boulevard ,
537Pinellas Park, Florida .
5413. The driving distance between Respondent's dealership
548and the location of the new dealership El Sol proposes to
559establish at 7000 Park Boulevard, Pinellas Park, Florida, is
568ro ughly one mile.
572CONCLUSIONS OF LAW
5754. DOAH has jurisdiction over the subject matter of this
585proceeding and of the parties hereto pursuant to Chapter 120,
595Florida Statutes (2010) .
5995. El Sol is seeking the Department's approval of a
609proposal to establish a new dealership for the sale of ZHNG
620Motorcycles at 7000 Park Boulevard, Pinellas Park, Florida . It
630is seeking such approval pursuant to Section 320.642, Florida
639Statutes (2010) .
6426. Subsec tion (2)(a) of Section 320.642, Florida Statutes
651(2010) , provides that such approval shall be denied if:
6601. A timely protest is filed by a presently
669existing franchised motor vehicle dealer
674with standing to protest as defined in
681subsection (3); and
6842. T he licensee fails to show that the
693existing franchised dealer or dealers who
699register new motor vehicle retail sales or
706retail leases of the same line - make in the
716community or territory of the proposed
722dealership are not providing adequate
727representation o f such line - make motor
735vehicles in such community or territory.
741The burden of proof in establishing
747inadequate representation shall be on the
753licensee.
7547. Pursuant to Subsection (3)(b)1. of Section 320.642,
762Florida Statutes (2010) , "if the proposed addi tional . . . motor
774vehicle dealer is to be located in a county with a population of
787more than 300,000," such as in the instant case, "[a]ny existing
799motor vehicle dealer or dealers of the same line - make hav[ing] a
812licensed franchise location within a radiu s of 12.5 miles of the
824location of the proposed additional . . . motor vehicle dealer"
835has standing to file a "protest," within the meaning of
845Subsection (2)(a)1. of the statute.
8508. To be timely , the protest " must be filed within 30 days
862following the date of publication of the notice [of the proposed
873new dealership] in the Florida Administrative Weekly."
880§ 320.642(1), Fla. Stat. (2010).
8859. With respect to the proposed new dealership in the
895instant case ( notice of which was given in the August 6, 201 0 ,
909publication o f Florida Administrative Weekly) , Respondent is an
"918existing motor vehicle dealer" who has standing to file a
928protest.
92910. By timely filing its protest (on August 18, 2010 ) and
941establishing (through its evidentiary presentation at hearing)
948its standing to file this protest, Respondent effectively
956imposed upon El Sol, by operation of the provisions of
966Subsection (2)(a)2. of Section 320.642, Florida Statutes (2010) ,
974the burden of proving there is "inadequate representation" in
983the community o r territory of the proposed new dealership.
99311 . H aving presented no evidence at the final hearing, El
1005Sol failed to meet this burden of proof.
101312 . The approval that El Sol is seeking in the instant
1025case must therefore be denied.
1030RECOMMENDATION
1031Based upo n the foregoing Findings of Fact and Conclusions
1041of Law, it is hereby
1046RECOMMENDED that the Department of Highway Safety and Motor
1055Vehicles issue a Final Order denying El Sol approval to
1065establish a new ZHNG Motorcycle dealership at 7000 Park
1074Boulevard, Pinellas Park, Florida.
