136STATEMENT OF THE ISSUE
140The issue is whether Petitioner properly imposed a fine of
150$50 against Respondent for failing to timely file an application
160for license renewal.
163PRELIMINARY STATEMENT
165On or about July 27, 2010, Petitioner Department of
174Children and Family Services (Petitioner) filed an
181Administrative Complaint against Respondent North Florida
187Daycare, Inc. d/b/a Alachua County Child Care Center
195(Respondent). The complaint al leged that Respondent violated
203Florida Administrative Code Rule 65C - 22.001(1)(d) by not filing
213for renewal of its license at least 45 days before its license
225expired. The complaint alleged that Respondent had to pay a $50
236fine pursuant to Florida Administ rative Code Rule 65C -
24622.010(2)(d).
247On July 29, 2010, Respondent filed a request for an
257administrative hearing to contest the allegations in the
265Administrative Complaint. Petitioner referred the hearing
271request to the Division of Administrative Hearings o n August 24,
2822010.
283On September 1, 2010, the undersigned issued a Notice of
293Hearing by Video Teleconference. The notice scheduled the
301hearing for October 28, 2010.
306During the hearing, Petitioner presented the testimony of
314two witnesses. Petitioner offered four exhibits that were
322accepted as evidence.
325Respondent presented the testimony of one witness.
332Respondent did not offer any exhibits for admission into the
342record.
343A transcript of the proceeding was not filed. Petitioner
352filed a Proposed Recommended Order on November 3, 2010. As of
363the date that this Recommended Order was issued, Respondent had
373not filed a proposed order.
378Except as otherwise noted, all references hereinafter shall
386be to Florida Statutes 2010.
391FINDINGS OF FACT
3941. Pet itioner is the state agency that is responsible for
405receiving and a pproving applications for child care facility
414licenses and for monitoring, regulating, and if necessary,
422suspendin g or revoking child care facility licenses for a
432violation of any provision o f Sections 402.301 through 402.319,
442Florida Statutes, or the rules adopted thereunder.
4492. The following facts are undisputed by the parties:
458a. Respondent is licensed by Pe titioner to
466operate a child care facility at 4138 North
474West Street, Gainesvil le, Florida 32609.
480b. By letter dated May 1, 2010, Petitioner
488notified Respondent that its renewal
493application was due June 21, 2010.
499Respondent knew that June 21, 2010, was the
507deadline for timely submission of the
513renewal application.
515c. Respon dent mailed her renewal
521application to Petitioner on June 21, 2010.
528d. The United States Post Office track and
536confirm notice shows that the application
542was accepted by mailing on June 21, 2010, at
5514:05 p.m.
553e. Petitioner received Respondent's renewa l
559application in Lake City, Florida, on
565June 28, 2010.
5683. Tami Hixon, Respondent's director/owner, testified that
575she telephoned Petitioner's office in Lake City, Florida, on
584June 21, 2010. According to Ms. Hixon, she spoke with Hannah
595Hall, Petition er's Administrative Assistant. Ms. Hixon claims
603that Ms. Hall gave her permission to mail Respondent's renewal
613application instead of driving to Lake City, Florida, to file it
624by hand delivery on June 21, 2010.
6314. Ms. Hixson claims she had been sick w ith bronchitis and
643had not completed the renewal application until June 21, 2010.
653Ms. Hixson asserts that she reli ed on the conversation with
664Ms. Hall in mailing the renewal application to Petitioner on
674June 21, 2010. Ms. Hixson's testimony in this regar d is not
686persuasive.
6875. Ms. Hall receives numerous telephone calls from
695childcare providers. She does not have an independent
703recollection of speaking with Ms. Hixson on June 21, 2010.
7136. Ms. Hall testified that she does not have authority to
724exte nd the time for filing renewal applications and would never
735have done so for any childcare provider, including Respondent.
744Ms. Hall's testimony in this regard is most persuasive.
7537. Sha'Leda Mirra is Petitioner's Child Care Licensing
761Supervisor. Ms. Mirra testified that the rule imposing a fine
771for late submission of renewal applications is strictly enforced
780on all providers. Only in extreme cases, such as a provider
791being in the hospital, has she ever waived the fine.
8018. According to Ms. Mirra, Ms. Hixson telephoned after
810receiving the Administrative Complaint. Ms. Hixson did not
818mention having bronchitis as a reason for the late filing during
829the telephone call.
8329. Receipt of renewal application 45 days before the
841license expiration date is necessary because licensing staff
849must check numerous documents for compliance. Additionally,
856childcare providers often must make corrections to their renewal
865applications. Receipt of renewal applications a few days before
874license expiration causes disr uption to families when a facility
884must be temporarily closed because the renewal is not complete
894or cannot be processed.
89810. Respondent's untimely license renewal application was
905processed and the fee paid before Respondent's license expired.
914Petitio ner's staff was able to complete the process , even th ough
926the application was missing a fire inspection certificate and
935despite Respondent's check being returned for insufficient
942funds.
94311. Ms. Mirra and another licensing supervisor are the
952only indivi duals who could have approved a late renewal
962application on June 21, 2010. Neither of them was in the office
974on that day. Petitioner's support staff, including Ms. Hall,
983has been well trained and knows not to tell anyone that it is
996acceptable to submit a late application.
1002CONCLUSIONS OF LAW
100512. The Division of Administrative Hearings has
1012jurisdiction over the parties and subject matter of this
1021proceeding pursuant to Sections 120.569 and 120.57(1), Florida
1029Statutes.
103013. Petitioner has the burden of proving by clear and
1040convincing evidence that Respondent should be fined for failing
1049to file it license renewal application in a timely manner. See
1060Department of Banking and Finance, Division of Securities and
1069Investor Protection v. Osborne Stern and Com pany , 670 So. 2d 932
1081(Fla. 1996). Petitioner has met this burden.
108814. Section 402.310(1), Florida Statutes, authorizes
1094Petitioner to impose disciplinary action for violation of
1102childcare licensing rules.
110515. Florida Administrative Code Rule 65C - 22.0 01(1)(d)
1114states as follows:
1117(d) A completed CF - FSP Form 5017 for
1126renewal of an annual license must be
1133submitted to the licensing authority at
1139least 45 days prior to the expiration date
1147of the current license to ensure that a
1155lapse of licensure does not occur. Failure
1162to submit a completed CF - FSP Form 5017 at
1172least 45 days prior to the expiration date
1180of the current license constitutes a
1186licensing violation as defined in paragraph
119265C - 22.010(2)(d), F.A.C.
119616. Florida Administrative Code Rule 65C - 22.010(2)(d)
1204states as follows:
1207(d) Failure to submit a completed CF -
1215FSP Form 5017, Application for License to
1222Operate a Child Care Facility, which is
1229incorporated by reference in paragraph 65C -
123622.001(1)(a), F.A.C. for renewal of an
1242annual license at least 45 days prior to the
1251expiration date of the current license
1257constitutes a licensing violations. The
1262department shall issue an administrative
1267complaint imposing a fine of $50.00 for the
1275first occurrence, $100.00 for the second
1281occurrence, and $200 .00 for each subsequent
1288occurrence within a five - year period.
129517. In this case, Petitioner properly determined that
1303Respondent should be fined $50.00 for failing to file its
1313license renewal in a timely manner. RespondentÓ s explanation
1322for its untimely submission is not persuasive and is therefore
1332insufficient to avoid the fine. Respondent has proved by clear
1342and convincing evidence that it had good cause to impose a
1353$50.00 fine on Respondent for the untimely submission.
1361RECOMMENDATION
1362Based on the f oregoing Findings of Fact and Conclusions of
1373Law, it is
1376RECOMMENDED:
1377That the Department of Children and Family Services enter a
1387final order imposing a $50.00 fine on Respondent.
